certain Manors, Lands, and Tenements, of Sir Thomas
Leventhorpe Baronet, in the Counties of Essex and
Hertford."
Mason, D. of Newcastle's Servant, to be brought by Habeas Corpus.
This House being this Day informed, "That Richard
Mason, menial Servant to the Duke of Newcastle, a
Peer of this Realm (being on Wednesday the 12th instant arrested, at the Suit of Bold Boughey Esquire,
Warden of The Fleete, contrary to the Privilege of
Parliament), is detained under Execution in the Prison now called The Compter of Woodstreet, London:"
It is ORDERED, by the Lords Spiritual and Temporal in Parliament assembled, That His Majesty's Writ of
Habeas Corpus cum Causa be awarded, and directed to
the Sheriffs of London and Midd. commanding them to
bring the Body of the said Richard Mason before the
Lords in Parliament, on Monday the 17th Day of February Instant, at Ten of the Clock in the Forenoon.
London and Keese to be brought to the Bar, for arresting Belon. Mauhert to attend.
ORDERED, That Nicholas Keise and Lodowicke London,
Bailiffs of the City of Westm. now in the Custody of the
Serjeant at Arms attending this House, for taking in
Execution the Goods of Peter Belon, One of His Majesty's
Servants in Ordinary, in November last, at the Suit of
Nicholas Maubert, contrary to the Privilege of Parliament, and for speaking contemptuous Words of the
Lord Chamberlain's Protection granted to the said Peter
Belon, shall be brought to the Bar of this House on Saturday the 15th Day of February Instant, at Ten of the
Clock in the Morning; and also that the said Nicholas
Maubert is hereby required to attend this House at the
same Time, upon Summons to be given him.
Morley and Grenvile versus Elwes.
The House proceeded to the further Hearing of
Counsel in the Cause depending between Cutbert Morley
and Bernard Greenvile Esq. and Jeremy and Henry Elwaies.
And the Counsel of Elwaies desiring that one
Grange might be examined viva voce; which being not
consented unto by the Counsel of Morley, in regard he
(fn. *) not examined in this Cause in the Court of Chancery, the Counsel were commanded to withdraw; and
the House took the same into Consideration.
And, after some Debate,
The Question being put, "Whether to hear
Grange in this Cause, at this Bar, viva voce?"
It was Resolved in the Negative.
It was also agreed, that William Comendale, another
Witness for Elwaies, may be examined upon what he
deposed in Chancery, but not unto any new Matter.
ORDERED, That this House will proceed in the further Hearing of this Cause To-morrow Morning, at Ten
of the Clock.
