Savery's Petition referred to Judges.

Upon reading the Petition of William Ilbert Esquire and William Downman Merchant, for and on the Behalf of Waltham Savery and Robert Savery, Infants, Sons of William Savery Esquire, deceased; praying Leave to bring in a Bill, to enable Trustees, during the Minority of Waltham Savery Esquire the Infant, and during the Minority of such Person or Persons who shall be his Heir or Heirs at Law, to let Leases for Ninety-nine Years, determinable upon One, Two, or Three Lives, of such Parts of his Lands as have been usually leased, to raise Money, to discharge the Incumbrances thereon; and for securing the Payment of his Younger Brother's Portion:

It is Ordered, by the Lords Spiritual and Temporal in Parliament assembled, That the Consideration of the said Petition shall be, and is hereby, referred to Mr. Baron Price and Mr. Justice Eyre; who are forthwith to summon all Parties concerned in the Bill; and, after hearing them, to report to the House the State of the Case, with their Opinion thereupon, under their Hands, and whether all Parties that may be concerned in the Consequences of the Bill have signed the Petition; and also that the Judges, having perused the Bill, do sign the same.

Lyde versus Rodd, in Error:

After hearing Counsel, to argue the Errors assigned upon the Writ of Error brought into this House the Twenty-fourth Day of March One Thousand Seven Hundred and Nine, wherein John Lyde is Plaintiff, and Thomas Rodd an Attorney of the Court of Queen's Bench Defendant, to reverse a Judgement given in the Court of Queen's Bench, against the Plaintiff, in a Special Action upon the Case; and due Consideration of what was offered thereupon:

Judgement revalued.

Emendat. per Ord. 27 Aprilis 1711.

It is Ordered and Adjudged, by the Lords Spiritual and Temporal in Parliament assembled, That the said Judgement given in the Court of Queen's Bench for the said Thomas Rodd shall be, and is hereby, reversed; and that Judgement is hereby given for the Plaintiff John Lyde; and that the Court of Queen's Bench do tax the said John Lyde his Costs, as if the said Court had given Judgement for him.

The Tenor of which Judgement, to be affixed to the Transcript of the Record to be remitted, follows:

Joh'es Lyde, per Attornatum suum præd. quam præd. Thomas Rodd in propria Persona sua; super quo, visis per Cur. Parliamenti præd. plenius intellectis omnibus et singulis Præmissis, diligenterque examinat. et (fn. 1) Inspectionis tam Record. et Process. præd. ac Judic. super eisdem reddit. quam præd. Causis et Materiis per præd. Joh'em Lyde superius pro Error. assignat. et allegat. videtur Cur. Parliamenti præd. quod in Record. et Process. præd. ac etiam in Redditione Judicii prædicti manifest. est Errat. Ideo considerat. est per eandem Cur. Parliamenti præd. quod Judic. præd. per præd. Cur. Dominæ Reginæ, coram ipsa Regina, in Forma præd. reddit. ob Error. præd. et al. in Record. et Process. præd. existen. revocetur, adnulletur, et penitus pro nullo habeatur; et quod præd. Joh'es Lyde ad omnia quæ ipse Occasione Judic. præd. amisit restituatur, &c. Et ulterius per eandem Cur. Parliamenti præd. considerat. est, quod præd. Joh'es Lyde recuperet versus præfat. Thomam Rodd Dampna præd. per Jur. præd. in Form. præd. assess. necnon Trigint. Libras pro Misis et Custagiis suis, per ipsum circa Sectam suam in hac Parte apposit Et præd. Thomas Rodd in M'ia, &c. Et superinde Record. et Process. præd. Cur. Parliamenti præd. per eandem Cur. Parliamenti Cur. Dominæ Reginæ, coram ipsa Regina, ubicunque &c. remittuntur, &c.
