L. Vaughan versus L. Herbert.

Upon reading the Petition of John Lord Vaughan and Earl of Carbury; complaining of a Breach of Privilege by some Proceedings in the Exchequer, in His Majesty's Name, on the Behalf of the Lord Herbert of Cherbury, for Recovery of some Arrears of Fee-farm Rents:

It is ORDERED, by the Lords Spiritual and Temporal in Parliament assembled, That the said Petition shall be, and is hereby, referred to the Lords Committees for Privileges; who are to meet on Friday next, at Ten of the Clock, in the House of Peers; and to adjourn as they please; and having heard Counsel and such Persons concerning the same as they shall think fit, are to report their Opinions thereupon to this House; and that some of the Barons of the Exchequer do then attend the Committee.

It is ORDERED, by the Lords Spiritual and Temporal in Parliament assembled, That the Thanks of this House be, and are hereby, given to the Lord Bishop of Norwich, for his Sermon preached before this House, the One and Thirtieth Day of January last, in the Abbey Church at Westm'r; and he is hereby desired to print and publish the same.

Bertie versus L. Faulkland & al.

Upon reading the Petition and Appeal of the Honourable James Bertie and Elizabeth his Wife; complaining of a Decree made by the Lord Chancellor of England, the Four and Twentieth and Five and Twentieth of January last, on Behalf of Lucius Henry Cary Lord Viscount Faulkland of the Kingdom of Scotland, Sir Will'm Whitlock Knight, and John Grout, whereby the Petitioners Bill was dismissed, and praying the Reversal of the said Decree:

It is ORDERED, by the Lords Spiritual and Temporal in Parliament assembled, That the said Lord Faulkland, Sir W'm Whitlock, and John Grout, may have a Copy of the said Appeal; and shall and they are hereby required to put in their Answers thereunto, in Writing, on Monday the One and Twentieth Day of this Instant February, at Ten of the Clock in the Forenoon.

Upon Report from the Lords Committees appointed to consider whether the Petition of Christopher and William Baron, Executors of George Baron, deceased, against Sir Will'm Hayward was fit to be received by this House:

Petition dismissed.

It is ORDERED, by the Lords Spiritual and Temporal in Parliament assembled, That the said Petition shall be, and is hereby, rejected; there needing no Explanation as to the Payment of Three Hundred Pounds therein mentioned, that Matter having been formerly determined by this House.

Countess of Macclesfield's Witnesses.

It is ORDERED, by the Lords Spiritual and Temporal in Parliament assembled, That Mr. Thomas Hardiman, Mr. Peter Bury, Mrs. Henrietta Gusshardier, Mr. Peter Lumbard, Edward Smyth Esquire, George Smyth Esquire, Mrs. Sarah Goodhall, Mrs. Elizabeth Bromley, Margaret Davis, William Martyn, Doctor Colladon, and Mr. William Buckingham, do attend this House on Wednesday next, at Ten of the Clock in the Forenoon, to be examined as Witnesses on the Part and Behalf of the Countess of Maclesfeld.

Proceedings in the K. B. concerning the Person who claims the Title of E. of Banbury.

The Earl of Rochester having offered to the House what he was ordered to report from the Lords Committees appointed to consider of the Proceedings in the Court of King's Bench, since the Judgement of this House of the Seventeenth of January, One Thousand Six Hundred Ninety-two, in relation to the Person who claimed the Title of Earl of Banbury:

It is ORDERED, by the Lords Spiritual and Temporal in Parliament assembled, That this Matter shall be considered on Thursday next, at Eleven of the Clock.

Howard & al. versus Marquis of Douglass.

Upon reading the Petition and Appeal of Henry Howard and Henry Hardeswell, Executors of Frances late Countess of Portland, from a Decree made by the Lord Keeper of the Great Seal of England, the Sixteenth Day of April, One Thousand Six Hundred Ninety-seven, on Behalf of James Lord Marquis of Douglas; and praying the Reversal of the said Decree.

Memorandum, This Appeal was received after the 14 Days, because the Respondents were quiet till within Eight Days last past.

It is ORDERED, by the Lords Spiritual and Temporal in Parliament assembled, That the Lord Marquis of Douglas may have a Copy of the said Petition, and shall and he is hereby required to put in his Answer thereunto, in Writing, on Monday the Eight and Twentieth Day of this Instant February, at Ten of the Clock in the Forenoon.
