Message from H. C. with the Bill to vacate Sir E J. Powel's Fines.
A Message was brought from the House of Commons,
by Sir Thomas Gore and others; who returned a Bill
formerly sent down to them, for making void certain
Fines, levied by Sir Edward Powell and Dame Mary
his Wife, wherein the Commons have made certain
Amendments, to which their Lordships Concurrence is
desired.
The said Amendments were read.
The Question being put, "Whether to agree with
the House of Commons in these Amendments
now read?"
It was Resolved in the Affirmative.
Message from thence, with a Bill.
A Message was brought from the House of Commons,
by Sir Allen Broderick and others; who brought up a
Bill, passed by the House of Commons, intituled, "An
additional Act touching Matters of Assurance used
amongst Merchants;" wherein their Lordships Concurrence is desired.
Bill for Execution of attainted Persons.

Execution of certain Persons attainted of High
Treason."
ORDERED, That the Consideration of this Bill is
committed to a Committee of the whole House; and,
for the more speedy Dispatch, the House was presently
adjourned into a Committee, to debate it.
The House being resumed;
The Lord Chamberlain reported, "That the Committee, upon Consideration of the aforesaid Bill, do
find that in the said Bill there are the Names of Six
Persons left out, which are included in the Act of
Oblivion, and have been since attainted of High
Treason: Therefore the Opinion of the Committee
is, That there be a Conference with the House of
Commons, to acquaint them with this, and desire to
know the Reasons that induced them to leave them
out in this Bill."
Which this House approved of, and ordered the same
accordingly.
Message to H. C. for a Conference about it.
A Message was sent to the House of Commons, by
Sir Moundeford Brampston and Sir Nathaniell Hobart:
To desire a present Conference, in the Painted Chamber, concerning the Bill for Execution of some Persons
attainted for High Treason.
The Lord Chancellor and the Lord Chamberlain
were appointed to manage this Conference with the
House of Commons.
ORDERED, That the Duke of Richmond is added to
be of the Committee for the Bill concerning disuniting
the Two Hundreds from the Country and City of Gloucester.
Answer.
The Messengers sent to the House of Commons return with this Answer:
That the Commons will give their Lordships a present
Conference, as is desired.
The House was adjourned during Pleasure, and the
Lords went to the Conference; which being ended, the
House was resumed.
ORDERED, That the Lord Gerard of Brand. is added
to the Committee for repealing Acts.
ORDERED, That the Lord Berkley of Berkley is
added to the Committee for the Bill concerning Gloucester; and Viscount Fauconberg is added to the Committee for Clitheroe; and the Lord Eure, Lord Ward,
and the Lord Langdale, are added to the Committee
for Petitions.
Yares versus Hoskins, in Errors:
Whereas John Yates, Plaintiff in a Writ of Error
against Thomas Hoskins Defendant, hath not assigned his
Errors according to Rule:
It is ORDERED, That if the said Plaintiff shall not
assign Errors, according to due Course in Law, within
Ten Days next after the Date of this Order, he or his
Attorney being timely served herewith, that then the
said Plaintiff shall lose his said Writ, and the Transcript
of the Record shall be remitted without further Order.
