Mathew versus Grove & al.

Upon reading the Petition of Jane Mathew and others, Respondents, to the Petition and Appeal of Huttost Grove and others; praying, "That they may have a Copy of certain Articles, made between Sir John Crooke and Charles Crooke of the one Part, and Richard Ashby of the other Part, which are now in the Custody of the Appellant Grove:"

It is ORDERED, by the Lords Spiritual and Temporal in Parliament assembled, That the said Jane Mathew and others shall have a Copy of the said Articles, as desired; and that the Service of this Order upon the Appellant's Clerk in Chancery shall be good Service, in order thereunto.

Whitley's Bill.

The Earl of Stamford reported from the Committee, the Bill, intituled, "An Act to enable Roger Whitley the Elder Esquire, and Thomas Whitley Esquire, to exchange certain Lands, of equal Value, within the County of Chester;" without any Amendment.

Hodie 3a vice lecta est Billa, intituled, "An Act to enable Roger Whitley the Elder Esquire, and Thomas Whitley Esquire, to exchange certain Lands, of equal Value, within the Cunty of Chester."

The Question was put, "Whether this Bill shall pass?"

It was Resolved in the Affirmative.

Message to H. C. that the Lords have passed it.

A Message was sent to the House of Commons, by Mr. Halford and Mr. Pitt:

To let them know, the Lords have agreed to the said Bill, without any Amendment.

After hearing Counsel this Day, upon the Petition of Sir William Rawlinson and others, against the Bill, intituled, "An Act for settling the Estate of Sir John Maynard Knight, deceased, late One of the Lords Commissioners for the Custody of the Great Seal of England," as also Counsel for the Bill; and after Debate thereupon:

Ld. Willoughby to execute the Office of Great Chamberlain.

It is ORDERED, by the Lords Spiritual and Temporal in Parliament assembled, That the Lord Willoughby of Ersby shall execute the Office of Lord Great Chamberlain this Day, in the Place of his Father, at the Introduction of the Lord Butler of Weston.

This Day Charles Lord Butler, Baron of Weston, was introduced, between the Lord Berkeley of Stratton and the Lord Ashburnham; the Lord Willoughby of Ersby, as ordered, in the Absence of his Father, going before in the Place of Lord Great Chamberlain; and the Herald carrying his Patent; which was delivered by his Lordship, on his Knee, to the Lord Keeper; who gave it to the Clerk, and was read.

His Letters Patents bear Date 23° Die Januarii, Quinto Gul. et Mar.

The House resumed the Debate, upon the Petition and Appeal of the Earl of Montagu and others, and the Answer of the Earl of Bathe and others put in thereunto; Counsel being called in, and heard, upon several Precedents on the Behalf of the Earl of Montagu and others, and also replied to by the Counsel for the Earl of Bathe and others:

After Consideration had thereof, it is ORDERED, by the Lords Spiritual and Temporal in Parliament assembled, That the Precedents cited by the Counsel, at the Bar, shall be reported to the House To-morrow, at Eleven of the Clock; and that all the Lords and Judges shall be summoned then to attend.

Sir S. Swale versus Winchcombe.

It is ORDERED, by the Lords Spiritual and Temporal in Parliament assembled, That this House will hear the Cause wherein Sir Solomon Swale is Appellant, and Anne Winchcombe Respondent, on Friday the Three and Twentieth Day of this Instant February, at Ten of the Clock in the Forenoon.
