Bp. Bath and Wells takes the Oaths.

This Day George Lord Bishop of Bathe & Wells took the Oaths, and made and subscribed the Declaration, and also took and subscribed the Oath of Abjuration, pursuant to the Statutes.

Recruits for Land Service and Marines, Bill.

Hodie 2a vice lecta est Billa, intituled, "An Act for raising Recruits for the Land Forces and Marines; and for dispensing with Part of the Act for the Encouragement and Increase of Shipping and Navigation, during the present War."

ORDERED, That the said Bill be committed to a Committee of the whole House, on Friday next, at One a Clock; and all the Lords summoned to attend.

Justices of Peace, Lists of, to be brought in.

It is ORDERED, by the Lords Spiritual and Temporal in Parliament assembled, That the Clerk of the Crown in Chancery do, on Friday next, at Eleven a Clock, lay before this House, in Writing, Lists of the Names of all the Justices of Peace in the several Counties of this Kingdom.

Rose versus College of Physicians, in Error:

After hearing Counsel, to argue the Errors assigned upon the Writ of Error brought into this House, the Eighteenth Day of February One Thousand Seven Hundred and Three, from Her Majesty's Court of Queen's Bench, wherein Judgement is entered, for the President and College or Commonalty of the Faculty of Physic, London, Qui tam, &c. against William Rose Apothecary, for Five Pounds, for practising Physic for One Month, within Seven Miles of the City of London, without the Licence of the Plaintiffs under their Common Seal, contrary to their Charter, and an Act of the 14 and 15 H. VIII.; and it being found specially by the Jury, on the Trial of that Cause, "That the Defendant was an Apothecary, and a Freeman of the City of London, and, not being licensed by the Plaintiffs, without the Advice of any Physician, and without any Fee for Advice taken by him, did, at the Request of John Seale, a sick Person, make up and compound several Medicines; (videlicet,) Boluses, Electuaries, and Julaps, and sold and delivered the same to him, to be drunk and taken as proper for his Distemper;" and the same being adjudged by the Court of Queen's Bench to be as practising Physic, within the said Charter; and due Consideration had of what was offered thereupon.

Judgement reversed.

It is ORDERED and Adjudged, by the Lords Spiritual and Temporal in Parliament assembled, That the said Judgement given in the Queen's Bench, for the President and College or Commonalty of the Faculty of Physic, London, against the said William Rose, shall be, and is hereby, reversed.

The Tenor of which Judgement, to be affixed to the Record to be remitted, is as followeth; (videlicet,)

Midd'x, a Cur. dict. Dominæ Reginæ, coram ipsa Regina, transmiss. fuit; prædictusque Will'us Rose, in Cur. Parliamenti præd. per Ric'um Watts Attornat. suum comparens, quandam Materiam pro Error. in Record. & Process. præd. ac etiam in Redditione Judicii in Record. præd. mentionat. pro Revocatione & Adnullatione Judicii præd. assign.; super quo, præd. Præsidens & Collegium, seu Communitas Facultatis Medicin. London. qui tam, &c. in eadem Cur. Parliamenti, per Ric'um Swift Attornat. similiter comparen. placitaver. quod nec in Record. & Process. præd. nec in Redditione Judicii præd. in ullo est Errat. Et postea, scilicet, Die Mercurii, Decimo Quinto Die Martii, Anno Regni dictæ Dominæ Annæ nunc Reginæ Angl. &c. Tertio, visis & per Curiam Parliamenti præd. diligenter examinatis & plenius intellectis omnibus & singulis Præmissis, maturaque Deliberatione inde habita, videtur Curiæ Parliamenti præd. quod in Record. & Process. prædict. necnon in Redditione Judicii præd. in præd. Curia dictæ Dominæ Reginæ, coram ipsa Regina, maniseste est Errat.: Ideo considerat. est per eandem Cur. Parliamenti præd. quod Judicium præd. in Curia dictæ Dominæ Reginæ, coram ipsa Regina, pro præd. Præsiden. & (fn. *) Collegio seu Communitate Facultatis Medicin. London. qui tam, &c. versus præd. Will'um Rose, in Forma præd. reddit. revocetur, adnulletur, & penitus pro nullo habeatur; & quod præd. Will'us Rose ad omnia quæ Occasione Judicii præd. amisit restituatur, &c.: Et superinde Record. & Process. præd. Cur. Parliamenti præd. dict. Cur. dict. Dominæ Reginæ, coram ipsa Regina, ubicunque &c. per eandem Curiam Parliamenti præd. remittantur, &c."

Adjourn.

Dominus Custos Magni Sigilli declaravit præsens Parliamentum continuandum esse usque ad & in diem Jovis, decimum sextum diem instantis Martii, hora undecima Auroræ, Dominis sic decernentibus.
