Prayers.

Leave of Absence.

ORDERED, That Mr. Weaver, a Member of this House, shall have Leave to go into the Country, to look after his own Occasions for a little time, in regard of his being appointed to go very shortly into the Isle of Guernsey.

Sheriff of Wiltes.

Ordered, That Edward Tooker Esquire, appointed by both Houses to be Sheriff of the County of Wiltes, shall have Leave to be absent out of his County, and to go to the Bathe for Recovery of his Health, or to come to London upon his necessary Occasions.

Sheriff of Southampton

Ordered, That Francis Tilney Esquire, appointed by both Houses to be Sheriff of the County of Southampton, shall have Leave to be absent out of his County, and, upon his own Occasions, to come to London, or elsewhere.

Sheriff of Derby.

Ordered, That Sir Samuell Sleigh Knight, nominated and appointed, by both Houses, to be Sheriff of the County of Derby, shall have Leave to be absent out of his County, and, upon his own Occasions, to come to London.

Message from Lords.

A Message from the Lords, by Sir Edward Leech and Mr. Page;

The Lords have commanded us to return unto you an Order for Payment of the Lord Pawlett's Rents, to the Use of the State; which moved first from this House; with some Alterations: An Ordinance for Settling of Ministers in the City of Lichfield: It moved from this House: The Lords have agreed unto it, with some Alterations, and a Proviso.-An Ordinance for Dr. Chamberlaine: In which they desire the Concurrence of this House:-A Petition of the Lady Burlase:-A Petition of Margarett Roberts, a poor distressed Widow: Which they refer to the Consideration of this House.

The Lords desire to put you . . mind of a Message they formerly sent unto this House, That the French Ambassador may be allowed such Impost of Wines as other Ambassadors have had.

Admiralty.

Ordered, That the Members of this House that are of the Committee of the Admiralty and Cinque Ports, be enjoined to meet this Afternoon.

Ld. Pawlett's Rents.

The Amendments to the Lords Order, concerning the Lord Pawlett's Rents in his Tenants Hands, were read.

Execution of Illery.

The humble Petition of Joane Iliery, of Hemyock in the County of Devon, a poor distressed Widow, to the Judges of Assize for the County of Devon, was read; shewing that her Husband was barbarously murdered and executed by the sole Order and Command of the Lord Pawlett; was this Day read; and likewise a Certificate under the Hands of Nine or Ten Persons, certifying the same, and avowing themselves to be Ear and Eye Witnesses of the Facts and all the Proceedings therein.

Ordered, upon the Question, That the Lord Pawlett be referred to his Tryal at Law, concerning the Death of Henry Illerie, executed at Hemyock.

Ordered, upon the Question, That it be referred to the Justices of Peace in the Eastern Division of the County of Devon, to examine the whole Matter of Fact touching the Death and Execution of Illerie, of Hemiock in the County of Devon, in order to the Tryal of the Lord Pawlett; and to certify the same to the House: And the Care of this Business is more particularly referred to Sir John Young and Wm. Fry Esquire.

Grant to Illery.

Ordered, That the Sum of an Hundred Pounds be bestowed upon Joane Illery, the Widow of Henry Iilerie, executed in the Parliament's Service, at Hemyock in the County of Devon, for Relief of herself, and her Three fatherless Children: And that the said Sum of One hundred Pounds be paid unto the said Widow, out of the Sequestrations of the County of Devon: And the said Committee of Sequestrations are hereby required and enjoined to take Notice of this Order, and to pay the said Sum of an Hundred Pounds to so charitable a Use and Relief accordingly.

General Magazine.

Ordered, That the Committee of the Army do take speedy and effectual Course for providing a general Magazine for the Service of the Kingdom; and, out of that, to replenish the Stores at Newcastle.

Disbanding Forces.

Ordered, That the General do take speedy and effectual Care for disbanding the Forces appointed to be disbanded at Pendennis Castle.

Publick Stores.

Ordered, That, on Wednesday next come Sevennight, Report be made from the Committee at Derby House, touching the publick Stores.

Lichfield Ministers.

The Amendments to the Ordinance for settling Ministers in the City of Lichfield, were read; and, upon the Question, assented unto.

Oxford Ministers.

Ordered, That Mr. Prideaux do prepare and bring in an Ordinance for settling Maintenance upon Preaching Ministers in the City of Oxon, out of the Rents and Profits of the Dean and Chapter of Exeter.

Winton Ministers.

Ordered, That Mr. Lisle do prepare and bring in an Ordinance for settling Maintenance upon Preaching Ministers in the City of Winton, out of the Rents and Profits of the Dean and Chapter of Winton.

Answer to Lords.

Answer returned by the same Messengers; That this House has considered their Lordships Message; and do agree to the Alterations in the Ordinance for settling Maintenance upon Ministers in the City of Lichfield.

Persons committed.

Resolved, &c. That Sir Sackvile Crow Knight, and Mr. Henry Hide Merchant, now on Shipboard in the River of Thames, be forthwith committed Prisoners to the Tower of London, in order to their Tryal: And that the Serjeant at Arms attending on this House do receive the Persons of the said Sir Sackvile Crow and Mr. Henry Hide, from the Captain of the Ship Margarett, or such other Officers in whose Custody they are; and convey them forthwith Prisoners to the Tower accordingly.

Ordered, That it be referred to the Committee of the Navy, to consider of, hear, and receive such Complaints as shall be put in, and exhibited, against Sir Sackvile Crow and Mr. Henry Hide, by the Levant Company, or others; to hear and examine Witnesses, and to receive Proofs; and likewise to hear and examine Sir Sackvile Crow and Mr. Henry Hide; and to hear and receive such Proofs and Witnesses as shall be produced by them, on their Behalf; and, upon hearing Parties and Witnesses of all Sides, to state the Matter of Fact, and report their Opinions thereupon to the House.

Adjournment.

Resolved, &c. That the House (at the Rising thereof) do adjourn itself until Wednesday next come Sevennight, at Eight of Clock in the Morning; and that, notwithstanding, all Committees do sit in the mean while.

Derby House Committee.

Ordered, That the Members of this House that are of the Committee at Derby House, be required to meet diligently at the Committee, notwithstanding the Adjournment of the House.

Message to Lords.

Mr. Annesley carried to the Lords, for their Concurrence, an Order for the Payment of the Sum of One thousand Pounds to Colonel Wm. Jephson, out of the Receipts of the Excise in Course, with Interest for the same: An Order for Payment of Fifteen hundred Pounds to Colonel Wm. Jephson, out of the Fifth, and Twentieth Parts of Delinquents, that have not yet paid in their Fifth, and Twentieth Parts.

He was to acquaint the Lords, That this House had resolved to adjourn till To-morrow Sevennight: And that, notwithstanding, they have appointed their Members that are of the Committee at Derby House, to attend that Service; and desire their Members might do the like.

Sykes' Claims.

An Ordinance for Payment of the Sum of Three thousand Nine hundred Sixty-three Pounds Eighteen Shillings and Five-pence to Wm. Sykes Merchant, out of the Receipts of the Excise, in Course, with Interest for the same, was this Day read; and, upon the Question, passed; and ordered to be sent unto Lords for their Concurrence.

Houghton's Arrears.

An Ordinance for Payment of the Sum of Seven hundred Seventy-nine Pounds Five Shillings and Nine-pence to Colonel Sir Richard Houghton, out of the Receipts of the Grand Excise, in Course, was this Day read; and, upon the Question, assented unto; and ordered to be sent unto the Lords for their Concurrence.

Lord Grey's Claims.

Ordered, That the Tenants and Under-tenants of the Earl of Chesterfield, a sequestered Delinquent, do, from time to time, pay unto Thomas Lord Grey the full Rents formerly payable unto the Earl of Chesterfield, until the Sum of Five thousand One hundred and Twenty Pounds be fully satisfied and paid unto the said Lord Grey, out of the Rents and Profits of the Lands and Tenements of the said Earl of Chesterfield, according to a former Order of both Houses in that Behalf; notwithstanding any other or former Order of the Committee of Lords and Commons for Sequestrations, or any other Committee, made concerning the Rents and Profits of the said Lands and Tenements.

Answer from Lords.

Mr. Annesley brings Answer, That the Lords do agree to the Orders for the several Sums of One thousand Pounds and Fifteen hundred Pounds to Colonel Wm. Jephson: They will adjourn their House till To-morrow come Sevennight: They have ordered the Members of their House that are of the Committee of Derby House, to attend the Service of the Kingdom.

Customs.

Upon Mr. Edward Ashe his Report from the Committee, to whom was referred the Consideration and Examination of the State of the Commissioners Receipts and Disbursements, delivered in by Mr. Toomes, SurveyorGeneral of the Customs, upon Order of this House;

It is Resolved, &c. That, from henceforth, the Commissioners of the Customs shall stand and be charged with the Monies received in the Out Ports, Forty Days after every Month; unless they can shew good Cause to the contrary.

Resolved, &c. That the Allowing of the Cause to be shewed, from time to time, by the Commissioners of the Customs, be referred to the Committee of the Navy: And the said Committee has hereby Authority to allow thereof, as they shall see Cause.

Resolved, &c. That the Commissioners of the Customs have been faithful in their Employments, for aught appears to this House to the contrary.

The Question was propounded, That, as for the Charge and Reply of Mr. Toomes, he hath done but the Duty of his Place:

And the Question being put, Whether this Question shall be now put;

It passed with the Affirmative.

Resolved, &c. That, as for the Charge and Reply of Mr. Toomes, he hath done but his Duty of his Place.

Ordered, That it be referred to the Committee of the Navy, to communicate unto the Commissioners of the Customs the Votes now passed, to receive their positive Answer touching the Loan of Thirty-thousand Pounds; and in case of failing with them, to pursue their former Order.

Resolved, &c. That the Commissioners of the Customs do take effectual Course, that the Collector of the Customs in the Port of Dover do clear his Accompt within Twenty Days.

Resolved, &c. That it be referred to the Committee of the Navy, to consider, which way the Receipts of the Customs, in the Port of Dover, and the Composition Trade there, may be managed to the best Advantage of the State; and to report their Opinions, upon the whole Matter, to the House, with all convenient Speed.

Irish Affairs.

Ordered, That it be referred to the Committee for the Affairs of Ireland, at Derby House, to proceed upon the Matters referred unto them, in relation to Colonel Jones, Governor of Dublyn, and the Forces in Lemster, in such manner as they shall see Cause; notwithstanding they have made no Report thereof to the House.

Excise.

Ordered, That, on Thursday next come Sevennight, the Auditors and Comptroller of the Excise do bring in the State of the Accompts of the Excise.

Fens.

Ordered, That, on Thursday next come Sevennight, the first Business, and nothing to intervene, the Reports of the Ordinance concerning the great Level of the Fens be made.

Cook's Accompts.

Ordered, That it be referred to the Committee for taking the Accompts of the Kingdom, to state and certify the Accompts of Colonel Edward Cook.

Army Pay.

Ordered, That Mr. Greenhill and Mr. Pocock, Treasurers at Christ Church, do, out of the Nine thousand One hundred Pounds, reserved out of the Monies of Goldsmiths Hall, for indigent Persons, pay proportionably, as the Monies will hold out, the Officers and Soldiers, whose Names are contained in the List presented to this House by Auditor Wilcox; taking especial Care, and endeavouring . . all means, that no Monies be paid to those that shall appear to have been engaged against the Parliament about July or August last: And Mr. Potter, Clerk to the Committee of the Military Garden, is appointed to be present at the Time of Payment, with Mr. Greenhill and Mr. Pocock, with his Books of the Five Qualifications, and the former List, by which they have received any former Monies, whereby none of them may be twice paid; nor any paid that are not comprehended within the Five Qualifications.

Army Arrears.

Ordered, That the several Persons that do clamour at the Doors of the House, demanding any Arrears from the Parliament, do repair to the Knights and Burgesses of the several and respective Counties and Towns, upon whose Entertainments, they, their Husbands, or Fathers, were employed in the Service of the Parliament; or any Two of them: The which Knights and Burgesses, or any Two of them, respectively, are hereby authorized and required to examine the Justness of their Demands; and as they shall see Cause, to certify the state of it to the House; to the end the House may take such Course for their Relief and Satisfaction, in the several Counties and Places where they served, as may be just and honourable to the Parliament.
