Aug. 21. 12. Certificate by John Fisher, Rector, and three others, that John Hartley, of St. Clements, has been well behaved and not factious; with note by Dr. Geo. Morley that he is fit for an almsroom in Christ Church, Oxford.

Arscott served under the late Lord Hopton in the war; was at the siege of Exeter and in several engagements; aided in Penruddock and Sir George Booth's business; was sequestered and imprisoned, being obliged to mortgage his own property, and to borrow 180l. to carry on his services, which still remains unpaid.

Petition of Sir John Lowther, jun., of Whitehaven, Cumberland, to the King, for a patent for settling a fair and market in that town, granted in his minority, because the navigation of the town was much increased by a pier built by his grandfather and father at their own expense. With reference thereon to the Attorney General.

23. Petition of the Deputies of the Protestant Churches of the valleys of Piedmont to the King and Council. Complain that 520l. of the money collected for relief of the said churches has been issued, without their consent, to strangers; request an order that these sums may be repaid, in order that the manna sent by Divine Providence to feed those desolate churches may be kept for them. With reference thereon to Sir Sam. Morland, and others, who have received the said moneys; Sir Samuel's answer that the 300l. given to him was for his dangerous and painful voyage to Savoy, but was to come from the interest of those moneys, not the principal; and that the petition is the result of the malice of the Deputies, who are incensed with him for informing that they were only deputies of a faction, and that those who preceded them had their credentials taken from them in the way, and given to these men. 23. i. Order in Council that the treasurers of the collections for the poor Protestants of Piedmont pay 300l. to Sam. Morland for his care in that business. November 25, 1657.

Shows,—in response to his order of July 17, that she should leave the lodgings she held belonging to the Master of the Horse,—that her lodgings never did belong to him, but were bought by her husband from Sir Sigismund Alexander; prays consideration of the patent by which she holds them.
Aug. 23. 25. Report of Attorney General Palmer on the aforesaid patent, which grants to And. Cole the Keepership of the Mews and lodgings there, that it is good in law, but contains no power for its exercise by a deputy.

29. Capt. Edmund Curtis to the Same. Chased and sunk a Spanish galley east of Gibraltar, with 300 men; the Spaniards got ashore, but 100 were slaves from Algiers and Tituan; freed them and returned them to their countries; saved with difficulty two brass guns, 11 cwt. each. Asks what is to be done with them, and something for his pains in getting them out. [Adm. Paper.]

Aug. 24. 32. [Sec. Nicholas] to Sir Wm. Curtius. Everything has improved since the King's arrival, and peace is hoped, both in church and state. The King has passed Acts for tonnage and poundage, pollmoney, &c., and they are finishing one for a general pardon. The commands in the army are gradually given to persons who have signalized themselves in His Majesty's service, and can be trusted. Letters from Scotland and Ireland announce general satisfaction with the Restoration. Lord Robartes is sent Deputy to Ireland. The Duke of Richmond is dead in France. The Prince De Ligne has come from the King of Spain, and a suspension of arms is declared. The Earl of Inchiquin is released from his captivity in Algiers, and has returned to England. The Earl of St. Albans is returning to France, the Queen Mother having resolved not to leave till spring, but the Princess Royal is expected at Michaelmas. M. de Ruvigny is coming as envoy from France. French.
Aug. ? 33. Request that the King would press the present Lord Chaworth to grant a recompense to the dowager lady, sister of Lord Windsor, her jointure being settled by the late lord on lands which were entailed.
Aug. 24. 34. The King to Lord Chaworth. Desires him to make an allowance to his mother, sister of the late Lord Windsor, as it appears that her jointure was assigned upon lands previously entailed, and is therefore void in law.

35. The King to the Militia Comrs. for London. Orders the arms of the several regiments of auxiliaries in London to remain with the regiments, till his further pleasure be known.

37. Chr. Clapham to Sir Ant. Ashley Cooper. The 20 pictures at Somerset House belonging to the late King, and bought by Lord Sussex for 2,500l., are now locked up in a room at Howlay House; the Earl declared his intention, at the time that he bought them, to give them up when the King should be restored. One picture was stolen by Lady Temple, Sir Rich. Temple's mother, from the Queen's closet. Was never an informer before, but will be fulfilling the wishes of the dead in promoting their restoration. Endorsed with notes [by Nicholas] to write to the Countess of Sussex, and desire that they may be restored.
Aug. ? 38. [Sec. Nicholas] to the Countess of Sussex. The late Earl, her husband, having bought several valuable pictures from Somerset House, belonging to the late King, protesting that he did so in order to restore them when His Majesty was in peaceful possession of his kingdoms, which pictures are at her house of Howlay,—sends her the enclosed proclamation, whereby she will perceive that their restoration is ordered.

39. Petition of John Fitzherbert, of Bristol, to the King, for the Customer's place outward in Bristol, on surrender thereof by Thos. Farewell, who holds it from the late King. Was engaged in the design of delivering up Bristol to the King; forced to fly to Oxford, and, after its retaking by Fairfax, was imprisoned in the castle dungeon chained to another person, nine weeks, and obliged to pay 360l. for his freedom; has lost at least 5,000l. by his loyalty. With reference thereon to the Lords of the Treasury.

52. Earl of Exeter to Sec. Nicholas. Has sent his deputy-lieutenants, and agreed to get the old rates of the hundreds in Northamptonshire, to see what proportion of men the country will bear, and appoint commanders, and then they can muster. Has attended to the King's instructions about volunteers, raised 100 in the east division and will try the same in the west. Hopes there will be three troops of volunteer horse, which will check any attempt at disturbance.
Aug. 26. 53. The King to the Mayor of Newcastle. Wishes now to remove all distinctions amongst subjects conforming in duty, and to promote reconciliation; requests that those magistrates who were removed for their loyalty be restored, and that Dr. Wyshard be appointed preacher in St. Andrew's Church.
Aug. 26. 54. Petition of Col. Dud. Dudley to the King. Was employed by the late King in Scotland; lost his estate of 200l. a year in land, with stock, ironwork, &c., value 2,000l.; served in the artillery, for which his sickly wife was turned out of doors, his men taken, one of them, Major Harcourt, miserably burned with matches, and he stripped and carried in scorn to Worcester, which he had fortified as general of artillery; was kept under double guard, but escaped, and, being pursued, took to trees in the day time, and travelling in the night, got to London, was retaken, brought before the committee of insurrections, sent to the Gatehouse, sentenced to be shot, but escaped with Sir Hen. Bates and nine others during sermon time, though opposed by four gaolers; lived three weeks in an enemy's hay-mow, went on crutches to Bristol, and escaped. Had the first warrant, after His Majesty's landing, for the place of Serjeant-atArms, but wants to be sworn in, as others are passing their patents who had them later. Annexing,

Loup to the King, for continuance in the place of Engineer, which he held under the late King; it will not, as His Majesty supposes, interfere with that of chief engineer, held by M. Le Gomme, since he will only have to attend the Master of Ordnance and Artillery, or to assist the chief engineer, when required. With reference thereon to the Ordnance Officers, and their report, Aug. 31, that three engineers have hitherto been appointed for the Ordnance Office; that they are unable to determine whether three engineers will suffice for the duties; the late King granted an engineer's place to Robt. Delamaine, with 100l. from the Exchequer, and the petitioner seems fit for favour. Annexing,

Attended the King in the park, reminded him of service done him at Oxford, and he promised to grant his desires presented by petition; asked for the government of Limerick, Cork, Kinsale, or Waterford Castle, Ireland. Was bred a soldier in the Low Countries, and this grant, which must be bestowed on some one, would satisfy His Majesty's debt to him.

Petition of the Levant Company to the King, for confirmation of their charter, with necessary additions; their trade has lately much declined, and they are burdened with heavy expenses of 10,000l., a year, in maintenance of ambassadors in Turkey, &c. With reference thereon to the Attorney and Solicitor General, and their report, 26 Nov., stating the old powers of the Levant Company and the new ones desired, and advising that both charters be confirmed by Parliament. Aug. 28. 72. Petition of —,on behalf of Thos. Goad, Vicar of Grinton, Yorkshire, to the Lord Chancellor. Goad, being chaplain in the late King's army, was present at Hesham Moor fight, and after it, came to the petitioner's house in Doncaster, fell ill and became distracted, in which condition he still remains: agreement was made for supply of his cure with Fras. Atkinson, who now refuses to give account of the proceeds, and tries to settle himself as lawful incumbent. Begs that Goad's distress and the cause of it may be considered, that the cure may be supplied, and 30l. yearly, about half its value, allowed to Goad for his support. [Copy.]

Middleton is to command Edinburgh Castle; asks whether the prisoners are to be given up to him.

Speech of the Speaker of the House of Commons to the King, detailing the blessings brought about by his restoration, and presenting for approval the Act for confirmation of judicial proceedings, to settle men's estates; an Act against usury; an Act appointing May 29 as a thanksgiving day; an Act of general pardon, indemnity, and oblivion; and an Act for provision of money for disbanding forces both by sea and land. Aug. 30. 82. Sir Chas. Harbord to Sec. Nicholas. As to the petition of Mr. Treswell to be Surveyor General after him, thinks it is not a place to be granted in reversion. Has long executed the office of surveyor of woods on this side Trent, and there are fewer woods than formerly. Thinks that Clarendon Park might be sown for next year, as the grain will be cut before the wall could be finished, and the tenants would thus be quieted.

Treswell, that the late King granted the office of surveyor of woods south of the Trent to his father, Robert Treswell, with reversion to his brother Andrew, and also granted the office of surveyor general to Sir Chas. Harbord; that his Majesty, in Paris, granted to the petitioner the office of surveyor general of woods south of Trent, which is a grant of larger scope than that of his father, and His Majesty must decide whether he intends to take away any part of Sir Chas. Harbord's grant.

The Levant Company to Vice-Admiral Sir John Lawson. The company have lost two ships, the Reformation and Free Trade, lately surprised by Spanish men-of-war in the Straits, great part of the lading of which is now on board two Dutch ships, the City Campana and the St. Mary, which, being bound for Amsterdam, will soon pass the Narrow seas; therefore the King has appointed part of his fleet to meet them, and bring them into some port of England. Reasons why Sir Richard Breame is unworthy of trust, viz., that by the favour of Cromwell and Lambert, he was not decimated; that he visited and corresponded with both; that he opposed the rising in Sir George Booth's business, and election of a royalist burgess for Windsor; with a suggestion that Wm. Bowles, jun., of Windsor, an honest and knowing man, be the surveyor of land there.
Aug. ? 136. Statement that the late King declared that Viscount Hereford had no claim to his title; and that Mr. Selden was of the same opinion; that the Viscount took part against the late King, and quarrelled with the Marquis of Hertford for being of the opposite party.
Aug. ? 137. Statement of the request of the Earl of Elgin and Lord Bruce to be restored to the office granted to Lord Elgin, of the Stewardship of Ampthill Honour, Bedford, with the herbage and pannage of three parks therein, of which he was deprived during the usurpation; or to become the King's tenant, in case the land cannot be imparked again.
Aug. ? 138. Complaint of the Royal and Loyal Party to the King, that having ruined their fortunes, they now find themselves altogether slighted, for want of favour to obtain offices; that those who were the greatest opposers to Kings are preferred to the chief places, and no suit will succeed unless through them, and that not without moneys, which their party cannot give, and therefore must starve or go abroad; that their petitions are never truly read, but the contents given by the secretaries as they may favour them. It is said that if any of the Royal party are recompensed, it would bring multitudes upon His Majesty, to the ruin of his revenues, which would not suffice to recompense all, but half the places and suits granted to the contrary party would have satisfied the nobility and gentry, and others would have looked to them; this is reported to proceed from the covetousness of men in office, and will prove very dangerous in these ticklish times. The writer has lost blood and estate for His Majesty, and will have to return to his country, a joy and scorn to his adversaries.

Declaration of the King's promise to reward the services of Sir Henry Chichley to the late King, by appointing him to the office of Exigenter of London, relinquished by the present Lord Chief Justice of Common Pleas, and to be relinquished by any future lord chief justice, as a condition of his holding the office.
[August.] 140. Answer of the Levant Company addressed to the Council, to the petition of Drs. Thos. and Jas. Hyde, brothers of Sir Hen. Hyde; they declare that Sir Henry owes them large sums of money, instead of their being indebted to him; deny the interception of orders from the King, and request that the matter may be settled by law.

Gives as ordered the names of the Deputy Lieutenants of Bedfordshire, three in number, who are still living and have continued loyal, and nominates five others for whose fidelity he will answer, and whom he recommends for the office.
