E. Bath versus E. Montagu.

This Day the Earl of Bath brought in his Answer to the Earl of Montagu's Petition.

Which being read; it is ORDERED, by the Lords Spiritual and Temporal in Parliament assembled, That the Earl of Montagu may have a Copy of the said Answer; and do put in a Reply thereunto on Tuesday next.

Bishop of Ely's Bill.

The Earl of Stamford reported from the Committee, the Bill, intituled, "An Act for enabling Symon Lord Bishop of Ely and his Successors to lease the Manorhouse and Demesne Lands of Downham, in the Isle of Ely, and for continuing a Lease lately thereof made by the said Bishop; and for the clearing of the said Bishop and others from Dilapidations there," as fit to pass, with One Amendment.

Which, being read Twice, was agreed to; and the Bill ordered to be engrossed.

Lassells' Bill.

The Lord Bishop of Peterburgh reported from the Committee, the Bill, intituled, "An Act to enable Rebecca Lassells Widow to sell Copyhold Lands and Houses in Ealing, in the County of Midl'x," as fit to pass, with some Amendments.

Which, being read Twice, were agreed to; and the Bill ordered to be engrossed, with the said Amendments.

Bishop of Norwich to preach the 31st.

It is ORDERED, by the Lords Spiritual and Temporal in Parliament assembled, That the Lord Bishop of Norwich be, and he is hereby, desired to preach before this House, on Monday the One and Thirtieth Day of January Instant.

Message from H. C. with a Bill.

A Message was brought from the House of Commons, by Mr. Farrer and others:

To return the Bill, intituled, "An Act for vesting in Sydenham Baker Gentleman an absolute Estate of Inheritance, in Fee Simple, in a certain Rent, Messuages, Lands, and Hereditaments, in the County of Devon; and securing to John Baker Gentleman, and Henry Baker, an Infant, his Son, Monies in Lieu of their Claims thereunto;" to which they have agreed, without any Amendment.

Counter et al. to continue the Imprisonment of, Bill.

Hodie 3^a vice lecta est Billa, intituled, "An Act for continuing the Imprisonment of Counter and others, for the late horrid Conspiracy to assassinate the Person of His Sacred Majesty."

A Clause being offered, to be added to the said Bill, was read, and agreed to.

Then the Question was put, "Whether this Bill, with the Clause, shall pass?"

It was Resolved in the Affirmative.

Message to H. C. with Amendments to it.

A Message was sent to the House of Commons, by Sir John Hoskyns and Sir Richard Holford:

To return the said Bill, and desire their Concurrence to the Clause.

Lord Mohun committed to The Tower:

It is ORDERED, by the Lords Spiritual and Temporal in Parliament assembled, That Charles Lord Mohun shall be, and he is hereby, committed Prisoner to His Majesty's Tower of London, there to be kept in safe Custody until he shall be delivered by due Course of Law; and this shall be a sufficient Warrant on that Behalf.

To the Right Honourable the Lord Lucas, Chief Governor of His Majesty's Tower of London.

It is ORDERED, by the Lords Spiritual and Temporal in Parliament assembled, That Sir Fleetwood Sheppard, Gentleman Usher of the Black Rod, in whose Custody Charles Lord Mohun now is, shall convey the said Charles Lord Mohun to His Majesty's Tower of London.

To Sir Fleetwood Sheppard, Gentleman Usher of the Black Rod attending this House.

To be tried in Westminster Hall.

Resolved, by the Lords Spiritual and Temporal in Parliament assembled, That this House will proceed to the Trial of Charles Lord Mohun in Westminster Hall.

Message from H. C. for a Conference on the Bill against corresponding with King James.

A Message was brought from the House of Commons, by Sir William Williams and others:

To desire a Conference, upon the Subject-matter of the Amendments made by this House to the Bill, intituled, "An Act against corresponding with the late King James and his Adherents."

To which the House agreed.

And the Commons were called in; and told, "That the Lords agree to a Conference, as desired; and appoint it presently, in the Painted Chamber."

Managers:

Then the Lords following were appointed Managers of the Conference:

Commons disagree to leaving out a Clause in it.

The Commons being come to the Conference, the Managers Names were read.

Then the House was adjourned during Pleasure, and the Lords went to the Conference.

Which being ended, the House was resumed.

And the Duke of Bolton reported, "That they had attended at the Conference; and that the Commons disagree to the leaving out the Clause that mentions the Act lately passed, for regulating Trials in Cases of Treason."

The House agreed, not to insist upon the keeping in of the said Clause.

Message to them, that the Lords do not insist on it.

A Message was sent to the House of Commons, by Sir Miles Cooke and Sir John Hoskyns:

To let them know, the Lords do not insist upon the Amendment disagreed to by them, for leaving out the Clause that mentions the Act lately passed, for regulating of Trials in Cases of Treason.

Adjourn.
