Harvey et al. Leave for a Bill.

After reading, and considering, the Report of Mr. Justice Powys and Mr. Justice Tracy, to whom was referred the Petition of Anne Harvey and her Children; praying Leave to bring in a Bill, for the Purposes in the Petition mentioned:

It is Ordered, by the Lords Spiritual and Temporal in Parliament assembled, That the Petitioners have hereby Leave given them to bring in a Bill, according to the Prayer of the Petition.

Stafford's Petition referred to Judges.

Upon reading the Petition of Anthony Stafford Gentleman, and Elizabeth his Wife; praying Leave to bring in a Bill, to enable the Petitioner to sell or mortgage some Part of his Lands and Hereditaments, in the Counties of Derby and Chester, for the Payment of his Father's and his own Debts; and the better settling and securing the rest of his Estate, for the Benefit of his Wife and Family:

It is Ordered, by the Lords Spiritual and Temporal in Parliament assembled, That the Consideration of the said Petition shall be, and is hereby, referred to the Lord Chief Justice of Her Majesty's Court of Common Pleas and the Lord Chief Baron of Her Majesty's Court of Exchequer; who are forthwith to summon all Parties concerned in the Bill; and, after hearing them, to report to the House the State of the Case, with their Opinion thereupon, under their Hands; and whether all Parties that may be concerned in the Consequences of the Bill have signed the Petition; and also that the Judges, having perused the Bill, do sign the same.

Ld. Slane's Attainder, Bill to reverse:

Hodie 3a vice lecta est Billa, intituled, "An Act to reverse the Outlawry and Attainder of Christopher Lord Baron of Slane, in Ireland."

The Question was put, "Whether this Bill shall pass?"

It was Resolved in the Affirmative.

Message to H. C. with it.

A Message was sent to the House of Commons, by Sir Robert Legard and Mr. Gery:

To carry down the said Bill, and desire their Concurrence thereunto.

Duties upon Malt, &c. Bill.

Hodie 1a vice lecta est Billa, intituled, "An Act for charging and continuing the Duties upon Malt, Mum, Cyder, and Perry, for the Service of the Year One Thousand Seven Hundred and Nine."

Viscountess Falkland and Lady Russel versus Lytton:

After hearing Counsel, upon the Petition and Appeal of Rebecca Viscountess Dowager Falkland, only Daughter of Sir Rowland Lytton Knight by Rebecca his Second Wife, from a Decree made in the Court of Chancery, the Sixteenth Day of June last, on the Behalf of Lytton Lytton Esquire, an Infant; praying to be relieved against the said Decree; and that the said Lytton Lytton and Dame Anne Russel may answer the said Appeal: As also upon the Answers of Dame Anne Russel and Lytton Lytton Esquire put in thereunto; and due Consideration of what was offered thereupon:

Judgement affirmed.

It is this Day Ordered and Adjudged, by the Lords Spiritual and Temporal in Parliament assembled, That the said Petition and Appeal of Rebecca Viscountess Dowager Falkland shall be, and is hereby, dismissed this House; and that the said Decree complained of in the said Appeal shall be, and is hereby, affirmed.

Lady Russell versus Lytton.

After hearing Counsel, upon the Petition and Appeal of Dame Anne Russell, One of the Coheirs, and only surviving Daughter, of Sir Rowland Lytton Knight, deceased, by Mary his First Wife, and Sister and Coheir of the whole Blood of Sir William Lytton Knight, also deceased, from a Decree made in the Court of Chancery the Sixteenth Day of June last, on the Behalf of Lytton Lytton Esquire; and praying to be relieved against the said Decree; and that the said Lytton Lytton and the Right Honourable Rebecca Viscountess Dowager Falkland may answer to the said Appeal: As also upon the Answers of the said Rebecca Viscountess Dowager Falkland and Lytton Lytton Esquire put in thereunto; and due Consideration of what was offered thereupon:

Judgement affirmed.

It is this Day Ordered and Adjudged, by the Lords Spiritual and Temporal in Parliament assembled, That the said Petition and Appeal of Dame Anne Russell shall be, and is hereby, dismissed this House; and that the said Decree complained of in the said Appeal shall be, and is hereby, affirmed.
