Prayers.

Reversing Cornish's Attaiuder.

A BILL to reverse the Attainder of Henry Cornish, Esquire, late Alderman of the City of London, was read the Second time.

Resolved, That the Bill be committed to Sir Tho. Clarges, Lord Falkland, Mr. Bickerstaffe, Mr. Reyne, Mr. Holles, Sir Walter Moyle, Mr. Christy, Major Manly, Sir John Doyly, Mr. Papillion, Mr. Moore, Mr. Freke, Mr. Hobby, Mr. Arnold, Mr. Paul Foley, Mr. Parker, Sir John Trevor, Sir Ralph Dutton, Mr. Newport, Colonel Penruddock, Mr. Fuller, Sir Rob. Cotton, Sir Wm. Poultny, Sir Tho. Littleton, Major Vincent, Mr. Kendall, Mr. White, Mr. Williams, Mr. England, Mr. Tho. Foley, Mr. Smith, Colonel Birch, and all the Members that serve for the City of London and County of Middlesex: And they are to meet this Afternoon, at Four of the Clock, in the Speaker's Chamber.

Privilege-a Person in Custody, petitions for Discharge.

A Petition of Joshua Woodman, Gentleman, was read; setting forth, That he, hearing that, by Order of the House, he was to be taken into Custody of the Serjeant at Arms for Breach of Privilege, in causing the honourable Colonel Sackvile, a Member of this House, to be served with a Subpæna in Chancery, did, in Obedience to the said Order, surrender himself; and, being now in Custody, has tendered his Submission to Colonel Sackville, and is still ready and willing to make such further Submission as the House shall think fit: And that, at the Time of the Service of the Subpæna, he did not know that Colonel Sackville was a Member of Parliament; and, since his Knowledge of the same, there hath not been made any further Prosecution, and praying, that upon such his Submission he may be discharged from his Confinement.

Ordered, That the said Joshua Woodman's Petition do lie upon the Table.

Leave of Absence.

Ordered, That Sir John Key have Leave to go into the Country, for a Month.

Ordered, That Sir John Dorrell have Leave to go into the Country for a Week.

Ordered, That Mr. George have Leave to go into the Country, for Three Weeks.

Privilege.- a Person in custody petitions for discharge.

A Petition of John Walker, Husbandman, was read; setting forth, That he, being under Age, about Michaelmas last by his Guardian, retained one Crouch, an Attorney, to recover the Possession of a Tenement and Lands in March Baulder in Com. Oxon.; who, after that Term, delivered Declarations in Ejectment, for which the Petitioner is in Custody: That the Petitioner was ignorant of the Proceedings, and believes Crouch did not know of Sir John Doyley's being elected for the Convention; and all Proceedings being since stayed; and praying to be dismissed from Attendance.

Ordered, That the said John Walker be discharged out of the Custody of the Serjeant at Arms, paying his Fees.

Newcastle Court of Conscience.

An ingrossed Bill for establishing a Court of Conscience at Newcastle, was read the Third time.

An Amendment was proposed to be made in Pr. 4. Line *, by inserting "Court of;" and, upon the Question put thereupon, was agreed unto by the House; and the Bill amended at the Table accordingly.

Resolved, That the Bill do pass: And that the Title thereof be, An Act for erecting a Court of Conscience at Newcastle upon Tyne.

Ordered, That Mr. Bickerstaffe do carry up the Bill to the Lords for their Concurrence.

Privilege- a Person reprimanded and discharged.

Ordered, That Joshua Woodman be discharged out of Custody of the Serjeant at Arms, paying his Fees.

And he was brought in to the Bar; and, upon his Knees, received the Reprimand of the House from Mr. Speaker.

Orphans of London.

Then the House resolved into a Committee of the whole House, to proceed in the Consideration of the Bill for Relief of the Orphans of the City of London.

Mr. Speaker left the Chair.

Mr. Grey took the Chair of the Committee.

Mr. Speaker resumed the Chair.

Conference with Lords.

A Message from the Lords, by Sir Miles Cooke and Mr. Methuen;

Mr. Speaker, We are commanded by the Lords to acquaint this House, That the Lords do desire a present free Conference in the Painted Chamber, upon the Subject Matter of the last Conference.

And then the Messengers withdrew.

Resolved, That the House doth agree to a present free Conference, as the Lords do desire.

And the Messengers were called in again: And Mr. Speaker acquainted them therewith.

Resolved, That the Members that managed the last Conference, do manage this free Conference.

And the Managers went to the free Conference, accordingly.

Sir Wm. Poultny reports from the free Conference, That the Earl of Rochester did chiefly manage for the Lords; and said, That the Lords had agreed to all the Amendments proposed by this House, but Two; viz.

70 Line, the Amendment insisted on by the Commons, not agreed to.

71 Line, not agreed to leave out the Proviso to the 81 Line.

As to the First, being the Point of Precedency; For that it is (as he insisted) against the Nature of a Commission for any to have Precedency; And, as to the Proviso; For that (as he said) it is not fit One Commissioner should make Decrees, or put the whole Broad Seal to any thing.

And, upon the Question severally put, That the House do agree with the Lords therein;

It was resolved in the Affirmative.

Ordered, That Sir Wm. Poultny do carry up the Bill to the Lords; and acquaint them with the Agreement of this House in the Matters aforesaid.

Privilege.

A Complaint being made by Edward Thompson, Esquire, a Member of this House, That Colonel Copley, Deputy Governor of Hull, sent for the Post-master there by a File of Musqueteers, and tied him Neck and Heels; and that he seized the Post Letters, and particularly a Letter from the said Mr. Thompson, which had his Name upon it, and opened the same;

Ordered, That it be referred to the Committee of Privileges and Elections, to examine the Matter; and report the same to the House.

Privilege.

A Complaint being made to this House, by the Lord Fairfax, a Member of the House, That a Servant of his, who he entertained to go over with him into Holland, was Yesterday arrested by one Robert Child, a Bailiff, at the Suit of Malligant Odley, and is still detained by them; although his Lordship sent a Certificate under his Hand and Seal, that the said Person was his Servant; with one to justify, that it was his Hand and Seal, in order to his Discharge;

Ordered, That the said Malligant Odley and Robert Child be sent for in Custody of the Serjeant at Arms attending this House, for such their Breach of the Privilege.

Blaire's, &c. Impeachment.

Ordered, That the Committee, to whom it was referred to prepare Impeachments against Sir Adam Blaire, Captain Vaughan, Captain Mole, and Dr. Grey, be revived; and do sit this Afternoon, at Five of the Clock: And that they, or Five of them, do prepare the same, and make their Report to the House.

Lieutenant of Dover Castle, &c.

Resolved, That an Application be made to his Majesty, by such of the Members of this House, as are of his Majesty's most honourable Privy Council, that there may be a Lieutenant of Dover Castle settled: And that the Militia of the Cinque Ports may be put into Order.

Orphans of London.

Resolved, That the House do, upon Wednesday next, resolve itself into a Committee of the whole House, to proceed in the further Consideration of the Bill for the Relief of the Orphans of the City of London.

Ordered, That the Chamberlain of the City of London do attend this House on Wednesday next, with his Books for the making the Debts to the Orphans appear.

Abingdon Election.

Ordered, That the Cause upon the Petition of Sir John Stonehouse Baronet, touching the Election of a Burgess to serve in this present Parliament for the Borough of Abingdon in the County of Berks, which was appointed to be heard this Afternoon before the Committee of Privileges, and Elections; be put off until Monday next, in the Afternoon.

And then the House adjourned till To-morrow Morning, Nine a Clock.
