Lady Brooke's Petition, for her Son's Park and Estate near Warwick to be freed from Assessments, in Consideration of L. Digby's seizing his Rents, under Pretence of having the Wardship of him.
Upon reading the Petition of the Lady Katherine
Brooke, Guardian to Francis Lord Brooke, and her Son;
shewing,
"That the Lord Digby, by colour of having a
Grant of the Wardship of her Son, hath entered upon
hers and her Son's Estates, in the Counties of Oxford, Bucks, Som'sett, Glouc. Stafford, Worcester, and
Warwicke, to the Yearly Value of Three Thousand
Pounds, from which he drives away the Cattle, and
imprisons the Persons of the Tenants; in regard
whereof, the Petitioner hath little other Means of
Livelihood than from the Town of Warwicke and
Parts next thereto adjacent, a great Part whereof
is a Park replenished with Deer, which Time out of
Mind hath not been charged with any Assessments;
therefore humbly prayeth, that her Son's Estate in
the said Park and Town, and Parts next thereunto
adjacent, may be still exempted from Assessments as
formerly; and the rather, for that the Townsmen,
who have hitherto paid the Town Assessments, have
had Protection from the Castle Garrison, who hath
been a great Charge to the Petitioners."
It is Ordered, That this Petition be recommended
to the House of Commons; and their Concurrence desired, for the granting of the Petition.
Assessments on the Countess of Devon's Estate in Leicestershire moderated, on Account of the late Devastations on it.
Ordered, That in regard the Estate of the Countess of Devonshire in Leycestershire is of late much wasted by the Enemy, in the eating and laying open of her
Grounds, in the taking away the Stocks of her Tenants
that were upon them, and in plundering and burning
of her Dwelling-house at Leycester Abbey, and the Buildings about it, and in that her Sufferings have been of
late much increased by the Soldiers of the present
Garrison, in taking the Profits of them for their Horses,
that the Committee for that County shall review the
Taxes formerly imposed upon her, or now due; and
that they do moderate the same to such a Proportion as
the present Revenue shall deserve.
Ordinance to free the Lands of Sutton's Hospital.
The Ordinance for freeing the Lands belonging to
Sutton's Hospitall for Taxes and Assessments, was read
Thrice, and Agreed to; and Ordered to be sent to
the House of Commons, for their Concurrence.
Message to the H. C. with it; and about the following Particulars.
A Message was sent to the House of Commons, by
Mr. Serjeant Whitfield and Doctor Heath:
1. To desire their Concurrence in the Ordinance concerning Sutton's Hospitall.
2. To desire Expedition in the Ordinance concerning adding of the Lords, to have Power to be of the
Committee for managing the carrying on of the War
of the Northern Association.
3. To recommend to them the Petition of the Dutch
Officers, late under the Command of the Earl of Essex.
4. To desire their Concurrence in the Ordinance concerning the Parish of Bennitt Fincks, in London.
5. To recommend to them the Lady Brooke's Petition.
6. To recommend the Petition of Tho. Church to them.
Ordered, That Sir Nathaniell Brent shall give Institution to John Hill, to the Rectory of Elworth, in the
County of Som'sett.

"The Condition of the abovesaid Recognizance is,
That if the abovesaid Doctor Brownrigg shall appear
before the Lords in Parliament within Twenty Days
after Notice given unto him for the making of such
his Appearance, then the said Recognizance to be
void; or else to remain in (fn. *) full Force and Virtue."
Leave to go to Cambridge, to settle his Accompts.
Ordered, That Doctor Brownrigg hath Leave to go
to Cambridge, and remain there for Twenty Days, to
give up his Accompts of his being Vice Chancellor.
Libel, called The Soldiers Catechism, to be burnt by the Hangman.
Next, Royston was brought to the Bar; and
confessed, "That he received the Book called The Souldiers Catechisme, being a base and scandalous Book
against the Parliament and their Proceedings, and
against the Kingdom of Scotland, from Oxford."
Hereupon this House Ordered, That the said Book
is condemned, as a Book of Malice and Scandal; that
the Master and Wardens shall make a Search, and seize
upon the said Books wheresoever they shall find them,
and bring (fn. *) them to the Lord Mayor and Sheriffs of
London, who are to see them burned by the Hand of
the common Hangman; and to make Proclamation,
that whosoever hath any (fn. *) of these Books in their
Custody shall bring them in to the Lord Mayor and
Sheriffs, under the Penalty of the Censure of this
House.
Royston committed to The Fleet, for publishing it.
And it is further Ordered, That the said Royston, for this his Offence, shall stand committed to the
Prison of The Fleete, there to remain during the Pleasure
of this House; and Eleanor Passinger and John Thomas
shall appear before this House To-morrow Morning, to
be further examined concerning this Business.
