Mercurii, 14o Novembris, 1621

Further Adjournment.

THIS Day, being the Day whereunto the Parliament was, at the last Meeting, adjourned, before Nine of the Clock in the Forenoon, Mr. Speaker, with about 200 of the Members of the House, appeared in this House; and, after Prayers said by the Clerk (but the Speaker's Prayer not read) the House stayed, until Sir Law. Tanfeild, Chief Baron, and Baron Bromley, brought from the Lords a Commission, under the Great Seal of England, directed to certain of the Lords above, to adjourn the Parliament there, from the 14th to the 20th of this Month: - And that they have adjourned that House accordingly; and that the Lords have sent the Commission hither, to be seen, or perused here, as this House shall please.

The Commission being left with Mr. Speaker, they retired: And Mr. Speaker opening to the House the Substance of the Message, by Direction of the House ;

Mr. Speaker: - That, taking Notice of the Commission, this House doth accordingly adjourn itself until the 20th of this Month, Nine of the Clock.

The Messengers called in again, Mr. Speaker acquainteth them, that the House, taking Knowledge of his Majesty's Pleasure, by the Commission, had adjourned itself till the said 20th of this Month, at Nine of the Clock: And so the Commission (the same not being read in the House) was again delivered to the Messengers, and they departed.

Motion for issuing Writs.

Note, That this Day a Motion was offered to be made to the House, before the said Adjournment, for a Warrant for new Writs, for a new Choice, in the Room and Place of Three of the Members of this House: viz. the Chancellor of the Exchequer, Sir H. Grevill; Sir Lyonell Cranfeild, Master of the Wards; and Sir Edw. Mountague; called all, sithence the last Recess, to the Degree of Barons, and so attendant in the Upper House: But the House generally refused to hear any Motion [at all] made this Day, being only a Day for Adjournment.

Prayers.

[THIS] Day, about Nine of the Clock, Mr. Speaker came; and Prayers being said, in usual Manner, first by the Clerk, [and] after by the Speaker;

Arranging Business of the House.

Sir Edw. Coke moved, to know, in what State Things left [at] our Recess: - Else, beginning in Disorder, Confusion will follow. -

[1] Bills: 2ly, Committees. - Bills passed both Houses, Nine; Sabaoth, Supersedeas, &c. Ten passed this House, and sent up, but not passed there: Bills passed this House, Four; which lie still here: - Yet not to send up these, till we have passed others ready. - 29 Bills committed: - The same Committees still to stand: - Ten Bills reported, ingrossed, and not yet come to the Question: 43 once read. - To proceed first with Bills ingrossed, then with Bills committed. -

General Committees: - Monday and Friday Afternoon, for Grievances; Tuesday, Decay of Trade, and Want of Money; Wednesday, Corruption and Abuses in Courts of Justice; Thursday, Decay of Trade, especially of Clothing; Saturday, private Bills.

Sir James Perrott concordat: - And, that divers have desired to be of all Committees; which drew many Committees to be of the whole House. - To avoid this, as a great Hindrance of the Business. - Many Committees appointed at One Time and Place. - First, to put the ingrossed Bills to the Question; and, when those sent up, to desire the Lords to expedite those Bills we have already sent up.

Mr. Alford: - To stay a Day or two, before we put any Bills to the Questions. - To which the House inclined.

Sir Tho. Wentworth: - To have a Day certain appointed for these Bills. - Agreed, Thursday next.

Committee for Repeal and Continuance of Statutes, - Saturday, Two of the Clock, Temple Hall.

Recusants, - Thursday, Two Clock, Exchequer Chamber.

Ordnance, - Thursday, Court of Wards.

Debts in the King's Name, - Friday, in the Exchequer Chamber.

Exactions of Customers Fees, - Friday, in the Exchequer Court: All, that will come, to have Voice.

Secret Inquisitions, - Monday, Court of Wards.

Insufficient Jurors, - Saturday, Exchequer Chamber.

Non-residents, - Tuesday, Star-chamber.

Sheriffs Accounts, - Tuesday, Exchequer Court.

Lawyers Fees, - Wednesday sevennight. Court of Wards.

Removing out of inferior Courts, - To-morrow, Exchequer *.

Apparel, - Thursday next, Duchy Chamber.

Arms, - To-morrow Sevennight, in Westmynster Court.

Warrant for issuing Writs.

Sir Rich. Gravenor moveth for a Warrant for new [Writs,] in the Rooms of those which are now Barons : And granted.

Conference desired.

Justice Jones and Sir Ro. Crew bring a Message [to] this House; that the King, being absent, by reason of Infirmity, hath directed the Lord Keeper to deliver a Message to both Houses jointly; for which Purpose, they think, both Houses must meet; and, to that End, the Lords desire, if it may stand with the Conveniencies of this House, that they, and this House, may meet To-morrow, at Two of the Clock in the Afternoon, in the Painted Chamber.

Agreed to.

Answer, by the same Messengers, that this House will attend the Service, at the Time and Place desired.

Moor-burning.

Crouding at Conference.

Sir Francis Barrington moveth, for some Course to be taken, for avoiding crouding at the Meeting; whereby much Disease, and Hurt.

Mr. Treasurer to move for a Course to help this.

Resolved, This Meeting is but as a Committee : The Speaker not to attend. Sir Edw. Coke to make the Report.

American Fishing.

Mr. Granvyle moveth, to speed the Bill of Fishing upon [the] Coasts of America; the rather, because Sir Fer. Gorge hath executed a Patent sithence the Recess. - Hath, by Letters from the Lords of the Council, stayed the Ships ready to go forth.

Mr. Neale, accordant. - That Sir Ferd. hath besides threatened to send out Ships, to beat them off from their free

Fishing; and restraineth the Ships, ut supra. - Moveth the House to take Consideration hereof.

Sir W. Heale : - That this true ; but my Lord Treasurer hath given Order, that the Ships shall go forth presently, without Stay.

Sir Edw. Coke : - That the Patent may be brought in.

- And Sir Tho. Wentworth : - That the Party may be sent for.

Ordered, The Patent shall be brought in to the Committee for Grievances, upon Friday next; and Sir Jo. Bowcer, and Sir Ferdinando his Son, to he sent for, to be then there, if he be in Town, Sir Fer. himself being Captain of Portesmouth, &c.

L. 2a. An Act for the Abbreviation of Michaelmas Term : - Committed to Mr. Treasurer, Sir Edw. Coke, all the Lawyers of the House, Sir Jer. Horsey, Mr.Fanshaw, Mr. Chancellor Duchy, Sir Wm. Pitt, Sir Tho. Wentworth, Mr. Raynscrofte, Mr. Alford, Sir Edw. Sackvyle, Sir Edw. Gyles, Mr. Ro. Pye, Mr. Wingfeild, Mr. Ravenscrofte, - Fine Office, Sir Ed. Barrett: - Monday next, Court of Wards.

Protections.

Sir Ro. Phillippes : - The Preservation of our Liberties, the Honour [of] this House. This may be broken actively, and passively. - [Will] not now meddle with the last; Mentioneth Protections, [both] above and here. Moveth, the Committee for Privileges may [consider,] what fit, and what unfit, in this Kind; [that we] may enjoy our Liberties, and yet the Commonwealth * no Prejudice. And moveth, the House may [be called] To-morrow.

Mr. Brooke : - That oft resolved here, that our Privilege extendedeth but to our menial Servants. - Serv *

* * and the printed Book is, "Servants and Famil * ." - The Abuse, in this Case, great. Some in this [House] have protected Knights. - That every Man disavow all such Protections he hath granted ; and grant no more, upon Pain of the Censure of this House. - To inform the Lords, above, of this Grievance there. - Not to call the House so soon as To-morrow.

Sir J. Horsey: - That an Order in this Case already.

Privilege.

Mr. Mallory: - Misseth Sir Edw. Sandys. - Moveth, we may know what is become of him.

The several Orders, for Privilege, read.

Sir Edw. Coke .- - That 18o Ed. I. a Distress of the Goods of a Servant of a Burgess holden Breach of Privilege. 10o Ed. III. a Clerk of the Parliament had a Citation served upon him: Ruled, Breach of Privilege [a]. -

5o H. IV. resolved, a Servant in the Country is to have Privilege. -

That he hath disavowed a Servant of his, that hath served him 22 Years. - Moveth, every Man may disavow what he hath unjustly done. - To look forward, and not backward; and, if any shall hereafter offend, to bring him to the Bar, and put him out of the House.

Dr. Gooch: - To make a Remonstrance of our Opinions here, unto the Lords above. - But not granted.

Protections.

Resolved by the House, That all Protections, granted by any Member of this House to any, not his menial Servant or Attendant, are void. And Ordered, That, if any shall hereafter avow any such Protection, unlawfully given, or shall, after this Time, give any, he shall incur the Censure thereof.

Moved by Sir Edw. Coke, and Ordered, That the Five first Days in every Week shall hold for general Committees, according to Sir Edw. Coke's [Motion] supra; and Saturday in the Afternoon for private Bills.
