E. of Clare's Bill.

Hodie 3a vice lecta est Billa, "An Act for settling Part of the Estate of John late Earl of Clare, and enabling Gilbert Earl of Clare his Son and Heir to dispose of some other Part thereof, for Payment of Debts and Portions."

The Question being put, "Whether this Bill shall pass?"

It was Resolved in the Affirmative.

Message to H. C. with it; and that the Lords have ordered the E. of Clarendon's Petition to be burnt.

A Message was sent to the House of Commons, by Mr. Proctor and Mr. Crosts:

1. To deliver to them the Bill concerning the Earl of Clare; and desire their Concurrence thereunto.

2. To acquaint them, that the Lords have given Order for the burning the Earl of Clarendon's Paper, by the Hangman, on Thursday next, at Gresham Colledge, at Exchange Time.

Answer.

The Messengers return with this Answer:

That they have delivered their Message to the House of Commons.

Message from H. C. for a Conference, concerning Freedom of Speech in Parliament.

A Message was brought from the House of Commons, by Mr. Cheyney and others:

To desire the Favour of their Lordships for a Conference.

Answer.

The Answer returned was:

That this House hath considered of their Message, and will send an Answer by Messengers of their own.

A Message was sent to the House of Commons, by Mr. Proctor and Mr. Crosts:

To let them know, that the Lords do agree to a Conference, and do appoint it to be presently, in the Painted Chamber.

Committee to consider of Laws expiring.

ORDERED, That the Committee appointed to consider of the Acts that are near expiring shall meet Tomorrow, at Three of the Clock in the Afternoon.

Ly. Cornwallis, Privilege: Mary Horton, her Servant, arrested.

Upon Oath made at the Bar of this House, by Elizabeth Clayton and Richard Blackwell, "That Mary Horton, Servant to the Lady Dowager Cornwallis, a Peeress of this Realm, was arrested, within a Month now last past, by Peter Bolingham, a Bailiff, contrary to the Privilege of Parliament; and that the said Peter Bolingham refused to discharge the said Mary Horton, notwithstanding that he was told by the said Elizabeth Clayton that the said Mary Horton was privileged, being the said Lady Cornwallis' Servant; but used very contemptuous Words of the Privileges of Parliament, and towards the Lady Cornwallis:"

Bolingham to be attached.

It is thereupon ORDERED, by the Lords Spiritual and Temporal in Parliament assembled, That the Serjeant at Arms attending this House, or his Deputy, shall forthwith attach the Body of the said Peter Bolingham, and bring him to the Bar of this House, to answer for his said Offence: And this shall be a sufficient Warrant on that Behalf.

Ld. Vaughan's Privilege:

Whereas John Bennet Esquire, Bailiff of the City of Westm. hath taken in Execution the Goods of Mr. George Weldon, Servant to the Lord Vaughan, a Peer of this Realm, contrary to the Privilege of Parliament, by which the Goods of all Privileged Persons ought to be free as well as their Persons:

Weldon his Servant's Goods to be restored.

It is ORDERED, by the Lords Spiritual and Temporal in Parliament assembled, That the said John Bennett do, forthwith upon Sight of this Order, cause to be redelivered all the Goods of, or belonging to, or taken in the Name of, Mr. George Weldon, Servant to the Lord Vaughan, a Peer of this Realm, which he or any of his Deputies have taken in Execution (sitting the Parliament) contrary to the Privilege of Parliament, as he will answer the contrary to this House: And this Order shall be a sufficient Warrant on that Behalf.

Adjourn.
