The Names of the Ministers and Commissionars of the particular Kirks of Scotland, conveinit to consult upon these things whilk are to fett fordward Gods glorie, and the weill of his Kirk in this Realme, in Edinburgh the xx day of December 1560 yeirs.

The names of them whilk the ministers and commissionars think maist qualified for the ministring of the word of God and facraments, and reiding of the commoun prayers publicklie in all kirks and congregations, and givin up be them every ane within there awin bounds.

December 21, 1560.

The ministers and commissioners forsaids being assemblit, finds that the ministrie of the word and sacraments of God, and assemblie of the peiple of the whole parochin of Restalring, be within the kirk of Leith; and that the kirk of Restalring, as a monument of idolatrie, be raysit and utterlie castin downe and destroyed.

The question being proponed anent mariage in second and uther degries of consanguinitie, forbidden be the Pope to be solemnizat betwixt parties, it is found that, of the law of God, mariage may be solemnizat betwixt parties beand of second, thrid, and serd degries of affinitie or consanguinitie, and uthers sick as are not prohibited expressely be the word of God; and therfor to desyre the Lords and estates to interpone there authoritie, and approve the samein, and make lawes therupon.

December 27, 1560.

The kirk appointit the electioun of the minister, elders and deacons, to be in the publick kirk, and the premonition to be made upon the Sonday preceiding the day of the electioun.

The kirk appointed that to the punishment of fornication, the law of God be observit: Publick repentance to be made be them that sall use carnall copulation betwixt the promise and solemnization of mariage.

[The petitioun of weights and measures was referrit to the Parliament.] C.

That all sick as hes bein in the ministrie of the Popes kirk, good and well conditioned persones, that they sall live upon the almes of the kirk, with the number of poore.

Consentit be the kirk that none be put in judiciall offices to be magistrates, as provest, baillies, and officers of townes, exceptand them who are knowin to be plaine and true professours of the Evangell.

It is also thoght expedient that earnest supplication be made to the estates of this realme in parliament, and to the lords of secreit counsell, that all judges ordinaire and officers judicial, sick as the Lords of the Sessioun, shireffis, stewarts, baillies, and uther judges ordinarie, be professours of the trueth of the true word of God; and all ministers thereof to be removit fra sick offices according to the civill law.

[Item To desire the Estates in Parliament to take order with the confirmatioun of testaments, that pupils and orphans be not desrauded, and that lawes be made thereupon in their favours.] C

To aske at the estates of parliament and lords of secreit counsell, for eschewing of the wrath and judgement of the eternall God and removeing of the plagues threatned in his law, that sharp punishment may be made upon the persons underwriten, and uthers idolaters and mantainers thereof, in contempt of God his true religioun and acts of Parliament, whilk sayes and causes messe to be said and are present thereat within the places following.

In Nithesdaile and Galloway.

The Pryor of Whitherne and his servants in Crugletone.
The Laird of Corswell, in Corswell.
The Lord Cairleill.
The Laird of Kirmichaell, who causes masse daylie to be said, and images holden up, and idolatrie to be mantained within his bounds.

In Fyfe.

The Lairds of Balwerie and Lathrisk, and Mr John Scrymgeours wife.

In Kyle, Carrick and Cunninghame.

The Erles of Eglintoun and Cassills, William Hamiltoun of Cambuskeith, the abbot of Corsraguell, the parochiners of Mayboill, Girvan, Oswald and Dalay, within the kirk whereof messe is openly said and mantained.

In East Lauthiane.

Johne Carkettle in Markill causes messe daylie to be said; the auld ladie Hoome in Thornetoun; the curate of Currie for abusing the sacraments.

In the Forrest of Ettrick.

The goodman of Gallowscheils, who not only causes messe to be said, but als mantaines the sayers thereof, who are enemies to God and his trueth, and therfor were exylit out of Edinburgh.

The kirks conveinit continues this thair assemblie till the 15 day of Januar nixt to cum, and hes thoght expedient that the said day ane comissionar at the least be sent fra every kirk, for requyring of sick things of the parliament as salbe thoght for the weill of the halie kirk; and every commissioner present promitteth to come themselves, or cause some others fra the kirk, the said day to the brugh of Edinburgh to the effect forsaid; and ordains every commissioner, alsweill of townes as of paroch kirks to landward, to bring a roll with them of the whole teyndis, lands, annualls, profeits and emoluments of the paroch kirks nixt adjacent to them, and what persones hes tacks thereof, to whom the samein pertains, and there names to be specially named, and what duetie they pay for the samein.
