Bill to prevent Delays in extending Statutes, &c.

Hodie 1a vice lecta est Billa, "An Act for Continuance of a former Act, to prevent Delays in extending Statutes, Judgements, and Recognizances."

Report concerning the Hamb. Company.

The Earl of Essex reported, "That the Committee appointed to consider of the Charter of the Fellowship and Company of the Merchant Adventurers of England, commonly called or known by the Name of Hamborough Merchants, and to advise with some of the Judges by what Way the said Company may be compelled to appear before this House legally, and in what Manner the said Company may be charged with the Payment of their Debts, have met several Times; and, upon Perusal of the Charter, their Lordships find, That the Governor, Deputy Governor, and Assistants, have Power to call a Court, which have Power to levy Money; in Pursuance whereof, the Committee have conceived a Draught of an Order for the Relief of the Creditors of the said Company, which they offer to the Consideration of the House."

The said Order being read, and upon some Debate thereof, it is ORDERED, That the said Draught of the Order be re-committed to the same Committee, to be further considered of; whose Lordships are to meet on Monday Morning next, at Nine of the Clock, in the Prince's Lodgings.

Message from H. C. with a Bill against maiming and wounding.

A Message was brought from the House of Commons, by Sir Thomas Leigh and others; who brought up a Bill, intituled, "An Act to prevent malicious maiming and "wounding;" to which their Lordships Concurrence is desired.

E. of Lincoln's Bill.

The Lord Gerrard reported, "That the Committee have considered the Bill to enable Edward Earl of Lyncolne to make a Jointure, and do think it fit to pass, without any Amendments."

Whereupon it is ORDERED, That the said Bill be engrossed.

ORDERED, That these Lords following are appointed a Committee, to examine the Matter of Fact committed in the late barbarous assaulting, wounding, and robbing, the Person of the Lord Steward of His Majesty's Household; and to make Report thereof to this House:

E. of Shrewsbury's Bill.

Hodie 1a vice lecta est Billa, "An Act for the enabling Robert Earl of Cardigan, George Lord Viscount Hallyfax, Henry Lord Howard Baron Howard of Rysing Castle, the Honourable Mervin Tuchett Esquire, Sir John Talbott Knight, Francis Finch Esquire, and William Talbot, Guardians and next Friends of Charles Earl of Shrewsbury and John Talbot Esquire, Sons of Francis late Earl of Shrewsbury, deceased, and Infants under the Age of Twenty and One Years, to demise, grant, and dispose of, the several Manors, Moieties of Manors, Messuages, Lands, Tenements, and Hereditaments, herein mentioned, for the Ends, Intents, and Purposes, and in Manner and Form, as is herein expressed."

Dr. Sherley, King's Servant, Privilege:

Upon Complaint made to this House, "That Mr. Thomas Sherley, otherwise called Doctor Sherley, is attached, by Process of Contempt of the Court of Chancery, and imprisoned in The Fleete, sitting the Parliament;" the said Thomas Sherley being this Day brought to the Bar, by the Warden of The Fleete, by virtue of His Majesty's Writ of Habeas Corpus to the said Warden for that Purpose directed; it appearing to this House that the said Thomas Sherley is Physician in Ordinary to His Majesty, and that his Imprisonment as aforesaid is contrary to the Privilege of Parliament:

It is thereupon ORDERED, by the Lords Spiritual and Temporal in Parliament assembled, That all Proceedings had against the said Thomas Sherley during the Time of Privilege of Parliament be set aside; and that the said Thomas Sherley be, and is hereby, discharged from his present Imprisonment in The Fleete, without paying Fees: And this shall be a sufficient Warrant on that Behalf.

Man and Church sent for.

Upon Complaint made to this House, "That Mr. Thomas Sherley (otherwise called Doctor Sherley), Physician in Ordinary to His Majesty, is attached, by Process of Contempt of the Court of Chancery, and imprisoned in The Fleete, sitting the Parliament, by the Prosecution of Benjamin Man; and that William Church, belonging to the Prison of The Fleete, would not suffer the said Thomas Sherley to be brought this Day to the Bar, by virtue of His Majesty's Writ of Habeas Corpus to the Warden of The Fleete on that Behalf directed, until the said Thomas Sherley had promised to pay Fees for such his coming to the Bar:"

It is thereupon ORDERED, by the Lords Spiritual and Temporal in Parliament assembled, That the said Benjamin Man and William Church are hereby required to appear, at the Bar of this House, on Monday next, at Ten of the Clock in the Forenoon, to answer the said Complaints respectively.

Burford, Lady Mohun's Servant, arresteds Privilege.

Upon reading the humble Petition of Katherine Lady Dowager Mohun, complaining of a Breach of Privilege of Parliament, by the arresting of her domestic Servant, Eleanor Burford, at the Suit of Anne Chapman Widow:

It is ORDERED, That the Consideration of the said Petition, and of the Privilege of other Peeresses in relation to the arresting of their Servants, be referred to the Committee for Privileges; whose Lordships are afterwards to make Report unto the House.
