Noell versus Nelson, in Error.
Whereas, by virtue of His Majesty's Writ of Error,
returnable into the House of Peers in Parliament assembled, a Record of the Court of King's Bench was
brought into this House on the 26th Day of November
last (with the Transcript thereof), wherein the Affirming
of a Judgement given in the Court of Common Pleas,
for William Nelson, against Sir Martin Noell, Thomas
Noell, and George Robinson, Executors of the Will of
Sir Martin Noell, late of London, Knight, deceased, in a
Plea of Debt, is entered:
Upon hearing of Counsel on both Parts at the Bar,
to argue the Errors assigned by the said Sir Martin Noell,
Thomas Noell, and George Robinson, after due Consideration had by this House of what hath been offered on
either Part thereupon; the Lords Spiritual and Temporal in Parliament assembled do order and adjudge,
That the said Judgement of the Court of King's Bench,
for affirming the Judgement of the Court of Common
Pleas, for the said William Nelson, against the said Sir
Martin Noell, Thomas Noell, and George Robinson, be,
and is hereby, affirmed; and that the said Transcript of
the said Record, wherein the Judgement of the Court of
Common Pleas is affirmed as aforesaid, be remitted; and
that the said William Nelson may thereupon proceed, as
if no such Writ of Error had been brought into this
House; and their Lordships do further order and adjudge, That the said Sir Martin Noell, Thomas Noell, and
George Robinson, shall pay unto the said William Nelson the
Sum of Ten Pounds for his Costs, by reason of their
bringing the said Writ of Error into this House.
The Tenor of which Judgement, to be affixed to the
Transcript to be remitted, followeth; (videlicet,)

Greene and Cole, in Error.
This House taking into Consideration what hath been
pleaded at this Bar, by Counsel, concerning the Errors
in the Writ of Error between Greene and Cole; and
having heard the Opinion of the Lord Chief Justice of
the Court of Common Pleas, Baron Turner, Justice
Wyld, and Baron Littleton, in Matter of Law:
It is ORDERED, That the further Debate of this
Matter is adjourned till To-morrow Morning.
L. Berkeley's Claim of Precedency.
Whereas, upon reading the humble Petition of George
Lord Berkeley of Berkeley, directed to the King's Most
Excellent Majesty; shewing, "That he conceiveth himself not to be in such Place of Precedency as a Baron
and Peer of this Realm, and all other Honourable
Assemblies of his Peers, as of ancient Time did belong to his Ancestors, from whom he did descend;
and therefore praying, That he may be admitted to
make Proof of his Claim, in order to the just Decision thereof; and of His Majesty's Reference of the
said Petition to the Consideration of this House;" it
was ordered, That the said Lord Berkeley should be heard,
by his Counsel, at the Bar, to make Proof of his said
Claim, on Tuesday the Tenth Day of January Instant:
It is this Day ORDERED, by the Lords Spiritual and
Temporal in Parliament assembled, That the said Counsel
shall be heard, at the Bar of this House, to make Proof of
his said Claim, on Saturday the One and Twentieth Day of
January Instant, at Ten of the Clock in the Forenoon.
