Treaty with the King.

A MESSAGE from the Lords, by Baron Trevor and Mr. Justice Godbolt;

The Lords do desire a Conference, this Day at Eleven of Clock, in the Painted Chamber, if it may stand with the Conveniency of this House, concerning a Vote formerly sent to this House, for the not insisting upon the Three Propositions sent into Scotland, before a Treaty be had with the King.

Resolved, &c. That this House doth agree to a Conference, as is desired.

Mr. Swinfen, Mr. Lane, Sir Thomas Widdrington, Sir Edward Aiscough, are appointed Reporters of this Conference.

Answer returned by the same Messengers; That this House has considered their Lordships Message; and do agree to a Conference, as is desired.

Copley's Arrears.

The Petition of Colonel Christofer Copley, was this Day read.

A Letter from the General, recommending his Condition, and good Services; and a former Letter from this House to Colonel Copley, taking Notice of his good Services; were all likewise read.

The Certificate of the Accompt of the said Colonel Christofer Copley was this Day read: Upon the Foot of which Accompt, there rests an Arrear unto the said Colonel Copley of Four thousand Three hundred Twentyfour Pounds and Nine Shillings.

Whereas it appears, upon the Certificate of the Accompt of Colonel Christofer Copley, That there rests, upon the Foot of the said Accompt, an Arrear of Pay due unto the said Colonel, upon his Entertainment in the Service of the Parliament, the Sum of Four thousand Three hundred Twenty-four Pounds and Nine Shillings: It is Ordered, That the said Sum of Four thousand Three hundred Twenty-four Pounds and Nine Shillings be forthwith paid unto the said Colonel Christofer Copley, or his Assignee, out of the Sequestration Monies formerly received, and yet remaining in the Hands of the Sequestrators, Collectors, Receivers, Treasurers of the Sequestrations of the County of Yorke, if the same may be found in their Hands: That if not, then so much as cannot be had out of those Monies, be paid out of the growing Profits of the Sequestrations in the County of Yorke, next after the Engagements, upon the said Sequestrations, unto Colonel Legard, by former Order of both Houses, be satisfied: And the Committee of Sequestrations in the County of Yorke, the Sequestrators, Collectors, Receivers, and Treasurers of the Sequestrations in the said County of Yorke, are hereby required and enjoined to take Notice of this Order; and to yield ready Obedience thereunto; and to make Payment of the said Monies to the said Colonel Christofer Copley, or his Assignee, as aforesaid: And that the Acquittance of the said Colonel Christofer Copley, from time to time, shall be a sufficient Warrant and Discharge to the said Treasurers, Sequestrators, Collectors, and Receivers, for such Monies as hereupon they shall so pay, as aforesaid.

Browne's Claims.

An Ordinance for the allowing Payment of Interest, after the Rate of Eight Pounds per Cent. for the Sum of Four thousand Pounds, formerly made payable unto Major General Richard Browne, out of the Receipts of Goldsmiths Hall, was this Day read; and, upon the Question, passed; and ordered to be sent to the Lords for their Concurrence.

An Ordinance for the further and better regulating of the Sequestrations of Papists and Delinquents Estates was this Day read the First time; and ordered to be read the Second time, on Tuesday next come Sevennight.

Excise.

Ordered, That the Ordinance for continuing the Excise for a longer Time be brought in on Tuesday Morning next, peremptorily.

Message to Lords.

Sir Thomas Dacres carried to the Lords the Two Ordinances for adding the Interest to the Monies payable by former Order to Major General Browne, out of the Excise, and Goldsmiths Hall: The Order for paying unto Colonel Christofer Copley his Arrears: The Order for adding the Word "Ordain" to the former Order, for discharging Sir John Maynard of the Penalty, for not proceeding in the Contract for Bugden.

Message to Lords.

Mr. Love carried to the Lords the Order for a Thanksgiving for a Victory in the North: The Order for Captain Henry Jervoise his Arrears.

Hopton's Arrears.

The humble Petition of Colonel James Hopton was this Day read.

Ordered, That Colonel James Hopton have his Arrears of Five hundred Fifty-eight Pounds and Thirteen Shillings paid and satisfied to him, out of the Sequestration of the Estate of Sir John Hewett, of Worsley in the County of Huntington, Baronet, or elsewhere, where any of his Estate lieth: And the said Colonel James Hopton, or his Assignee or Assignees, are appointed to receive and enjoy the said Sequestration, until the said Sum of Five hundred Fifty-eight Pounds and Thirteen Shillings be paid unto him: And the Committee, Sequestrators, and Treasurers of the Sequestrations, in the County of Huntington, or elsewhere, where any Part of the said Sir John Hewett's Estate lieth, as aforesaid, are required to take Notice of this Order, and to yield ready Obedience thereunto: And his or their Acquittance or Acquittances shall be a sufficient Discharge to the several Persons abovementioned.

Herbert's Claims.

The humble Petition of Colonel William Herbert, was this Day read.

Ordered, That the Sum of Seven hundred Thirty Pounds and Four Shillings, due unto Colonel William Herbert, upon the Publick Faith, for Money laid out of his Purse, and Interest for the same, be paid unto the said Colonel William Herbert, his Executors, Administrators, or Assigns, . . be charged upon the Excise, in Course: And the Acquittance or Acquittances of the said Colonel William Herbert, his Executors, Administrators, or Assigns, to the Commissioners of Excise, or such other Person or Persons as shall pay the same, shall be a sufficient Discharge to such Person or Persons as shall pay the same.

Bishops Lands.

Whereas some Scruple hath been made by the Trustees and Contractors for Bishops Lands, upon the Order made 27 Junii 1648, touching the Discharge of the Penalty of Sir John Maynard Knight, for not proceeding with his Contract for the Manor of Bogden; for that the Word "Ordain" was not in the said Order: It is Ordered, That the Word "Ordain" be added in the said Order.

The Lords Concurrence to be desired herein.

Army Arrears.

The humble Petition of divers Officers and Soldiers, that served in the Northern Parts under the late Lord General the Earl of Essex, and under the Command of Sir Thomas Fairfax, now Lord General, being in Number about Two hundred, was this Day read. And

It is Ordered, That the Petitioners be referred to the Committee of the Northern Association: And that the said Committee do call for the Names of the Petitioners; and to examine, Whether they were not paid, as those that were in the List of the Lord Fairfax; and to consider, What is fit for the House to do in it; and to report it to the House.

Leave of Absence.

Ordered, That Sir Nicholas Martyn have Leave to go into the Country, for Recovery of his Health.

Affairs in Kent.

A Letter from the Committee of Kent, from Rochester, of 4 Julii 1648, was this Day read.

Resolved, &c. That this House doth approve of what the Committee of Kent hath done, in raising a Regiment of Horse, and a Regiment of Foot.

Resolved, &c. That the Estates, real and personal, of all those Persons that have been formerly in Arms against the Parliament, and have been in the late Insurrection in Kent, be forthwith sequestered.

Resolved, &c. That the Estates, real and personal, of all those Persons that have been in former Insurrections in Kent, and in the last Insurrection, be forthwith sequestered.

Resolved, &c. That the Estates, real and personal, of all those Persons that have been Commissioners or Commanders in the late Insurrection in Kent, or have been notoriously active in Plunderings or Imprisonments in the late Insurrection in Kent, be forthwith sequestered.

Resolved, &c. That some Examples be made, by Capital Punishment, of such who, by breaking their former Negative Oaths or Engagements, have risen in the late Insurrection in Kent; regard being herein had to the Observance of Articles: And it is referred to the Committee of Kent, to present the Names of such Persons as they shall judge fit to be made Examples, by Capital Punishment.

Resolved, &c. That the Sequestrations of the real and personal Estates of the Delinquents in the late Insurrection in Kent shall be applied, by Ordinance of Parliament, to the Maintenance of the Forces raised in the County of Kent, for the Defence and Safety thereof.

Resolved, &c. That the Fines of all the Delinquents in Kent, not formerly sequestered, and compounding, shall be applied to the Maintenance of the Forces raised in the County of Kent, and of Dover Castle.

Resolved, &c. That it be referred to the Committee, formerly appointed for the Business of Kent, or any Five of them, to consider of that Clause in the Letter from the Committee of Kent, of 4 Julii 1648, touching the Mitigation and Exemption therein mentioned; and to report their Opinions, and what Course they think sit to be observed therein.

Victory in Nottingham.

A Letter from Colonel Edward Rosseter, from Nottingham, of the 6th of July 1648, giving Notice of the great Victory it has pleased God to bestow upon the Forces under his Command, against the Pontefract Forces under the Command of Sir Phillipp Mouncton, General, on the Fifth of July 1648, in Willoughby Fields, in the County of Nottingham, was this Day read.

Grauts to Rosseter, &c.

Resolved, &c. That the Sum of Two thousand Pounds be forthwith paid and advanced to Colonel Edward Rosseter, upon Account, out of such Sequestrations as are not yet engaged: And that it be referred to Sir Anthony Irby. Mr. Ellis, Mr. Weaver, Sir Edward Aiscough, and Sir John Potts, to consider, Out of what Sequestrations this Sum of Two thousand Pounds shall issue, and to prepare and bring in an Ordinance, in pursuance hereof.

Ordered, That the Sum of One hundred Pounds be bestowed upon Captain Charles Norwood, that brought the good News from Colonel Rosseter; and paid out of Sequestrations not engaged; in like manner as the Two thousand Pounds for Colonel Rosseter: And that it be referred to the same Gentlemen, to consider of the Raising of, and Payment of it.

Thanksgiving.

Ordered, That Thanks be given to Almighty God, To morrow the Ninth of this instant July, in all the Churches and Chapels within the late Lines of Communication, for the great Victory it pleased God to give the Parliament Forces, under the Command of Colonel Edward Rosseter, over the Enemies Forces, in Wiloughby Fields in the County of Nottingham: And that the Lord Mayor be desired to give notice hereof to the several Ministers of those several Places.

Weaver thanked.

Ordered, That the Thanks of this House be given to Mr. Weaver, a Member of this House, for his good Service in the Affairs commanded him by this House.

Mr. Speaker, accordingly, gave him the Thanks.

Victory in Nottingham.

Ordered, That Captain Norwood be desired to put in Writing the Narrative of the Fight and late great Victory, in Willoughby Fields in Nottingham; and to take care for the Printing of it, together with the List of the Prisoners.

Prisoners at Lincolne.

Ordered, That it be referred to the Committee of Lincolne, to examine, by whom, upon what Ground, and Force, the Prisoners were enlarged at Lincolne; and of what Quality and Condition the Prisoners were; and to certify the Truth thereof to the House.

Surgeon, &c. to be sent to Rosseter.

Ordered, by the Commons assembled in Parliament, That the Members of this House, of the Committee of Derby House, do take care, that a Surgeon, a Physician, and an Apothecary, be sent down to Colonel Rosseter; and a Letter of Thanks be prepared, to be sent to Colonel Rosseter, for his valorous and gallant Service; and a Letter to every Committee of the several Counties of Nottingham, Lincolne, Leicester, Darby, Rutland, and Northampton, for their Readiness in assisting the said Service: And that One hundred Pounds be forthwith advanced and paid by the Committee of the Revenue, to satisfy the Pains and Charges of the said Surgeon, Physician, and Apothecary.

Prisoners of War.

A Letter from the Committee at Nottingham was this Day read.

Ordered, That Mr. Browne and Colonel Purefoy be desired to repair to Justice Roll; and to acquaint him, That the House hath received Information, that the Sheriff of the County of Warwicke refuseth to execute several Prisoners, that were condemned at the last Assizes there: And that Mr. Justice Rolles be desired to certify the true State of that Business to the House, on Monday next.

Ordered, That the several Prisoners in all Counties, that have been taken in the several Rebellions and Insurrections, be tried in their several Counties, at the Assizes: And that the Commissioners of the Great Seal be desired to give in Charge to the Judges of Assizes, to take care they be proceeded against accordingly: And the Committee in every several County are to take care for assigning the Parties that shall be so tried; and to prepare Evidence to be given against them, at their several Tryals.

Wounded Soldiers, &c.

Ordered, That it be referred to the Committee of Sequestrations in the County of Nottingham, to take care, that the Cure, Lodging, and Diet of the wounded Soldiers and Prisoners at Nottingham, be paid for, and satisfied, out of the Estates of such Prisoners as were taken at the late Battle at Willoughby Field.

Disposing of Prisoners.

Ordered, That the Committee for Prisoners where Colonel Moore hath the Chair, be revived; and do meet constantly, de die in diem; and take speedy and effectual Course for the Disposing of the common Prisoners, taken in the late Insurrections, into the Plantations beyond the Seas.

Nottingham Militia.

Ordered, That the Propositions for the Committee of the Militia in the County of Nottingham be read on Monday Morning next.

Lincolne Treasury.

Whereas it was informed, That the Treasury at Lincolne was broken open, by the Party that came from Pontefract, and seized upon Lincolne, and took away One thousand One hundred Pounds, out of the said Treasury, of the publick Monies: Be it Ordained, That it be referred to the Committee of Lincolne, to examine the Truth thereof: And what the said Committee, or any Seven of them, shall certify to be so taken away out of the said Treasury, by the said Party, shall be allowed unto the said Treasurer, upon his Accompt; and be discharged thereof: And that the Committee of Accompts, and all others whom it may concern, shall allow thereof.
