PRAYERS.

E. Mulgrave and E. Rochester, Quarrel.

The Lord Chamberlain of His Majesty's Household acquainted the House, from the King, "That His Majesty understanding that there was an Intention of a Duel between the Earl of Mulgrave and the Earl of Rochester; His Majesty hath sent an Officer of His Guards to find them out, but he could not meet with the Earl of Mulgrave; and having apprehended the Earl of Rochester in his Chamber, his Lordship engaged his Honour and Word to him, not to make any Escape; but, pretending to have some Occasion to go into a little Back Room, he conveyed himself away at a Back Door, and is not yet found: There are several Persons sent Abroad to find them out. His Majesty says, as the Earl of Rochester is His Servant, He knows what Course to take with him; but, in regard they are both Peers, and Members of this House, His Majesty held it a Respect to this House, to give their Lordships Notice hereof; and desires their Lordships to take some Course with them."

Both to be brought in Custody.

Hereupon it is ORDERED, by the Lords Spiritual and Temporal in Parliament assembled, That the Gentleman Usher of the Black Rod attending this House shall take Care speedily to secure the Persons of the Earl of Mulgrave and the Earl of Rochester, and bring them in safe Custody before the Lords in Parliament.

Bp. of Rochester, Charitable Uses Bill.

Smithsby's Executors versus Jacob & al.

Whereas Counsel hath been this Day heard, at the Bar, upon the Plea and Demurrer of Sir John Jacob, and of John Crispe and Thomas Crispe Esquires, Three of the Defendants to the Petition of Symon Middleton, John Blackwell, and others, Petitioners:

It is ORDERED, by the Lords Spiritual and Temporal in Parliament assembled, That this House doth overrule the Plea and Demurrer of the said Defendants; and that the said Sir John Jacob, John Crispe, and Thomas Crispe, shall put in their Answer in Writing to the Merits of the Cause complained of in the said Petition, on Friday the Twenty-sixth Day of this Instant November, at Ten of the Clock in the Forenoon; and that this House will hear Counsel on both Sides thereupon on Thursday the Second Day of December next, at Ten of the Clock in the Forenoon.

Harrison, a Member of H. C. a Party in the Cause, how to answer.

Whereas Richard Harrison Esquire, Executor of the last Will of Sir John Harrison Knight, deceased, who is made a Defendant to the Petition of Symon Middleton and John Blackwell, Executors of Thomas Smithsby, now depending in this House, is a Member of the House of Commons:

It is ORDERED, by the Lords Spiritual and Temporal in Parliament assembled, That it be referred to the Lords Committees for Privileges, to consider of the Manner and Way how Notice is to be given to the said Richard Harrison to answer to the said Petition, and make Report thereof unto the House.

De Vaux versus Colladon.

Upon reading the Plea and Answer of Sir John Colladon Knight, to the Petition of Sir Theodore De Vaux Knight, now depending in this House:

It is ORDERED, by the Lords Spiritual and Temporal in Parliament assembled, That Saturday next is appointed, to hear Counsel on both Parts, upon the said Petition and Answer, at Ten of the Clock in the Forenoon.

Thomas versus Dagnal & al.

Whereas Thursday the Second Day of December next was appointed to hear Counsel on both Parts, upon the Petition of Anthony Thomas Esquire, and the several Pleas and Answers of Anne Dagnall, Relict and Executrix of Richard Dagnall deceased, and of Thomas Owen Esquire and Mary his Wife, Richard Stephens Gentleman and Francis his Wife, the Daughters, Heirs, and Legatees, of the said Richard Dagnall:

It is this Day ORDERED, by the Lords Spiritual and Temporal in Parliament assembled, That the said Parties shall be heard, by their Counsel, at the Bar, upon the said Petition, Pleas, and Answers, on Friday the Third Day of December next, at Ten of the Clock in the Forenoon: Hereof both Parties are to take Notice, to the End they may come prepared accordingly.
