Forbes versus Forbes.

After hearing Counsel, upon the Petition of Appeal of William Forbes, of Tolquhon, Esquire, from an Interlocutory Sentence, or Decree, of the Lords of Council and Session in Scotland, pronounced the 2d Day of January 1710/11, and the Affirmance thereof, on the Behalf of Alexand'r Forbes, of Ballogie, Esquire; praying to be relieved against the same: As also upon the Answer of the said Alexand'r Forbes put in to the said Appeal; and due Consideration of what was offered thereupon:

Judgement affirmed.

It is Ordered and Adjudged, by the Lords Spiritual and Temporal in Parliament assembled, That the said Petition of Appeal shall be, and is hereby, dismissed this House; and that the Sentence or Decree, and the Affirmance thereof, complained of in the said Appeal, shall be, and are hereby, affirmed.

Hodie 3^a vice lecta est Billa, intituled, "An Act for selling certain Lands, Part of the Manor of Wightfield, alias Whitefield, and other Lands in the County of Gloucester, for the Payment of the Debts heretofore of Mary Fermor Widow, and of John More Junior, of Kirtlington, in the County of Nottingham, Esquire, and Margaret his Wife."

The Question was put, "Whether this Bill shall pass?"

It was Resolved in the Affirmative.

A Message was sent to the House of Commons, by Mr. Meller and Mr. Orlebar:

To carry down the said Bill, and desire their Concurrence thereunto.

Sir Robert Guldeford's Bill.

Whereas, by Order of this House of the First Instant, the Bill, intituled, "An Act for Sale of the Manor of Hempsted, and other Lands therein mentioned, lying in the Counties of Kent and Sussex, the Estate of Sir Robert Guldeford Baronet, for the Payment of Debts, and for settling the Camber Farm, and other Lands, in the said County of Sussex, to the same Uses as the said Manor of Hempsted now stands settled," with the Amendments thereunto, were to lie on the Table for Ten Days:

The House being this Day moved, "That the said Bill, with the Amendments, be engrossed:"

The same was ordered accordingly.

Act for discharging the Yule Vacance, to repeal, Bill.

The House was adjourned during Pleasure, and put into a Committee upon the Bill, intituled, "An Act for repealing an Act passed in the Parliament of Scotland, intituled, Act for discharging the Yule Vacance."

And, after some Time spent therein, the House was resumed.

And the Lord Balmerino reported, from the said Committee, "That they had gone through the said Bill, and made some Amendments."

Which were read Twice, and agreed to.

Success, a free Ship, Bill:

The House was also adjourned during Pleasure, and put into a Committee upon the Bill, intituled, "An Act for making the Ship Success a free Ship."

And, after some Time spent therein, the House was resumed.

And the Lord Delawar reported from the said Committee, "That they had gone through the Bill; and think it fit to pass, without any Amendment."

Hodie 2^a vice lecta est Billa, intituled, "An Act for making the River Avon, in the Counties of Somerset and Gloucester navigable, from the City of Bath, to or near Hanham Mills."

Ordered, That the said Bill be committed to a Committee of the whole House, on Monday next.

Insolvent Debtors, Bill.

The House (according to Order) was adjourned during Pleasure, and put into a Committee upon the Bill, intituled, "An Act for the Relief of Insolvent Debtors, by obliging their Creditors to accept the utmost Satisfaction they are capable to make, and restoring them to their Liberty."

And, after some Time, the House was resumed.

And the Earl of Winchilsea reported from the Committee, "That they had made some Progress in the said Bill; and desired Leave to sit again."

Ordered, That on Monday next this House shall be put into a Committee again, to proceed further in the said Bill.

Patrick's Bill; Trust accepted.

Whereas, by a Standing Order of this House, all Trustees appointed by Private Bills are to accept the Trusts under their Hands, before the Committees to whom such Bills are referred:

The House being this Day informed, "That Peter Chester Clerk having agreed to accept the Trust intended to be reposed in him by the Bill depending in this House, for Sale of the Estate late of Symon Patrick Clerk, deceased; and his necessary Occasions obliging him to go out of Town:"

He was called in; and, at the Bar, declared his Consent to accept the said Trust; and subscribed his Name in the Minute Book.

A Message was brought from the House of Commons, by Mr. Lee and others:

With a Bill, intituled, "An Act for compleating a Chapel of Ease in the Town of Deal, in the County of Kent, by a Duty on Water-borne Coals to be brought into the said Town."
