ACTS OF THE COURT OF HIGH COMMISSION During the Month of May 1634,

In continuation of those for April in that year, published in the preceding Volume, pp. 579–584. They are derived from Domestic, Charles I., Vol. cclxi.

May 3. Vol. cclxi., fol. 18b. Augustine Holl, of Heigham, Norwich, Esq. Appeared and took oath to answer articles.
May 5. fol. 10. Robert Waldegrave, of St. Mary le Savoy, Middlesex, cutler. The like.
fol. 18 b. John Workman, of the diocese of of Gloucester, clerk. Witnesses produced and sworn.
John Beare, of Bovey Tracey, Devon, tanner. Appeared and took oath to answer articles.
May 8. fol. 17 b. Robert Cooke, of Feering, Essex, yeoman. Report made by Sir John Lambe and Dr. Aylett. They recommend that Cooke, as impropriator of the rectory of Marks Tey, should be ordered to do certain repairs in the chancel of that church.
fol. 18 b. Francis Wright, vicar of Witham, Essex. Witnesses produced and sworn.

David Hooganhosen and James Bleau, Belgians. Bleau's answer insisted upon, Hooganhosen admitted to put in his defence and examine witnesses, so that the cause be ready for hearing in Trinity Term.

Thomas Austen, rector of Grafton Regis, co. Northampton. Austen ordered to pay arrears of 20 marks a year to the curate there.
Michael Kelly, of London Examined this day.
Paul Poole, or Pawle, of Felsham, Suffolk. Defendant had been warned to appear under penalty of 100l.; not appearing he was fined accordingly.
Henry Lovell, of Bletchingley, and Frances Lovell alias Newdigate, his pretended wife. Defendant setting up a royal pardon, the cause was referred to Sir Charles Cæsar and Dr. Gwynn.
fol. 21. William Clifford, rector of Yarlington, Somerset. Further time allowed for examination of witnesses.
John Pincombe, of Poughill, Devon. Fined 100l. upon non-appearance, and fresh intimation decreed on pain of 150l.
Robert Waldegrave, of the Savoy, Middlesex. Examined.
fol. 21 b. Cannon and Weldon Commission decreed for proof of defence.
Richard Walker, clerk, prisoner in the Gatehouse. Next sitting appointed to consider sufficiency of answer. Being asked if he had any letters of orders, he answered, No; only a certificate to procure him to be made a deacon.
John Laverock, clerk, prisoner in Bridewell. Adjudged a man scandalous, and the keeper of Bridewell required to set him at work, and bring him to the court next court day.
Henry Deane alias Atwell, Thomas Wadlowe, and William Cole. To take Oaths of Supremacy and Allegiance, and so to be discharged.
Godson Meighen, of Westminster, clerk. Upon submission and promise of conformity, dismissed on payment of fees.
Francis Con, of London, gent.; suit promoted by Mary Steward alias Con, his pretended wife. Cause referred to Sir Henry Marten and Dr. Eden.

fol. 25. Sir Philip Parker Commission for examination of witnesses renewed and Sir Philip to present certificate of repair of chancel of church of Burnham Overy alias Burnham St. Clement's, the last court day of Trinity Term.
William Powell, clerk The costs of defendant having been taxed at 16l., motion was made that the same might be paid by John Price, who was the real promoter, there being no such person as Richard James, the pretended promoter.
Richard Parry, of Llanvalteg, co. Pembroke, gent. Not appearing, his bond was certified and the cause finally settled in his absence. It appeared that he occasioned a disturbance in his parish church by causing the sexton to apprehend a person who was there present, during divine service; that on another occasion, rising after receipt of the bread in the sacrament, he exclaimed, "Some devil is in my knee;" and that at other times he said to Roger Phillips, his rector, "I am a better "preacher than thou; and I care not a "straw for thee," and that he said of the archdeacon of Carmarthen, or his official, who had sent out process against him, that he hoped he would be hanged; and that he had said that if he were King there should be no bishop in the land, but every doctor should have 100l. a year and every master of arts 20l. or 30l., adding, "What good do bishops in the land?" He was ordered to make a submission in his parish church of Llanvalteg and in the cathedral church of the diocese of Carmarthen; he was further fined 2,000l. to the King, and condemned in expenses.

May 8. Vol. cclxi. fol. 26. Edmund Jefford, clerk Motion made for his release from his suspension, but not granted.

Henry Lort of St. Petwike [Petrox], co. Pembroke. Attachment decreed for appearance under pain of 40l.
Ralph Jones, clerk, curate of Corringham, Essex. Sworn and ordered to be examined.
James Erick, of Thornton, co. Leicester, clerk. Cause referred to Sir John Lambe, but not to be finally dismissed out of court, the court being resolved to make trial of defendant for a time, so he was licensed to depart, paying first the costs of suit.
fol. 27. Margaret Umpton Witnesses sworn.
Robert Cooke, of Feering, Essex, yeoman. Report of referees confirmed with an alteration in a clause relating to a certificate of his reparation of the chancel of Monk's Tey.
Sir Thomas Southwell (first cause). Attachment decreed unless in the meantime he satisfy the order of the court in the cause between defendant and his wife.
The same and Mary Eden (second cause). Promoter permitted to bring in new articles against Sir Thomas for continuing to cohabit with Mary Eden, not withstanding the order of the court.
Richard Massey, clerk Commission brought in and motion made for publication, but it being alleged that Massey was an ancient grave minister, and was willing to receive home his wife and give security for her good usage, it was referred to Drs. Duck and Aylett to set down order touching the same.
fol. 27 b. Thomas Williams, of Chew Magna, Somerset. Cause to be sentenced next court day.
Thomas Pye and others of Morpeth. Order that unless prosecutor follow up this cause next term, defendants to be dismissed.
Ludowick Middleton Defendant to be dismissed, having performed the order of the court.
Nanney Lloyd Dr. Merrick to make a motion herein next Court day.
Tristram Hinchcliffe, vicar of Timberland, co. Lincoln. Ordered that unless defendant be examined within a week he be attached.
Richard Saunders, of Lynn, gent., George Ganswell, of Watlington, Edmund Warne, and John Hansell, of Congham, co. Norfolk. Appeared and took oath to answer articles.
May 8. Vol. cclxi. fol. 28. Thomas Stevens, clerk Witnesses sworn and interrogatories referred to Drs. Gwynn and Wood to expunge scandalous and impertinent matter.
William Tyler, clerk Petition of defendant rejected and he remanded back to prison until he perform the order of the court.
John James, of Burton, William Fox, John Ponder, Thomas Wells, and William Dodson, all of Rothwell, co. Northampton. Appeared and were examined. Answers referred to Sir John Lambe, who, upon perusal of John James's answers, licensed him to depart.
Ralph Jones, of Coringdon [Corringham?], Essex, clerk. Appeared and was monished to be examined before the next court day.

Richard Liker, of Upper Stowey, Somerset, yeoman. Intimation decreed for appearance on pain of 20l.
Philip Earl of Chesterfield The Earl, having given in his answers and denied the matters charged, to be dismissed if bond to prosecute be not put in before next term.
fol. 28 b. Richard Murray, S.T.P., Warden of Manchester. Witnesses sworn.
Westland and others Reference to the registrar to inform the court of this cause.
May 12. John Careswell, of Shiffenhall, Salop, gent.; suit promoted by Dorothy his wife. Dr. Eden, the referee, condemned Careswell in payment of 7l., costs of suit, and 80l. per annum alimony, and that if Careswell provide for the maintenance of Sarah his eldest daughter, then 20 marks of the 80l. be defalked.
June [May?] 13. fol. 29. John Pincombe, of Poughill, co. Devon, Esq. Appeared and took oath to answer articles.
May 14. Augustine Holl, suit promoted by Bridget his wife. Costs of suit taxed at 50l. and defendant monished to pay the same. In regard of the large addition to his estate his wife's alimony augmented to 200l. per annum.
William Gorton, vicar of Nether Guyting, co. Gloucester. Defendant being charged with having committed adultery with Dorothy Freston, alias Winchcombe, wife of Roger Freston, it appeared that during the absence of Roger Freston beyond seas, defendant and Dorothy, believing him dead, intermarried, but Freston returning challenged his wife, whereupon Gorton and she parted company. The court acquitted Gorton of the adultery, but admonished him not to come again into her company. No costs allowed to either party.
May 29. Edmund Thomas, of Westerham, Kent, yeoman. Appeared and took oath to answer articles.
