Mr. Justice Roll reported, "That himself and Two
others of the Judges have met, and heard the Business referred to them from this House, between Solomon Smyth and Edward Davies, to know what Course
may be taken for the Relief of the said Soloman Smyth:
And the Opinion of the Judges are, That, as this
Case is, there is no Relief for him, neither in Law
nor Equity; but that the proper Way will be, to proceed upon the Writ of Error depending in this
House."
Ordinance to settle Church Government.
The Ordinance for settling Church Government, was
read the Second Time; and ordered to be committed to
the Committee of the whole House, and to be taken
into Consideration To-morrow Morning.
Short Catechism.
Next, the Shorter Catechism was read the Third
Time, and Agreed to; and ordered to be printed and

Message from the H. C. with an Ordinance; for a Conference about the Treaty; and for a Thanksgiving for the Victory over the Scots.
A Message was brought from the House of Commons,
by Mr. Swinfen, &c.
To desire Concurrence in an additional Ordinance for
giving further Power of Martial Law to the Lord Admiral. (Here enter it.)

2. To desire a Free Conference, concerning the Matter of the late Conference, concerning Treaty of Peace
with the King.
Ordered, to give a Conference To-morrow Morning, at Ten a Clock, in the Painted Chamber.
3. To desire Concurrence for a Day of Thanksgiving
for the Victory against the Scotts; which is contained in
a Letter of Lieutenant General Crumwell's.
The said Letter was read, and ordered to be printed.
The Order for the Day of Thanksgiving was read,
and Agreed to, and ordered to be printed and published.
Preachers at the Thanksgiving.
Ordered, That Mr. Marshall and Mr. Obadiah
Sedgwicke are appointed to preach before the Lords, in
the Abbey Church, at this Day of Thanksgiving.

That this House appoints To-morrow Morning, at
Ten a Clock, in the Painted Chamber, for a Free Conference, as is desired: To all the rest, their Lordships
do agree.
Message to them, for a Conference about the King's Children.
A Message was sent to the House of Commons, by
Doctor Heath and Mr. Eltonheade:
To desire that, at the Conference To-morrow, their
Lordships may communicate something unto them concerning the King's Children with the Earl of Northumb.
Additional Ordinance for Martial Law at Sea.
"The Lords and Commons assembled in Parliament,
taking Notice of the Defect in the Ordinance of the
21th of August Instant, for the Execution of Martial
Law, by the Lord Admiral; for the Supply of the
said Defect in that Ordinance, do order and ordain,
and it is hereby Ordered, and Ordained, That the
Lord Admiral, with his Council of War commissionated by his Commission under his Hand and Seal, be,
and are hereby, authorized to agree upon such Laws
and Ordinances as are mentioned in the said Ordinance of the 21th of this Instant, for Trial of Offenders by Martial Law; and the same to put in Execution accordingly."
Order for a Thanksgiving for the Victory against the Scots.
"Ordered, by the Lords and Commons in Parliament assembled, That Thursday come Fortnight, the
Seventh of September next, be appointed a Day of
solemn Thanksgiving, through the whole Kingdom,
unto Almighty God, for His wonderful great
Mercy and Success bestowed upon the Parliament
Forces under the Command of Lieutenant General
Cromwell, against the whole Scotts Army, under the
Conduct and Command of Duke Hamilton, on the
17th, 18th, and 19th of this present August, in Lancasheir."
