Thorowgood versus Cordell.

After hearing Counsel upon the Petition and Appeal of John Thorowgood and Rebecca his Wife, from a Decree and Orders of the Court of Chancery, of the Twentieth Day of May One Thousand Six Hundred Ninety-three, the Seventh of June, the Nineteenth of July, and the Fourth of October, One Thousand Six Hundred Ninety-eight, in cross Causes, one wherein Edmund Cordell and Mary his Wife were Complainants, and John Thorowgood and Rebecca his Wife, John Budgen and Mary Hallett, were Defendants; and the other, wherein the said John Thorowgood and Rebecca his Wife were Complainants, and the said Edmund Cordell and Mary his Wife, and John Webb and Mary his Wife, Defendants; as also upon the Answer of the said Edmund

Judgement Offered, with Costs:

Cordell put in thereunto; and due Consideration of what was offered thereupon:

It is ORDERED and Adjudged, by the Lords Spiritual and Temporal in Parliament assembled, That the said Petition and Appeal of John Thorowgood and Rebecca his Wife shall be, and is hereby, dismissed this House; and that the Decree and Orders therein complained of shall be, and they are hereby, affirmed: And it is further ORDERED, That the Appellant John Thorowgood shall pay, or cause to be paid, unto the said Edmund Cordell, the Sum of Thirty Pounds, for his Costs.

Wood reprimanded, for signing the Cause, though not of Counsel in it.

Then the House took Notice, "That the printed Case for John Thorowgood was (contrary to a Standing Order of this House) signed by one Charles Wood, who was not Counsel in the Cause below, nor at the Hearing in this House:"

Whereupon Charles Wood being called in, and kneeling at the Bar, asked Pardon for his Offence; and was reprimanded by the Lord Chancellor, by Order of the House.

Sherard versus Sherard.

Upon reading the Petition of John Castle Sherard, Respondent to the Appeal of Castell Sherard; shewing, "That the Appellant hath not entered into Security for Costs according to Order; and praying a Day of hearing:"

It is ORDERED, by the Lords Spiritual and Temporal in Parliament assembled, That the Appellant shall, on or before Friday next, enter into a Recognizance for Costs; and that this House will hear the said Cause, by Counsel, at the Bar, on Monday the Five and Twentieth Day of this Instant March, at Eleven of the Clock in the Forenoon.
