Hodie 1a vice lecta est Billa, "An Act to enable Thomas Earl of Aylesbury and Elizabeth Countess of Aylesbury (fn. 1) his Wife to make Provision for Payment of his Debts, and make Leases of other Estates."

Sedgewick versus Hitchcock & al.

The House being this Day moved, "That a Day may be appointed for hearing the Cause wherein Obadia Sedgwicke is Appellant, and George Hitchcok and others Respondents:"

It is ORDERED, by the Lords Spiritual and Temporal in Parliament assembled, That this House will hear the said Cause, by Counsel on both Sides, at the Bar, on Wednesday the Seventeenth Instant, at Ten of the Clock in the Forenoon.

Dutchess of Beaufort & al. to be heard against the E. of Aylesbury's Bill.

Upon the First Reading of a Bill, intituled, "An Act to enable Thomas Earl of Aylesbury and Elizabeth Countess of Aylesbury his Wife to make Provision for Payment of Debts, and to make Leases of their Estates:"

It is ORDERED, by the Lords Spiritual and Temporal in Parliament assembled, That her Grace the Dutchess of Beaufort, the Lord Marquis of Worcester, and the Honourable Robert Bruce Esquire, may be heard, by their Counsel, on Monday the Fifteenth Day of this Instant December, at Ten of the Clock in the Forenoon, at the Bar of this House, what they have to say against the said Bill.

Counsel, if absent when called, not to plend that Session.

It is ORDERED, by the Lords Spiritual and Temporal in Parliament assembled, That when a Day shall be appointed for hearing any Cause depending in this House, and Counsel shall be retained for pleading on either Side thereupon, and the Counsel shall not be ready when this House shall think fit to call them in; the Counsel or Counsellors, not being then ready and attending as he or they ought to do, shall not be permitted to plead at this Bar in any Cause whatsoever during that Session of Parliament: And it is ORDERED, That this Order be set upon the Doors of this House.

Burdet, a Papist, attached, for walking in the Court of Requests.

The House being informed, "That one Thomas Burdet, a Papist, being walking in the Court of Requests (contrary to the Orders of this House), was now taken, and put into the Custody of the Gentleman Usher of the Black Rod:"

It is ORDERED, by the Lords Spiritual and Temporal in Parliament assembled, That the Gentleman Usher of the Black Rod do keep the said Thomas Burdet in safe Custody until further Order of this House; and this shall be a sufficient Warrant on that Behalf.

To Sir Thomas Duppa, Gentleman Usher of the Black Rod, his Deputy and Deputies, and every of them.

Clarke versus Baden.

It is ORDERED, by the Lords Spiritual and Temporal in Parliament assembled, That this House will hear the Cause wherein Edmond Clarke is Plaintiff, and Robert Baden Defendant, on Thursday next, at Ten of the Clock in the Forenoon, the First Business.

Brocmhall versus Johnson.

Upon hearing Counsel this Day at the Bar, upon the Petition and Appeal of Thomas Bromball an Infant, by William Bromball his Father and Guardian, from a Decree made in the High Court of Chancery, the 4th Day of July 1690, in a Cause there then depending, between Henry Johnson Plaintiff, and this Appellant and others Defendants; as also upon the Answer of the said Henry Johnson put in thereunto:

After due Consideration had of what was offered by Counsel on either Side thereupon, it is ORDERED and Adjudged, by the Lords Spiritual and Temporal in Parliament assembled, That the Decree made by the Court of Chancery, the Fourth Day of July 1690, from which the said Thomas Bromhall appealed to this House, shall be, and is hereby, reversed; saving only (fn. 2) that the Debts owing by the Defendant Thomas Bromball to the said Henry Johnson, and for which the said Hen. Johnson stands engaged for to any Persons, upon the Account of the Appellant Bromball, or those under whom he claims.

Hewley versus Wyvell.

It is ORDERED, by the Lords Spiritual and Temporal in Parliament assembled, That this House will hear the Cause wherein Dorothy Hewley Spinster is Plaintiff, and Francis Wyvell and Anne his Wife are Defendants, on Friday next, at Ten of the Clock in the Forenoon.

Adjourn.
