Deeds belonging to Peers which were in the Hands of the Trustees for Ministers:

The Earl of North'on reported from the Committee for Inspection into Ordinances, the Particulars of those Deeds which belong to certain Peers, which were in the Custody of Mr. Phelpes, and now, by Order of both Houses, in the Hands of the Clerks of both Houses of Parliament.

And the Opinion of the Committee was, "That these and other Deeds, and Evidences, and Writings, as concern the Peers, may be delivered into the Custody of the Clerk of this House, that so the Lords may have Recourse unto them as there shall be Cause."

The particular Papers were read.

Committee for a Conference about them.

It is ORDERED, That it is referred to the Committee of Inspection into Ordinances, to prepare Reasons to be offered to the House of Commons, to induce them to order that the Deeds and Evidences mentioned in these Papers may be delivered to the Clerk of this House; and to report to this House.

Pownall's Order revoked.

Upon Report of the Lord Fynch, from the Committee for Petitions; shewing, "That Pownall, a Minister, hath, upon a Misinformation, obtained the Benefit of the general Order concerning securing of Tithes, and hath made indirect Use thereof:"

It is ORDERED, That the said Order of securing the Tithes is revoked and discharged.

Portington versus Dawson and Thomson.

Upon Report of the Lord Fynch, from the Committee of Petitions, of the Case of Roger Portington Plaintiff, against Dawson and Thomson, "That the Committee were of Opinion, That a Proviso be added to the Act of Indemnity, and to the Act for confirming of Judicial Proceedings (when they shall be transmitted from the House of Commons), whereby Portington may be at Liberty to seek any Remedy by Law, and be capable of such Relief in Equity as, upon further Examination of the Cause, shall by this House be thought fit to give him, notwithstanding the said Acts, or either of them."

Which Report this House confirms.

Proviso for Jenkins, in the Act to confirm Judicial Proceedings.

Upon reading the Petition of David Jenkins Esquire; shewing, "That whereas there is a Bill for Confirmation of Judicial Proceedings, he prays the same may not extend to a Decree made in Chancery the 6th Day of April, in the Year of our Lord 1644, by Lisle and Keeble, against David Jenkins of Grays Inne Esquire, having neither appeared nor answered, nor submitted to the same, but utterly denied their Power; the Plaintiff desires he may begin his Suit at his Pleasure."

It is ORDERED, That there be a Proviso to this Purpose added to the Act of Indemnity, and to the Act for confirming of Judicial Proceedings, when they shall be taken into Consideration by this House.

ORDERED, The Report upon the Petition of Mr. Byron be taken into Consideration the First Business Tomorrow Morning.

Pownall and Gorge, concerning the Rectory of Wraxall.

Upon the Report from the Lords Committees for Petitions, in the Case and Petition of Thomas Gorge Clerk:

It is ORDERED, &c. That the Sequestration of the Profits of the Rectory of Wraxall, in the County of Somersett, into the Hands of the Churchwardens and Overseers of the Poor of the said Parish, by virtue of an Order of this House, dated the 22th of June last, be, and is hereby, discharged; and the Possession and Profits of the said Rectory restored and continued to Thomas Gorge Clerk, until the Suit between him and Ezekiell Pownall, depending in Chancery, concerning the said Rectory of Wraxall, shall otherwise determine the same.

Adjourn.
