Constable's Petition referred to Judges.

Upon reading the Petition of John Constable, of Ockley, in the County of Surrey, Gentleman, and Sarah his Wife; praying Leave to bring in a Bill, for Sale of the Moiety, or full Half Part, of several Messuages, Lands, and Tenements, lying in the said Parish of Ockley; and settling several Messuages, Lands, and Tenements, lying in Wootton, in the said County, of greater Value, to the same Uses the said Estate in Ockley is now settled:

It is Ordered, by the Lords Spiritual and Temporal in Parliament assembled, That the Consideration of the said Petition shall be, and is hereby, referred to the Lord Chief Justice of the Court of Queen's Bench and Mr. Justice Tracy; who are forthwith to summon all Parties concerned in the Bill; and, after hearing them, to report to the House the State of the Case, with their Opinion thereupon, under their Hands, and whether all Parties that may be concerned in the Consequences of the Bill have signed the Petition; and also that the Judges, having perused the Bill, do sign the same.

Jolly to enter into a Recognizance for Robertson.

Upon reading the Petition of Alexander Robertson, of Strowan, Esquire; praying, "That Mr. Alexander Jolly may be allowed to enter into a Recognizance for the Petitioner, in relation to his Appeal depending in this House; his Residence being in Scotland, and his Affairs necessarily requiring his Continuance there:"

It is Ordered, by the Lords Spiritual and Temporal in Parliament assembled, That the said Alex'r Jolly may enter into a Recognizance for the Petitioner, as desired.

Ld. Ormestoun versus Hamilton.

Upon reading the Petition of Adam Cokburne Lord Ormestoun and Dame Anne his Wife; shewing, "That John Hamilton Esquire, Respondent to the Petitioners Appeal depending in this House, hath obtained an Order for hearing the same on Monday next; that the Petitioners Counsel are gone the Circuit, and the Proceedings in the Cause very long, and consist of several difficult Points; and praying, that, for instructing other Counsel in the said Cause, a further Day may be appointed for hearing thereof:"

It is Ordered, by the Lords Spiritual and Temporal in Parliament assembled, That this House will hear the said Cause, by Counsel, at the Bar, on Friday the Twenty-eighth Day of this Instant March, at Eleven a Clock; whereof the Petitioner is forthwith to cause Notice to be given to the said John Hamilton.

Egerton's Bill.

Hodie 3^a vice lecta est Billa, intituled, "An Act for Sale of the Manors of Agardesley, alias Agersley, and Marchington, and several Lands and Hereditaments, in the County of Stafford, for Payment of the Mortgage Monies charged thereon, and other the Debts of the Honourable Charles Egerton Esquire."

The Question was put, "Whether this Bill shall pass?"

It was Resolved in the Affirmative.

Content Galley, a free Ship, Bill.

Hodie 2^a vice lecta est Billa, intituled, "An Act to make free The Content Galley, a Running Ship, taken from the French, and condemned as Prize."

Ordered, That the said Bill be committed to a Committee of the whole House, on Monday next, at Twelve a Clock.

Sheriffs Accompts, Bill.

The House (according to Order) was adjourned during Pleasure, and put into a Committee upon the Bill, intituled, "An Act for the more easy passing Sheriffs Accompts."

And, after some Time spent therein, the House was resumed.

And the Earl of Clarendon reported from the said Committee, "That they had made some further Progress in the Bill; and had directed him to move for Leave to sit again."

Ordered, That this House be put into a Committee again, upon the said Bill, on Monday next, at One a Clock.

Message from H. C. to return the E. of Anglesey's Bill, with Amendments:

A Message was brought from the House of Commons, by Sir Henry Bunbury and others:

To return the Bill, intituled, "An Act for making the Exemplification of the Settlement made upon the Marriage of James Lord Annesley with the Lady Elizabeth Manners, under the Great Seal of Great Britain, Evidence on Hearings in Equity and Trials at Law;" and to acquaint this House, that they have agreed to the same, with some Amendments, whereunto they desire their Lordships Concurrence.

Then the said Amendments were read Thrice, and agreed to.

Message to them, that the Lords agree to them.

And a Message was sent to the House of Commons, by Sir Robert Legard and Mr. Hiccocks, to acquaint them therewith.

Sir Patrick Home versus Sir Robert Home.

The House being moved, "That a Day may be appointed, for hearing the Appeal depending in this House, wherein Sir Patrick Home Baronet is Appellant, and Sir Robert Home Baronet Respondent:"

It is Ordered, by the Lords Spiritual and Temporal in Parliament assembled, That this House will hear the said Cause, by Counsel, at the Bar, on Thursday the Third Day of April next, at Eleven a Clock.
