More's Pet. referred to Judges.

Upon reading the Petition of John More Esquire and Margaret his Wife, which said Margaret is sole Daughter and Heir of Peter Fermor Esquire, deceased, by Mary Fermor his late Wife, deceased; praying Leave to bring in a Bill, for Sale of their Estate in Gloucestershire, for discharging a Mortgage thereon; and the Overplus of the Money to be laid out in a Purchase of Lands lying more convenient to the said John More's Paternal Estate, to be settled to the same Uses as the Freehold and Inheritance of the said Gloucestershire Estate is now settled:

It is Ordered, by the Lords Spiritual and Temporal in Parliament assembled, That the Consideration of the said Petition shall be, and is hereby, referred to Mr. Baron Lovell and Mr. Justice Eyre; who are forthwith to summon all Parties concerned in the Bill; and, after hearing them, to report to the House the State of the Case, with their Opinion thereupon, under their Hands, and whether all Parties that may be concerned in the Consequences of the Bill have signed the Petition; and also that the Judges, having perused the Bill, do sign the same.

Messages from H. C. with Bills.

A Message was brought from the House of Commons, by Mr. Finch and others:

With a Bill, intituled, "An Act to repeal the Act of the Seventh Year of Her Majesty's Reign, intituled, An Act for naturalizing Foreign Protestants, except what relates to the Children of Her Majesty's naturalborn Subjects born out of Her Majesty's Allegiance;" to which they desire the Concurrence of this House.

Also, a Message was brought from the House of Commons, by Mr. Ferrier and others:

With a Bill, intituled, "An Act to make a Causeway over The Denes, from Great Yarmouth to Caister, in the County of Norfolk;" to which they desire the Concurrence of this House.

Queen's Message concerning the Scots Peers, &c. considered.

The House was (according to Order) adjourned during Pleasure, and put into a Committee, to take into further Consideration that Part of Her Majesty's most Gracious Message to this House on the Seventeenth Instant, which relates to the Peers of the North Part of Great Britain.

And, after some Time spent therein, the House was resumed.

And the Earl Ferrers reported, "That the Committee of the whole House had further considered the Matter to them referred; and were come to a Resolution, which he was ready to report, when the House should please to receive the same."

Ordered, That the Report be now received.

Then his Lordship reported from the said Committee, the Resolution which they had directed him to report to the House, as follows; (videlicet,)

Sitting of the Scots Peers by Election, alterable by Parliament.

"That the Sitting of the Peers of Great Britain, who were Peers of Scotland before the Union, in this House, by Election, is alterable by Parliament, at the Request of the Peers of Great Britain who were Peers of Scotland before the Union, without any Violation of the Union."

Which Resolution, being read, was agreed to by the House.

And his Lordship also acquainted the House, That he was directed, by the Committee, to move, That they may have Leave to fit again."

Ordered, That on Tuesday next, at Twelve a Clock, this House shall be put into a Committee, to take into further Consideration that Part of Her Majesty's said Message which relates to the Peers of the North Part of Great Britain.

Sir E. Seymour versus Lady Seymour et al. et è contra.

The House being moved, "That a Day may be appointed, for hearing of the Appeal depending in this House, wherein Sir Edward Seymour Baronet is Appellant, and the Lady Letitia Seymour and others are Respondents;" as also the Cross Appeal, wherein the said Lady Letitia Seymour and others are Appellants, and the said Sir Edw d Seymour is Respondent:

It is Ordered, by the Lords Spiritual and Temporal in Parliament assembled, That this House will hear the said Causes, by Counsel, at the Bar, on Saturday the Second Day of February next, at Eleven a Clock.

Adjourn.
