Union with Scotland.

Mr. Hyde remembereth, that the Lords, at the Conference Yesterday, had adjourned, and put off the Answer and Argument, expected from the Judges, until this Day ; and moveth, to know the Pleasure of the House, if they think fit to send to their Lordships.

The House hereupon sent Mr. Secretary Herbert, to let their Lordships know, they would be ready to attend in the Afternoon, at the usual Time and Place. Who returned Answer, that the Lords would also be ready, but desired, that the Committees of this House might have Liberty to continue and adjourn their Meeting, without restraining them, upon every Meeting, to know the Pleasure of the House.

Privilege in Suits at Law.

Upon former Motion, for Privilege to be granted to sundry Members, for Stay of Trial in their several Causes to be tried at the Assises, as also in other Cases of Privilege, Mr. Speaker did write several Letters ; One in Behalf of Sir John Bennett, as followeth :

My very good Lords,

IT hath been informed in the Commons House of Parliament, that one John Denham hath taken down Two several Writs of Nisi prius, for Trials to be had at York Assises, now to be holden, in an Action of Trans' and of Ejectment, between him, the said Denham, as Plaintiff, and one John Theaker, Assignee, and John Harrison, Servant to Sir John Bennett Knight, One of the Members of the House (whom the Cause, in Point of Interest, principallyconcerneth) Defendants: And because it is conceived, that it may be a Mean to withdraw him, the said Sir John

Bennet, from his Service here, or otherwise endanger the Success of the Cause ; therefore the House hath thought fit, that he should have Privilege, for Stay of the Trial, as in other the like Cases hath been usual; and have commanded me to make known their Order and Resolution unto you ; praying you will be pleased to stay the Proceeding accordingly, until the said Sir John may be freed of this Service, and be at Liberty to follow and attend his own Cause. And so I heartily commend your Lordships to the Protection of the Almighty. From Boswell-house, this 26th Day of February, 1606.

" To my very good Lords, the Justices of Assise for the County of York."

A Letter from Mr. Speaker, to the same Effect, for the Stay of Two several Trials ; One, between the Lady Portington, the Widow, and Sir Richard Gargrave, Knight; another, between one Mrs. Gale, and the said Sir Richard; of the same Tenor and Date, and directed to the same Justices of Assise.

Another Letter, in behalf of Sir William Kingswell, Knight, directed to the Sheriff of Hampshire, in Case of Seizure of Goods, in this Form:

AFTER my very hearty Commendations. Whereas I am informed, that you, or One of you, have, during this Session of Parliament, caused a Seizure to be made of certain Goods belonging to Sir William Kingswell Knight, One of the Members of the Commons House of Parliament; for that the Privilege of Parliament, during the Time of Service there (haply not so well known to yourself) reacheth as well to the Goods, as Person, of every Member attendant for the Time; I am, by the Duty of my Place, to advertise you thereof, and to advise and require you, that you forthwith procure the Restitution of the said Goods unto him, according to the said Privilege, lest that Question and Danger grow upon it, which I would be loth you should undergo. And so I bid you heartily farewel. From Boswell-house, this 26th Day of February, 1606.
