Booth versus E. of Warrington.

Upon reading the Petition of George Booth Esquire; praying, "That the Hearing of his Appeal depending in this House, to which the Earl of Warrington is Respondent, may be adjourned for some Time; it not being possible for him to procure his Case to be prepared, and settled by his Counsel, and printed, against the Day already appointed:"

It is therefore (with the Consent of the said Earl) Ordered, by the Lords Spiritual and Temporal in Parliament assembled, That this House will hear the said Cause, by Counsel, at the Bar, on Wednesday the Twenty-eighth Day of this Instant April, at Eleven a Clock.

Jacobsen versus Hannekenius & al;

After hearing Counsel, upon the Petition and Appeal of Jacob Jacobsen, Executor of the last Will and Testament of Theodore Jacobsen, late of London, Merchant, deceased, brought into this House the last Session of Parliament, from a Decree made in the Court of Chancery the 23d of May 1712, and a subsequent Order of the same Court of the 19th of June last, which was passed and settled the 27th of the same Month, on the Behalf of Balthazar Meno Hannekenius and Tetha Katherine his Wife, Theodore Balthezar Jacobsen, and Balthazar Mentzer; praying, "That the said Decree and Order may be reversed and set aside:" As also upon the Answer of Balthazar Meno Hannekenius and the other Respondents put in thereunto; and due Consideration of what was offered thereupon:

Chancery to re-hear the Cause.

It is Ordered and Adjudged, by the Lords Spiritual and Temporal in Parliament assembled, That the Order of the Court of Chancery, of the 19th of June 1713, complained of in the said Appeal, whereby the Demurrer was allowed, and the Bill ordered to be dismissed, be reversed: And it is further Ordered, That the Court of Chancery do proceed to re-hear the said Cause, when the same shall be ready for re-hearing.

Herbert versus Finch & al.

Whereas Thursday next was appointed, for hearing the Cause wherein Philip Herbert Esquire and his Wife are Appellants, and John Finch Esquire and others are Respondents:

It is Ordered, That this House will hear the said Cause on Friday next, at Eleven a Clock.

Prendregast's Pet. referred to Judges.

Upon reading the Petition of Sir Thomas Prendergast Baronet, a Minor under the Age of Twelve Years, by his Guardian; praying Leave to bring in a Bill, to enable the Petitioner to sell several Lands, Tenements, and Hereditaments (Part of his Estate), lying in the County of Waterford, in the Kingdom of Ireland, for Payment of Debts, and making Provision for his Sister, according to the Will of Sir Thomas Prendergast, deceased; the Petitioner having, in due Form, published Notice of his Design to apply to this Honourable House, pursuant to a Resolution of the Commons, of the 6th of February 1707, in that Behalf:

It is Ordered, by the Lords Spiritual and Temporal in Parliament assembled, That the Consideration of the said Petition shall be, and is hereby, referred to Mr. Justice Dormer and Mr. Justice Eyre; who are forthwith to summon all Parties concerned in the Bill; and, after hearing them, to report to the House the State of the Case, with their Opinion thereupon, under their Hands, and whether all Parties that may be concerned in the Consequences of the Bill have signed the Petition; and also that the Judges, having perused the Bill, do sign the same.

Lockhart versus Chiefly & al.

Upon reading the Petition of George Lockhart Esquire; praying, "That the Hearing of his Appeal depending in this House, which was appointed to be on Friday next, may be put off for some Time longer; there being Papers which will be necessary in the Cause, and cannot be produced by that Time;" and the Respondents consenting:

It is Ordered, by the Lords Spiritual and Temporal in Parliament assembled, That this House will hear the said Cause on Tuesday the Fourth Day of May next, at Eleven a Clock.

Loggin, Leave for a Bill of Divorce.

Upon reading the Petition of Francis Loggin, and also of Thomas Loggin, of Butler's Marston, in the County of Warwick, Gentleman, and Jane his Wife, on Behalf of the said Francis Loggin, their Son and Heir Apparent; praying Leave to bring in a Bill, for dissolving the Marriage of the said Francis Loggin with Sarah Gardner; and that he may be at Liberty to marry again:

It is Ordered, by the Lords Spiritual and Temporal in Parliament assembled, That Leave be given to bring in a Bill, according to the Prayer of the said Petition.

Business put off.

Ordered, That the Business appointed for To-morrow be put off to Saturday next.
