Capt. Treise's Petition, for his Trial to be brought on.

Upon reading the Petition of Captain John Treise; shewing, "That he, having Command of a Company of Foot, in the Garrison of Plymouth, was about Five Weeks since convented before a Council of War there, from whence he appealed to be tried (for the Matters objected against him) by the High (fn. 1) Court of Parliament, and gave Bond for his Appearance here; and the Petitioner, having attended here a Week, doth not hear of any Charge brought against him, but believeth that the Prosecutors do endeavour to delay the Petitioner's Trial, to his Damage; therefore the Petitioner desireth that the Charge against him, together with the Proceedings thereupon, be brought in by a certain Day, that so he may receive Sentence according to Justice, or be dismissed from any further Attendance here, to return to his Command, being at present as his Livelihood."

Hereupon it is Ordered, That, forthwith upon the serving of this Order upon the Prosecutors, they bring in to this House the Charge and the Proceedings thereupon.

Ordered, That the Order of Dominiq Petit shall be enlarged till the 29th of Sept. 1645.

Instructions for the Commissioners going to Scotland.

The House was adjourned into a Committee during Pleasure, to debate and consider of the Alterations in the Instructions to be given to the Commissioners that are to be sent to the Parliament of Scotland.

And the House being resumed;

The said Instructions were agreed to, with some Alterations, which are to be communicated to the House of Commons, for their Concurrence therein.

Countessof Peterborough's Assessment.

Upon reading the Petition of the Countess of Peterborough; complaining, "That she, being a Peeress, is assessed at One Thousand Pounds, at Haberdashers Hall, for her Fifth and Twentieth Part, contrary to the Words and Intent of the Ordinance; therefore desires that Consideration may be had of her Condition; and, if Contribution be expected, that then she may be directed only by this House, and so much of her Debenture accepted by Way of Abatement, as this House shall think fit:"

It is Ordered, That this Petition shall be taken into Consideration on Monday next; and the Ordinance to be perused by which she (fn. 2) is assessed.

Major Woodroffe, of the Train'd Bands, refused Privilege.

This Day (fn. 3) Abraham Woodroffe, Major of Colonel Zacharie's Regiment, belonging to the Hamlets, was brought to the Bar, by Habeas Corpus, being arrested for divers Debts; but, because he was, by his own Confession, but of the Trained Bands, this House declared it not fit to give Protection to any of the Trained Bands, but only to those that are in actual Service of the Parliament.

Hereupon it is Ordered, That the said (fn. 3) Sam. Woodroofe shall be remanded to the King's Bench.
