The joint and several Answers of Nicholson Peyton, Eliza Peyton, Charlotte Lea Peyton, Reynolds Peyton, Thomas Griffith Peyton, Henry Peyton, Francis Peyton, William Peyton, Elizabeth Peyton and Eliza Berry Peyton, to the Petition and Appeal of Elizabeth Houston and Charlotte Griffiths, were this Day brought in.

Robertson v. Harford, Brothers & Co. & Christie.

Warburton v. Loveland, in Error:

The Order of the Day being read for further hearing One Counsel of a Side further to argue the Errors assigned upon the Writ of Error wherein Elizabeth Warburton is Plaintiff, and James Loveland, Lessee of George Ivie and others, is Defendant; and for the Judges to attend;

Counsel were accordingly called in:

And the Defendant's Counsel being fully heard, as also Counsel for the Plaintiff, by way of Reply;

The Counsel were directed to withdraw.

Questions put to the Judges.

Proposed, "That the following Questions of Law be put to the Judges; (vizt.)

"An unmarried Woman being possessed of Land in Ireland for a long Term of Years, and about to marry, assigned the Term by a Deed, executed also by the intended Husband, to Trustees, upon Trust to permit the Husband after Marriage to receive the Rents for Life, then the Wife for Life, then the First Son of the Marriage, if any, with Remainder over. The Marriage took effect, the Husband entered into Possession, and received the Rents and Profits, and then made a Lease for Years for Part of the Term, rendering Rent. The Lessees entered and received the Rents and Profits, and then assigned the Lease for a valuable Consideration.

The Marriage Settlement was not registered.

The Lease, by the Husband, was registered.

The Assignment of the Lease is supposed not to have been registered.

"The Wife, surviving her Husband, obtained Possession of the Land. The Assignees of the Lease brought an Ejectment against her to recover the Possession, Regard being had to the true Construction of the Irish Register Act, 6 Anne, c. 2.

"1. Which Title is to be preferred, that of the Assignees of the Lease, or of the Widow, or the Trustees under the Settlement?

"2. Supposing the Assignment of the Lease to have been registered, will the Construction be the same?"

The same was agreed to; and the said Questions were accordingly put to the Judges:

And the Judges desiring Time to consider the said Questions;

Ordered, That the further Consideration of the said Cause be put off sine Die.

The House was adjourned during Pleasure.

The House was resumed by The Lord Chancellor.

Indemnity Bill.

A Message was brought from the House of Commons, by Sir Alexander Grant and others;

With a Bill, intituled, "An Act to indemnify such Persons in the United Kingdom as have omitted to qualify themselves for Offices and Employments, and for extending the Time limited for those Purposes respectively until the Twenty-fifth Day of March One thousand eight hundred and thirty-two; to permit such Persons in Great Britain as have omitted to make and file Affidavits of the Execution of Indentures of Clerks to Attornies and Solicitors to make and file the same on or before the First Day of Hilary Term One thousand eight hundred and thirty-two; and to allow Persons to make and file such Affidavits, although the Persons whom they served shall have neglected to take out their Annual Certificates;" to which they desire the Concurrence of this House.

Birmingham & Liverpool Canal Bill.

A Message was brought from the House of Commons, by Mr. Clive and others;

With a Bill, intituled, "An Act to enlarge and amend the Powers and Provisions of the several Acts relating to the Birmingham and Liverpool Junction Canal, and to better supply the said Canal with Water;" to which they desire the Concurrence of this House.

Liverpool & Manchester Railway Bill.

A Message was brought from the House of Commons, by Mr. Clive and others;

With a Bill, intituled, "An Act for amending and enlarging the Powers and Provisions of the several Acts relating to the Liverpool and Manchester Railway;" to which they desire the Concurrence of this House.

Ollerset, &c. Waterworks Bill.

A Message was brought from the House of Commons, by Mr. Mundy and others;

With a Bill, intituled, "An Act for better supplying with Water the several Hamlets of Beard, Ollerset, Thornset and Whittle, in the Parish of Glossop, in the County of Derby;" to which they desire the Concurrence of this House.

Trent & Mersey Navigation Bill.

A Message was brought from the House of Commons, by Mr. Clive and others;

With a Bill, intituled, "An Act to consolidate and extend the Powers and Provisions of the several Acts relating to the Navigation from the Trent to the Mersey;" to which they desire the Concurrence of this House.

Hyde, &c. Waterworks Bill.

A Message was brought from the House of Commons, by Mr. Clive and others;

With a Bill, intituled, "An Act for better supplying with Water the several Townships of Hyde, Werneth and Newton, in the County Palatine of Chester;" to which they desire the Concurrence of this House.

Glamorganshire Roads Bill.

A Message was brought from the House of Commons, by Mr. Clive and others;

With a Bill, intituled, "An Act to amend an Act of the Seventh and Eighth Years of His late Majesty, for the more effectually repairing and otherwise improving the Roads in the County of Glamorgan;" to which they desire the Concurrence of this House.

Yaxley Drainage Bill.

A Message was brought from the House of Commons, by Mr. Clive and others;

With a Bill, intituled, "An Act for embanking, draining, improving and preserving certain Fen Lands and Low Grounds lying in the Parish of Yaxley, in the County of Huntingdon, called "The Undrained Fen;" to which they desire the Concurrence of this House.

The said Eight Bills were, severally, read the First Time.

Com rs of new Churches Account delivered.

The House being informed, "That Mr. Waple, from the Commissioners for building Churches, attended;"

He was called in; and delivered at the Bar, pursuant to the Directions of an Act of Parliament,

"An Account of Charges and Expences paid by His Majesty's Commissioners for building new Churches between 25th March 1830 and 25th March 1831."

And then he withdrew.

And the Title thereof being read by the Clerk;

Ordered, That the said Account do lie on the Table.

Beer & Malt Duty, Returns respecting, Ordered.

Ordered, That there be laid before this House, "A Return of the Number of Licences taken out for the Sale of Beer, Ale, Cyder, &c. under the Act 11th Geo. 4th, Cap. 64, up to the latest Period to which the said Returns can be made out, and distinguishing the Counties in which the said Licences have been taken out:"

And also, "A Return of the Number of Bushels of Malt that have paid the Duty in the last Ten Years, ending April 5th, 1831, distinguishing the Number of Bushels returned in each Year."

Houston & Griffiths v. Hughes et al.

Ordered, That the Cause wherein Elizabeth Houston and Charlotte Griffiths are Appellants, and Henry Alwright Hughes, and others, are Respondents, be heard by Counsel at the Bar on Tuesday next.

Harris v. Kemble et al. Respondents Petition for an early Day.

Upon reading the Petition of Charles Kemble, John Saltren Willett and John Forbes, Three of the Respondents in a Cause depending in this House, to which Henry Harris is Appellant; praying, "That their Lordships will be pleased to fix the earliest possible Day for the hearing of the said Cause, or that their Lordships will be pleased to make such other Order in the Premises as in their Lordships great Wisdom may seem meet:"

It is Ordered, That the said Cause be heard, by Counsel at the Bar, on Tuesday next.

Baillie v. Grant, Respondent's Petition to dismiss Appeal if not revived, referred to Appeal Com ee.

Upon reading the Petition of Margaret Grant, Respondent in a Cause depending in this House, to which Alexander Baillie is Appellant; setting forth, "That the Petitioner was a Creditor of the Appellant in several large Sums of Money, exceeding £3,000 in the whole, and the Appellant having succeeded to a considerable Fortune vested in the Public Funds, he took up his Residence in the Sanctuary of Holyrood House, to avoid the Diligence of his Creditors: That the Respondent thereupon, in Terms of the Act of the 54th of George 3d, Chapter 137, applied by Petition to the Court of Session for a Sequestration of his Estate and Effects; and on the 20th of May 1830 such Sequestration was accordingly awarded by that Court: That on the 29th of May 1830 the Appellant presented his Appeal against the said Interlocutor of the 20th of May 1830, and the same was answered by the Petitioner, and duly set down for hearing before their Lordships: That upon the Petition of the Appellant, stating the Urgency of the Case, and that the Cause should receive Despatch, as relating to a Matter of Bankruptcy, their Lordships specially appointed the same to be heard on the first Cause Day after the then ensuing Christmas Recess; but upon the 12th Day of December last the said Appellant died, and his Appeal thereby became abated: That the said Appellant has left Catharine Grant or Baillie, his Widow or Relict, and Catharine Baillie or Bigg, Mary Baillie, Margaret Baillie, Isabella Baillie and Sophia Baillie, his Children and next of Kin, all residing in Cross Causeway, in the City of Edinburgh, him surviving: That the said Widow or Relict and next of Kin have a material Interest in the Questions involved in the said Appeal; and the Funds of the Deceased must, 'till the said Appeal be disposed of, be locked up, to the great Inconvenience as well of them as of the Creditors of the said Deceased;" and therefore praying their Lordships, "That an Order may be made upon the said Widow and Relict and the said Children of the Appellant, deceased, to revive the said Appeal within a Time to be limited by their Lordships; and that upon their failing so to do the said Appeal may stand dismissed:"

It is Ordered, That the said Petition be referred to the Committee appointed to consider of the Causes in which Prints of the Appellants and Respondents Cases, now depending in this House in Matters of Appeals and Writs of Error, have not been delivered, pursuant to the Standing Orders of this House.

Doncaster Road Bill, Petition against, referred to the Com ee:

Upon reading the Petition of the several Persons whose Names are thereunto subscribed, Trustees appointed by and acting in pursuance of an Act of Parliament made and passed in the First Year of the Reign of His late Majesty King George the Fourth, intituled, "An Act to continue the Term and alter and enlarge the Powers of several Acts passed for repairing the Roads therein described, so far as the said Acts relate to the Roads leading from Ferrybridge, through Wetherby, to Boroughbridge, in the County of York;" taking notice of a Bill depending in this House, intituled, "An Act for repairing and improving the Road from Doncaster, through Ferrybridge, to the South Side of Tadcaster Cross, in the County of York;" and praying their Lordships, "That they may be heard by their Counsel, Agents and Witnesses against such Parts of the said Bill as may affect them:"

It is Ordered, That the said Petition be referred to the Committee to whom the last-mentioned Bill stands committed, and that the Petitioners be at liberty to be heard by their Counsel, Agents and Witnesses against such Parts of the said Bill as may affect them, as desired; and that Counsel be heard for the Bill at the same Time, if they think fit.

L d Sinclair's Estate Bill Specially reported.

The Earl of Shaftesbury reported from the Lords Committees appointed to consider of the Bill, intituled, "An Act to empower the Judges of the Court of Session in Scotland to sell such Part of the Entailed Lands and Barony of West Nisbet, in the County of Berwick, now belonging to Charles Carre Lord Sinclair, as shall be sufficient for Payment of the Provisions, Debts and Incumbrances affecting the same;" "That the Committee had met, and considered the said Bill, and examined the Allegations thereof, which were found to be true; and that all the Parties concerned in the Consequences of the Bill had consented thereto in the Manner required by the Standing Orders of this House, except The Right Honorable Charles Carre Lord Sinclair, (the Heir of Entail in Possession of the Estates mentioned in the Bill,) who was proved to be at Lausanne, in Switzerland; but that David Robertson appeared and consented to the Bill on the Behalf of the said Charles Carre Lord Sinclair, and for his Lordships infant Children Charles Saint Clair, John Saint Clair, Ellen Saint Clair and Jane Elizabeth Saint Clair, (the Second, Third, Sixth and Seventh Heirs of Entail after the Heir in Possession,) by virtue of a Special Power of Attorney for that Purpose, which was produced to the Committee, and duly proved; and that the Committee had gone through the Bill, and directed him to report the same to their Lordships, with some Amendments."

Which Report, being read by the Clerk, was agreed to by the House.

Then the Amendments made by the Committee to the said Bill, being read Twice by the Clerk, were agreed to by the House.
