next, why the Certificate of Sir John Nulls and others
should not be confirmed by this House.
Serjeant Finch, Leave to be absent.
Ordered, That Mr. Serjeant Fynch hath Leave to
go to his House at Havering, in Essex; and his Attendance on this House is excused for a while, in regard
of his ill Health.
Dr. Wetherby, a Pass.
Ordered, That Doctor Wetherby shall have a Pass,
to go to Farringdon, to a Gentleman sick there, and return back again to London.

Tuesday return with this Answer:
Answer from the H. C. about Justice Berkley's Trial.
That they will send an Answer presently, by Messengers of (fn. *) their own, touching the Trial of Mr.
Message from thence, to defer it.
A Message was brought from the House of Commons,
by Mr. Maynard:
To let their Lordships know, that they having received a Message this Morning touching the Trial of
Mr. Justice Berkeley, and, in regard of some great Business now in Agitation, they shall not be ready this
Morning to proceed therein; but, at any other Time
as their Lordships shall appoint, they will be ready.
Justice Berkley's Trial deferred.
Ordered, That the Trial of Mr. Justice Berkley
shall be on Saturday Morning next.
And a Message was sent to the House of Commons,
by Mr. Page and Doctor Aylett, to give them Notice
Sir William Withypoole and Sir Walter Devereux.
Upon reading the Petition of Sir Wm. Withipoole: It is
Ordered, That Sir Walter Devereux shall have a Copy
of this Petition, and return an Answer to this House
within a convenient Time after Notice.
Letter from Lord North, that he will attend as soon as his Health will permit.
Upon reading a Letter of the Lord North's, directed
to the Speaker, shewing, "He having received a Letter from his Lordship, as Speaker, to attend this
House; in regard of his ill Health, he desires the
House to excuse his Absence; promising to attend
this House so soon as his Health will give him Leave."
