Addison versus Haddock.
After hearing Counsel, upon the Petition and Appeal of Thomas Addison and Henry Inman Merchants, from a Decree made in Their Majesties Court of Exchequer, the Thirtieth Day of November, in the Third Year of Their now Majesties Reign, on a Bill there brought, by Timothy Haddock Plaintiff, against the Appellants then Defendants; as also upon the Answer of the said Timothy Haddock put in thereunto:
After due Consideration had of what was offered thereupon, it is ORDERED, by the Lords Spiritual and Temporal in Parliament assembled, That there shall be a new Trial had, at the next Assizes held for the County of Lancaster, upon a seigned Issue, whether any Toll is payable for Wares and Merchandizes landed from Shipboard, or carried out of the County by Shipboard, at the Place of landing or shipping of the same; and if any such Toll be due, what the same is; and that, in order thereunto, the Appellants do name a Defendant and an Attorney, to accept the said Issue, and take Notice of Trial; and that the Depositions of such Witnesses taken in this Cause in the Exchequer, as are now dead, or unable to travel to the said Assizes, may be made Use of at the said Trial by either Party, saving all just Exceptions.
Vexatious Suits, to prevent, Bill.
It is ORDERED, by the Lords Spiritual and Temporal in Parliament assembled, That this House shall be put into a Committee, upon the Bill, intituled, "An Act for preventing frivolous and vexatious Suits," on Thursday the Twelfth Day of this Instant April, at Ten of the Clock in the Forenoon; and that the Judges in Town and Mr. Attorney General do then attend.
