PRAYERS.
L. Griffin at the Bar.
The Lord Griffin was brought to the Bar, and kneeled.
The Speaker acquainted him, "That the Lords having been acquainted, by a Message from His Majesty, that he was committed for High Treason; he being a Peer of the Realm, they had sent for him to hear what he had to say."
Then the Lord Griffin spoke to this Effect: "That he thought the Warrant was not for High Treason; but he submits all to their Lordships."
Then, the Warrant of Commitment being read, his Lordship said, "He knew nothing of the Occasion of it, from the Beginning to the End."
So he withdrew.
After Debate:
Evidence against him.
It was ORDERED, That Thomas Hall do attend the House immediately.
Who being come, and sworn at the Bar; and a Paper or Letter, supposed to be writ to the late King, being read; the Contents whereof is:
"October the 20th.
"This Gentleman, I hope, will give you an Account, which would be too long to write, what the Figure of 2 has done in your Concerns, since James Taylor was with you: I can give you my Word he has neglected nothing, nor, I'll assure you, will not; he has all the Sense imaginable of your Favour to him in F-e: But his Enemies are so violently bent against him, that unless you are pleased to send him this other Discharge, they will utterly ruin him; for this First will do no good. He prays for nothing so much as your good Fortune, and a happy Meeting with you; for till then he can never be easy."
Which Paper being shewed him; he was asked, "If he knew whose Hand that was?"
He answered, "He had often seen the Lord Griffin's Hand, and he believed that was his Writing."
Then he withdrew.
Judges Opinions to be had about his Commitment.
The House, after some Debate, agreed to hear the Opinion of all the Judges To-morrow Morning, Whether this be such an Evidence upon which the Lord Griffin ought to be committed.
L Griffin remanded to The Tower.
ORDERED, by the Lords Spiritual and Temporal in Parliament assembled, That the Lord Griffin, who (fn. 2) was brought this Day to the Bar by the Chief Governor of The Tower of London, be, and is hereby, remanded to the said Tower.
ORDERED, That the Chief Governor of The Tower of London, his Deputy or Deputies, do bring to the Bar of this House the Lord Griffin, now Prisoner, Tomorrow, at Ten of the Clock in the Forenoon.
L. Preston to be attached, for claiming Privilege of Peerage under a Patent from the late King, in France.
Then the Lord Viscount Preston appeared; and was told by the Speaker, "That the House being informed that he claims the Privilege of a Peer of this Realm, they had sent for him, to know upon what Ground he did so."
He said, "The Earl Mountague had commenced a Suit against him; that he was ready to give his Lordship an Appearance, though he had a Patent to be a Peer of this Realm, from the late King James, before the Vote of Abdication passed; and he thought he had the Privilege of a Peer."
And then he withdrew.
After Debate;
The Patent being sent for, and brought in, bearing Date, Apud Fanum Sanct. Germani ad Layam, 21 Januarii, Stilo veteri, Anno Regni Nostri 4to.
Upon this, the House made this ensuing Order:
"ORDERED, That the Gentleman Usher of the Black Rod do take Richard Lord Viscount Preston immediately into his Custody.
"To Sir Thomas Duppa, Gentleman Usher of the Black Rod attending this House, his Deputy and Deputies, and every of them."
Judges to attend, concerning his Patent.
ORDERED, That all the Judges do attend this House To-morrow, at Ten of the Clock in the Forenoon; at which Time the House will take into Consideration the Lord Viscount Preston's Patent, and the Lord Griffin's Case.
Bp. of Litch. & Cov. excused.
This Day John Bockburst and William Swyncore attested, upon Oath, at the Bar, "That the Bishop of Coventry and Litchfeild is in such an ill Condition of Health, that he is not able to attend this House."
Upon which, his Lordship is excused.
The Earl of North'ton, Viscount Lumley, and the Lord Bishop of London, are added to the Committee for Inspections.
Adjourn.
