L. Berkeley's Claim of Precedency.

This Day the Counsel of the Lord Berkeley of Berkeley Castle being heard, to make Proof of his Claim of Precedency upon his Petition to His Majesty, and His Majesty's Reference of the said Petition to this House; the Lord Delawarr desired that his Counsel might be heard, to oppose the said Claim of the Lord Berkeley.

And the Earl of Berks desired that the Duke of Norfolk's Counsel might be also heard, concerning his Claim of Precedency as Lord Mowbray.

Whereupon the Lord Berkeley of Berkeley declared in the House, "That his Claim of Precedency is only relating to the Lord Delawarr, Lord Awdley, and Lord Abergavenny; but not to the Duke of Norfolke as Lord Mowbray, to whom he quits any Pretence of Precedency."

Hereupon this House made the Order following:

"Upon hearing the Counsel of the Lord Berkeley of Berkeley Castle this Day at the Bar, to make Proof of his Claim of Precedency mentioned in his Petition presented to His Majesty, and by His Majesty referred to this House: After some Consideration had of what hath been offered thereupon, the Lord Delawar desiring that he may have Time to search Records, and to be heard concerning the same: It is thereupon ORDERED, by the Lords Spiritual and Temporal in Parliament assembled, That the Lord Delawar shall be heard, by his Counsel, at the Bar of this House, on Friday the Fourteenth Day of April next, at Ten of the Clock in the Forenoon, to oppose the said Lord Berkeley's Claim made this Day: And it is further ORDERED, That Copies of the Records produced and read this Day on the Behalf of the said Lord Berkeley, and also his Lordship's Pedigree in Writing, shall be brought into this House on or before the Two and Twentieth Day of this Instant February."
