Bail of Persons impeached.
Mr. Speaker acquainted the House, That the Serjeant
at Arms attending this House, having, according to
Order, prepared Bonds for the Persons in his Custody,
who are ordered to be impeached, and their Sureties, to
enter into, and had them together to enter into the same,
they had delivered him a Paper of their Objections to the
Bond; which the Serjeant delivered in at the Clerk's
Table: Where the same was read; and is as followeth;
viz.
The Bail do humbly represent their Objections to the
Condition of the Bond ordered by the Honourable
House of Commons; viz.
That it obliges an Appearance, without any Limitation of Time, either during the present, or any particular
subsequent Session of Parliament; and therefore do hope,
the same will not be required by the Wisdom of the Honourable House: And likewise, That the said Condition
is so penned, as seems to imply an Obligation, not only
for Appearance, but also, for a Performance of the Judgment which the House of Peers may give in the present
Case; and consequently, for the Payment of any such
Sum or Sums of Money as may be thought fit to be
imposed as a Fine in or by such Judgment; which they
humbly conceive will not be thought reasonable, when
the Method of Recognizances and Securities, in all other
criminal Proceedings, is considered.
Now, forasmuch as the Bail are willing to enter into
Bonds or Recognizances to the King, or any other Person, in the Sum required, for the Appearance of the Parties before the Lords in Parliament, at any time, and at
all times, during this present Session; it is humbly hoped,
That it may be consistent with the Honour and Justice
of the House, to accept such Bail or Security, with such
Condition as aforesaid; especially, considering that new
Security may be expected by the House of Lords upon
this Occasion.
The Prisoners, in behalf of themselves, do humbly
offer, That, in case the Honourable House shall think
fit to insist upon the Form of the Condition by them prescribed, they will endeavour to persuade their Sureties to
comply with it, or else to procure others that will, if
possible.
The said Persons having not complied in giving the said
Security, according to the Order of this House;
Ordered, That Sir Rowland Gwyn, when he carries up
the Impeachment, to the Lords, against John Goudet,
David Barrau, Peter Longueville, Stephen Seignoret, Rene
Baudouvin, Nicolas Santini, and Peter Diharce, do acquaint the Lords, That the said Persons are in the Custody
