The Attorney General v. Winstanley, in Error:

The Order of the Day being read for hearing Counsel to argue the Errors assigned upon the Writ of Error wherein The Attorney General is Plaintiff, and Thomas Winstanley is Defendant; and for the Judges to attend; Counsel were accordingly called in:

And the Plaintiff's and Defendant's Counsel being fully heard, as also One Counsel for the Plaintiff, by way of Reply;

The Counsel were directed to withdraw.

Questions put to the Judges:

Proposed, "That the following Questions of Law be put to the Judges:

"1. Whether if a Trader, having mortgaged his Land as Security for Payment of a Debt, afterwards become bankrupt, and the whole Interest in the Land is sold by Auction by Order of the Assignees of the Bankrupt, and with the Concurrence of the Mortgagee, Duty on the Sale is payable to His Majesty on the Whole or any and what Part of the Sum produced by the Sale?

"2. Whether if a Trader, after such Mortgage, conveys the Land to Trustees, on Trust to raise further Sums, and to sell, for Payment of former and new Incumbrances, and the Land is sold by Auction by Order of the Assignees, with the Concurrence of the Trustees, it not appearing that any further Sum was raised by the Trustees or new Incumbrance created by them, or the Mortgagees informed of the Sale, Duty is payable to His Majesty on the Whole or any Part of the Sum produced by the Sale?"

The same was agreed to; and the said Questions were accordingly put to the Judges.

Judges Opinion delivered:

The Lord Chief Justice of the Court of Common Pleas, having conferred with the rest of the Judges present, delivered their unanimous Opinion upon the said Questions in the Negative; and gave his Reasons:

Whereupon the following Order and Judgment was made:

Whereas, by virtue of His Majesty's Writ of Error returnable in the House of Lords in Parliament assembled, a Record of the Court of King's Bench was brought into this House on the 15th Day of April 1829, wherein The King is Plaintiff, and Thomas Winstanley is Defendant, in order to reverse a Judgment given in the Court of Exchequer Chamber, affirming a Judgment of the Court of Exchequer for the said Defendant; and Counsel having been heard this Day to argue the Errors assigned upon the said Writ of Error; and after hearing the unanimous Opinion of the Judges present upon Two Questions of Law to them proposed; and due Consideration had of what was offered on either Side in this Cause:

Judgment Affirmed:

It is Ordered and Adjudged, by the Lords Spiritual and Temporal in Parliament assembled, That the Judgment given in the Court of Exchequer Chamber, affirming a Judgment of the Court of Exchequer, be, and the same is hereby Affirmed; and that the Record be remitted, to the end such Proceeding may be had thereupon as if no such Writ of Error had been brought into this House.

The Tenor of which Judgment, to be affixed to the Transcript of the Record, is as follows:

Tenor.

"On which Day, before the same Court of Parliament aforesaid, at Westminster aforesaid, come the Parties aforesaid, by their Attornies aforesaid; Whereupon as well the Record and Proceedings aforesaid, and the Judgment on the same given, and the Affirmance thereof, as the said Causes and Matters for Error by Sir Charles Wetherell Knight, Attorney General of Our said Sovereign Lord the King, above assigned, being seen by the said Court of Parliament, and diligently examined and inspected; For that it seemeth to the Court of Parliament aforesaid now here, that neither in the Record and Proceedings aforesaid, nor in the Rendition of the Judgment aforesaid, nor in the Affirmance thereof, there is any Error, and that the said Record is in nothing vicious or defective in Law; It is considered, that as well the Judgment aforesaid, as the Affirmance thereof, be in all Things Affirmed, and stand in their full Force and Effect, the said Causes and Matters for Error above assigned in anywise notwithstanding: And thereupon the Record aforesaid, and also the Proceedings aforesaid had in the same Court of Parliament in the Premises, are remitted by the same Court of Parliament to the Barons of the Exchequer, to the end Execution might be done thereupon, &c."

Warburton v. Loveland, in Error.

The Order of the Day being read for hearing One Counsel of a Side, further to argue the Errors assigned upon the Writ of Error wherein Elizabeth Warburton is Plaintiff, and James Loveland, Lessee of George Ivie and others, is Defendant; and for the Judges to attend;

Ordered, That the further Hearing of the said Errors argued be put off 'till To-morrow; and that the Judges do then attend.

D. of Hamilton's Estate Bill.

The Earl of Shaftesbury reported from the Lords Committees, to whom the Bill, intituled, "An Act to enable The Most Noble Alexander Duke of Hamilton and Brandon, and the Heirs of Entail of the Lands and Barony of Kinneil, in the Shire of Linlithgow, to charge the Sleeches or Land to be gained from the Sea opposite the said Barony with the Expences laid out in gaining the same," was committed; "That they had considered the said Bill, and examined the Allegations thereof, which were found to be true; that the Parties concerned had given their Consents to the Satisfaction of the Committee; and that the Committee had gone through the Bill, and made One Amendment thereto."

Which Amendment, being read Twice by the Clerk, was agreed to by the House.

Ordered, That the said Bill, with the Amendment, be ingrossed.

Bruton Roads Bill.

The Earl of Shaftesbury also reported from the Lords Committees, to whom the Bill, intituled, "An Act for more effectually repairing several Roads in and near the Town of Bruton, and other Roads, in the Counties of Somerset and Wilts; and for making and maintaining Two other Roads communicating therewith," was committed; "That they had considered the said Bill, and examined the Allegations thereof, which were found to be true; and that the Committee had gone through the Bill, and directed him to report the same to the House, without any Amendment."
