E. of Clare versus Franklyn and Vosper, Privilege.

The Earl of Dorsett reported, "That the Committee for Privileges desire that Justice Twisden and Doctor Baldwyn may be ordered to attend that Committee, to assist them in their Consideration of the Case of the Earl of Clare."

And accordingly it is ORDERED, That they attend at the next Sitting of the Committee.

ORDERED, That the Lord Chandois is added to the Committees for Privileges, Petitions, and the Journal Book.

The Earl of Winchilsea and Vicecomes Hallyfax are added to the Committee to consider of the Fall of Rents and Decay of Trade within this Kingdom.

The Earl of Petriburgh and the Earl of Carlile are added to the Committee for Privileges, and the Committee to consider of the Reasons of the Fall of Rents, &c.

Commissioners for Accompts deliver in Papers.

This Day, according to the Order of this House on Wednesday last, the Lord Brereton, and some others of the Commissioners for taking of Accompts of several Monies mentioned in an Act of Parliament, attended this House, and gave this Account:

"That they have writ out as many of the Answers and Papers mentioned in their Report as they could in so short a Time, and have brought the same; and they will bring the rest as soon as they can be written and examined, which they hope may be To-morrow or Monday.

"They presented the Originals, and Copies attested by the Commissioners to be true Copies (being Thirteen in Number), that so their Lordships may take which they please."

Upon this, the Commissioners withdrew; and, after some Consideration thereof, the House directed that the Originals should be re-delivered to the Commissioners, in regard they may have further Occasion to use them, and it may be the King may desire to peruse them.

The Commissioners were called in again; and the Lord Keeper told them, "That the Lords have appointed the Originals should be returned to them, and did retain the Copies;" and further signified to them, That the Lords desired that true Copies of the rest of the Papers may be brought to the House as soon as possibly may be."

It was moved by some Lords, "That the Report, with these Papers, might be presently committed to a Committee:" And other Lords moved, "That the said Papers might be read before the rest of the Papers were brought in."

For the further Consideration hereof, it was moved, "That the House might be put into a Committee;" which accordingly was done.

The House being resumed;

The Question was put, "Whether these Papers shall be read now?"

It was Resolved in the Negative.

ORDERED, That these Papers be read To-morrow Morning at Ten of the Clock, and no other Business to intervene.

Middleton & al. Executors of Smithsby, versus Jacob & al. Farmers of the King's Customs.

Upon reading and considering of the humble Petition of Simon Middleton and John Blackwell Esquires, Executors of Thomas Smithsby Esquire, deceased, and others; complaining against Sir John Jacob, Sir Nicholas Crispe, Sir John Harrison, and others, late Farmers of His Majesty's Customs, concerning Monies lent by the Petitioners, and not re-paid by the said Persons, as in the Petition is set forth:

It is ORDERED, by the Lords Spiritual and Temporal assembled in Parliament, That Sir John Jacob Executor of the said Sir John Jacob deceased, John and Thomas Crispe, Executors of the said Sir Nicholas Crispe deceased, and Dame Harrison and Richard Harrison, Executors of the said Sir John Harrison deceased, being made Defendants by the said Petition, are hereby required to put in their respective Answer or Answers in Writing to the said Petition, in this House, on Thursday the Fourth of November next, at Ten of the Clock in the Forenoon; and that, in the mean Time, Hezekiah Heynes, in the said Petition mentioned, and all Attornies and Solicitors, or other Persons, employed by him, are hereby required to forbear all Manner of Proceedings tending to the Acknowledgement of Satisfaction on the Judgements mentioned in the said Petition, until further Order of this House, as they will answer the contrary at their Perils.

Prosser, Ly. Dowager Abergavenny's Servant, arrested.

Upon Information given at the Bar of this House, by Hugh Hawker, "That John Prosser, menial Servant to the Lady Dowager Abergaveny, a Peeress of this Realm, was, on the 27th Day of November last, within the Time of Privilege, arrested, contrary to the Privilege of Parliament, by William Pinkard, Day, and Hull, at the Suit of Griffith Gwilliam, and within a Day or Two after by Richard Dawson; and that both the said Gwilliam and Dawson would not allow of the Privilege claimed by the said Lady Abergaveny; and that afterward the said John Prosser, being so detained Prisoner, had an Execution laid upon him by Mrs. Carnaby:"

Gwilliam, Dawson, & al. sent for.

It is ORDERED, by the Lords Spiritual and Temporal in Parliament assembled, That the said William Pinkard, Day, and Hull, as also the said Griffith Gwilliam, Richard Dawson, and Mrs. Carnaby, are hereby required to appear at the Bar of this House, on Thursday the Fourth Day of November next, at Ten of the Clock in the Forenoon, to answer to the said Information, and hereof they may not fail: And it is further ORDERED, by their Lordships, That His Majesty's Writ of Habeas Corpus be awarded to the Warden of The Fleete, for the bringing of the Body of the said John Prosser to the Bar of this House on the said Thursday the Fourth of November next, at the Hour aforesaid.

Grenvile versus Elwes.

Upon reading and considering of the humble Petition of Bernard Grenvile Esquire, and Anne his Wife, sole Daughter and Heir of Cutbert Morley Esquire deceased, together with an Order of this House, dated the 31th of March, 1668, and a Decree of the Court of Chancery to the said Petition annexed:

It is ORDERED, by the Lords Spiritual and Temporal in Parliament assembled, That Mr. Jeremy and Henry Elwes, the Defendants mentioned in the said Decree, are hereby required to put in their Answer in Writing to the said Petition, in this House, on Thursday the Fourth Day of November next, at Ten of the Clock in the Forenoon: And hereof they may not fail.
