The House was called over, as ordered.

Sir J. Fenwick at the Bar, and asked if he had any Thing to offer:

Sir John Fenwick was brought to the Bar, and told by the Lord Keeper, "That the Lords are proceeding on the Bill to attaint him of High Treason; and that, if he had any Thing to offer to their Lordships, they had given him this Opportunity."

Sir John Fenwick thanked the Lords for their Favour, in hearing his Counsel and Witnesses; and hoped that no Lord, upon the Evidence given against him, will think him Guilty.

Remanded:

Sir John Fenwick being withdrawn; it is ORDERED, by the Lords Spiritual and Temporal in Parliament assembled, That Sir John Fenwick Baronet shall be, and is hereby, remanded to the Prison of Newgate.

Papers read, &c.:

After the Papers in the Lord Keeper's Custody, (videlicet,) Sir John's Confession in his own Hand-writing, and Information taken upon Oath before Mr. Vernon, were read.

The Lord Steward and Earl of Carlisle gave the House an Account of what Message they received from Sir John, by his Lady, concerning the surrendering himself before his Flight, if he might have been bailed.

Bill to be read a Second Time:

Then, after long Debate, the Question was put, "Whether the Bill, intituled, "An Act to attaint Sir John Fenwick Baronet of High Treason;" shall be read a Second Time ?"

It is ORDERED, by the Lords Spiritual and Temporal in Parliament assembled, That Sir John Fenwick shall have Notice, that the Bill, intituled, "An Act to attaint Sir John Fenwick Baronet of High Treason," was this Day read the Second Time, and is ordered to be read the Third Time on Tuesday next.

House to be called.

It is ORDERED, by the Lords Spiritual and Temporal in Parliament assembled, That on Tuesday next, at Eleven of the Clock, this House shall be called over; and that such Lords as are in Town, or within Ten Miles thereof, that do not then attend, shall be taken into Custody; and also that the House shall be called over again before it rises; and if any Lord present at the First Calling be then absent, he shall be taken into Custody.

Rex versus Walcot, in Error.

Whereas Monday next was appointed to hear the Errors argued, upon a Writ of Error depending in this House, wherein His Majesty by His Attorney General is Plaintiff, and John Walcot Son of Thomas Walcott is Defendant:

It is ORDERED, by the Lords Spiritual and Temporal in Parliament assembled, That this House will hear the said Errors argued, by Counsel, at the Bar, on Thursday the Four and Twentieth Day of this Instant December, at Ten of the Clock in the Forenoon; and that Mr. Tanner do then attend with Records, as formerly ordered.

Winchester versus Fowke.

It is ORDERED, by the Lords Spiritual and Temporal in Parliament assembled, That this House will hear Counsel, upon the Petition of Henry Winchester and Ann his Wife, and the Answer of Elizabeth Fowke, the First Day of Sitting after Christmas.
