Frequent Parliaments, Bill for.

Hodie 2a vice lecta est Billa, intituled, "An Act for the frequent Meeting and Calling of Parliaments."

ORDERED, That the said Bill shall be committed to a Committee of the whole House, To-morrow Morning.

Wilful Perjury to make Felony, Bill.

It is ORDERED, by the Lords Spiritual and Temporal in Parliament assembled, That the House shall be put into a Committee again, to proceed on the Bill, intituled, "An Act making wilful and corrupt Perjury, in certain Cases, to be Felony," on Wednesday next; and that the Judges then attend the House; and report, as ordered, To-morrow.

Marten versus Herbert.

Whereas To-morrow is appointed for hearing of the Cause wherein Henry Marten is Appellant, and Thomas Herbert Respondent:

It is ORDERED, by the Lords Spiritual and Temporal in Parliament assembled, That this House will hear the said Cause, by Counsel, at the Bar, on Saturday the Two and Twentieth Day of this Instant December, at Ten of the Clock in the Forenoon.

Duvall versus Price.

Upon reading the Petition of John Duvall; praying, "That the Day appointed for arguing the Errors assigned upon his Writ of Error brought into this House, wherein Edward Price is Defendant, may be put off from Wednesday next; for that the Counsel retained in his Cause, and instructed to argue for him, cannot possibly appear that Day:"

It is ORDERED, by the Lords Spiritual and Temporal in Parliament assembled, That this House will hear the Errors argued thereupon, on Monday the Four and Twentieth Day of this Instant December, at Ten of the Clock in the Forenoon; whereof the Petitioner is to give timely Notice to the Defendant.

Reeve versus Long:

Upon hearing Counsel this Day, at the Bar, to argue the Errors assigned upon the Writ of Error brought into this House the Seven and Twentieth Day of November last, in relation to a Judgement given in the Court of Common Pleas, and assirmed in the Court of King's Bench, in an Action of Trespass and Ejectment, wherein Charles Reeve was Plaintiff, and Anne Long Widow Defendant:

Judgement reversed.

After due Consideration had of what was offered by Counsel on either Side thereupon, it is ORDERED and Adjudged, by the Lords Spiritual and Temporal in Parliament assembled, That the said Judgement given in the Court of Common Pleas, and the Affirmation thereof in the Court of King's Bench, shall be, and they are hereby, reversed.

The Tenor of which Judgement, to be affixed to the Record to be transmitted, followeth; (videlicet,)

"Postea, scilicet, Vicesimo Septimo Die Novembris, Anno Regni Domini Will'mi et Dominæ Mariæ nunc Regis et Reginæ Angl. &c. Sexto, Transcript. Annam Long in Præmissis prosecut. dictis Domino Regi et Dominæ Reginæ in præsenti Parliamento, a præd. Curia dictor. Domini Regis et Dominæ Reginæ, coram ipsis Rege et Regina, hic transmiss. suit; prædictaque Anna Long, in eadem Cur. Parliament. comparens, divers. Causas et Materias pro Error. in Record. et Process. Judicii præd. necnon in Affirmatione ejusdem Judicii, pro Revocatione et Adnullatione Judicii præd. necnon Affirmation. ejusdem Judicii, assignavit; ad quas præd. Carolus Reeve, in eadem Cur. Parliament. scilicet comparens, placitavit, quod nec in Record. et Process. præd. nec in Redditione Judicii præd. nec in Affirmatione ejusdem, in ullo fuit Errat. Et postea, scilicet, Die Lunæ, Decimo Septimo Die Decembris, Anno Regni dictor. Domini Regis et Dominæ Reginæ. nunc Sexto supradicto, in præd. Cur. Parliament. visis et per eandem Cur. Parliament. ibidem diligent. examinat. et plenius intellect. tam Record. et Process. præd. ac Judic. super eisdem reddit. necnon Affirmation. ejusdem Judicii, quam præd. Caus. et Mater. per præfat. Annam Long pro Error. assignat. et allegat. maturaque Deliberatione inde' habita, pro eo quod videtur Cur. Parliament. præd. nunc hic, quod in Record. et Process. præd. necnon in Redditione Judicii præd. ac in Affirmatione ejusdem Judicii, manifest. est Errat.; consideratum est per eandem Cur. Parliament. præd. quod Judicium præd. necnon Affirmatio ejusdem Judicii, ob Error. præd. et al. in Record. et Process. præd. existen. revocentur, adnullentur, et penitus pro nullo habeantur; et quod præd. Anna Long ad omnia quæ ipsa Occasione Judicii præd. ac Affirmation. ejusdem amisit restituatur, &c. Ac superinde Record. et Process. præd. per Cur. Parliament. præd. in præd. Cur. dictor. Domini Regis et Dominæ, coram eisdem Domino Rege et Domina Regina, ubicunque &c. remittuntur, et in eadem Cur. Domini Regis et Dominæ Reginæ coram ipsis Rege et Regina jam residen. &c."
