Colt versus Colt.
Upon due Consideration had this Day by this House
of what hath been offered by Counsel at the Bar, on
both Parts, upon the Petition of Thomas Colt and Henry
Hall Esquires, and the Answer of John Dutton Colt
Esquire thereunto, the said Petition being an Appeal
from a Decree made in the Court of Chancery, upon
their Bill of Review brought in that Court, concerning
a Judgement acknowledged by James Scudamore Esquire
of Ten Thousand Pounds, and Lands sold by the
said James Scudamore towards Satisfaction of the said
Debt:
It is ORDERED and Adjudged, by the Lords Spiritual
and Temporal in Parliament assembled, That the said
Petition of Thomas Colt and Henry Hall aforesaid be, and
is hereby, dismissed this House: And it is further ORDERED, That the Lord Keeper of the Great Seal of
England for the Time being be, and is hereby, empowered to settle the Conveyance (mentioned in the
said Petition) to be made by the said Henry Hall, according as his Lordship shall think fit in Equity, the
Decree mentioned in the said Petition notwithstanding.
ORDERED, That Counsel shall be heard, between
the Countess Dowager of Peterborough and the Earl of
Peterborough, on Thursday Morning next.
