Trial of Catesby, &c.
A LETTER from Mr. Speaker, to Sir Robert Heath,
and other Commissioners of Oyer and Terminer,
concerning the Stay of the Trial of Capt. Clifton Catesby,
Capt. Vivers, Capt. Lilbourne, and Capt. Wingate.
Information against Carre, &c.
Battersby informed the House: That he was sent for
by a Beadle, to Mr. Carre, a Constable; who desired
him to set his Hand to a Petition framed here in Westminster: Who answered, he had already set his Hand to
it: Mr. Carre replied, "You must not set your Hand
only, but your Heart; and you must stand up for it."
Battersby replied, "What means that? Must I fight for
it?"- "Yes, Sir, or else it will come to this: The House
of Commons hath already set forth an Order, or Ordinance, for the Assessing and Taking of the Twentieth
Part of every Man's Estate; and by the same Law, they
may take the other Nineteen: And they that shall refuse to pay, must be banished from their Wives and
Children: And how like you this? Is it not now Time
to stand up for it?" - Feild the Constable was likewise
present, when these Words were spoken.
Resolved, &c. That Carre the Constable shall be
forthwith sent for, as a Delinquent, by the Serjeant at
Arms attending on this House.
Resolved, That Feild the Constable be forthwith sent
for, as a Witness.
Cambridge Dragoons.
Upon an Information, That the County of Cambridge
was very willing to raise Dragoons;
Mr. Pym and Sir Dudley North are appointed to prepare some Order for the Encouragement of the County
of Cambridg, in Raising of Dragoons, to be employed in
the Service of the Parliament; according to the Directions and Commands of the Lord General.
Military Details.
A Copy of a Letter from Mr. Fines and Mr. Goodwyn,
to my Lord General, relating the Service at Winchester.
Money for Army.
Mr. Nicholls to write a Letter to be sent to the
Merchants of Southampton, to advance Two thousand
Pounds to the Forces at Portesmouth, that came from
Winchester.
Message to Lords.
Mr. Moore carried up to the Lords an Order for Seven
hundred and odd Pounds, to Lieutenant Colonel Carne:
The Eight Orders reported by Mr. Goodwyn, on Saturday
last: The Declaration concerning Capt. Lilbourne, &c.
Ld. General thanked.
Sir Philip Stapilton, Col. Hamden, and Sir Henry
Vane, are appointed to return to my Lord General
Thanks for his Care and Vigilancy in the Directions of
this late Service at Winchester.
Raising Money in Bristoll.
A Letter to be written to * *, and to the Mayor of
Bristoll, by Mr. Marten, for the Procuring of Monies in
that Town, upon the Propositions; and to advance that
Service.
Loan on Cochineal.
Resolved, That Ten thousand Pounds shall be borrowed upon the Cochineal deposited in Sir John Nulls
his Hands; either of the Pretenders to it, or else any
other Merchant that will lend the said Sum of Ten thousand Pounds, upon the said Cochineal, by Tuesday next.
Ordered, That none of the Cochineal deposited in Sir
John Null's Hands, be transported, or disposed of, but
by the Order of this House.
Ordered, That it be referred to the Committee for
Advance of Monies, that sits in London, to inquire after
all the Proceedings and Passages concerning the Cochineal deposited in Sir John Nulls his Hands; and, if they
shall see Cause to dispose of it in any other safe Hands:
And to take some Course for the Advance of Ten thousand Pounds appointed for the Service of the Northern
Expedition.
Prisoners at Oxford.
Mr. More brings Answer, That the Lords do agree to
the Declaration that concerns the Prisoners at Oxford:

A Message from the Lords, by Sir Robert Riche and
Mr. Page;
The Lords have considered of the important and Multiplicity of Business that the Committee for the Safety of
the Kingdom have: And therefore they do adjourn their
House till Monday, at One of the Clock: And do intend
to adjourn their House, from Day to Day, till that Time;
and to sit at That Committee in the Forenoon; and at
the House in the Afternoon.
Information against Sir J. Coke.
A Letter from Sir John Gell, and other Deputy Lieutenants of the County of Derby, of the Thirteenth of December, relating some Miscarriages in Sir John Coke, and
some Disservices done by him to the Parliament; and likewise a Warrant from some of the Deputy Lieutenants of
that County, to which he refused to set his Hand, were
both read.
Resolved, That Sir John Coke, a Member of this
House, be forthwith sent for up, in safe Custody, at his
own Charge: And Sir John Gell, and the rest of the
Deputy Lieutenants, shall be assisting to the Messenger,
if there be Cause.
Resolved, That this House doth approve of the Warrant from the Deputy Lieutenant of the County of Derby.
Ordered, That Mr. Pym do prepare a Letter, to be
sent to Sir John Gell, and the rest of the Deputy Lieutenants; to return them an Acknowledgment from this
House, of their good Service; and to encourage them
in the Pursuance of it.
Booth's, &c. Petitions.
Ordered, That the humble Petition of Henry Booth
and Wm. Waude, of Dover, and the Petition of Increased
Collins, shall be referred to the Committee for Informations, where Mr. Corbett has the Chair; to take the
Examination thereof; and to report it to the House.
Sir H. Cholmley, &c.
That the House being informed of the Disobedience
of Sir Hugh Cholmley and Colonel Bointon, to their
General, my Lord Fairefax, which they are very sensible of; and to require them to yield better Obedience
to his Directions hereafter.
Army Affairs.
Resolved, That the Lord General be desired to give
Order, That the Regiment to be raised by Sir Wm.
Fairefax may be sent to join with my Lord Fairefax;
and to receive and obey his Directions.
Ditto.
Resolved, That the Earl of Lincoln shall be desired to
stay with his Troop of Horse in the County of Lincoln;
and to send his Regiment of Foot, and his Officers, to
join with the Forces of the Lord Fairefax; and to be
obedient to his Directions: And that the Lord General
be desired to give forth his Order to this Purpose.
Resolved, That a Thousand Foot Arms, and One
hundred Horse Arms, be forthwith sent to the Earl of
Lincoln, to arm his Regiment of Foot, and his Troop of
Horse: And that it be referred to the Committee for the
Northern Counties, to make Provision of Horse and
Foot Arms accordingly.
Raising Forces.
Resolved, That the County of Huntington shall be
desired speedily to raise Sixty Horse, and One hundred
and Fifty Foot, to be employed for the Service of the
Northern Parts.
Resolved, That Northamptonshire shall be desired to
raise One hundred and Fifty Horse, and Five hundred
Foot, to be employed for the Service of the Northern
Parts.
Resolved, That Leicestershire shall be desired to raise
One hundred and Fifty Horse, and Three hundred Foot,
to be employed for the Service of the Northern Parts.
Resolved, That Rutland shall be desired to raise Fifty
Horse, and One hundred Foot, to be employed for the
Service of the Northern Parts.
Resolved, That Nottingham shall be desired to raise
One hundred and Fifty Horse, and Four hundred Foot,
to be employed for the Service of the Northern Parts.
Resolved, That Derby shall be desired to raise One
hundred and Fifty Horse, and Four hundred Foot, to be
employed for the Service of the Northern Parts.
Ordered, That on Ordinance be prepared for the
Raising of these Forces in these several Counties, by the
Committee for the Northern Parts.
Resolved, That the several Counties shall be desired to
provide a Month's Pay for the several Proportions of
Men and Horse, to be sent out of the several Counties:
And to appoint a Paymaster, in every several County,
to see the Money truly and proportionably disbursed.
Resolved, &c. That the Lord General be desired to
appoint some fit Person to have the Care of Raising of
these Forces in the several Counties; and of bringing
them to a general Rendezous; and of carrying them to
my Lord Fairefax.
Resolved, That Arms shall be provided for the several
Forces to be raised in these several Counties for the
Service of the Northern Parts: And that it be referred
to the Committee for the Northern Counties to provide
Arms for the Arming of the Forces to be raised in the
several Counties for the Service of the Northern Parts.
Fortifying Canterbury.
Ordered, That the Treasurers for the Proposition
Monies collected in the City of Canterbury, shall detain
in their Hands Two hundred Pounds of the One thousand Pounds now sent up, to be employed towards the
Fortifying of That City: And that the other Eight hundred Pounds be paid over, upon Account, to the Committee for the Northern Parts; to be employed for the
Providing of Arms for arming the Forces to be raised in
the several Counties for the Service of the Northern
Parts: And that hereafter, what other Monies shall be
raised in that City, upon the Propositions, shall be
likewise employed for the Fortifying thereof.
Ordinance of Assessment.
Resolved, That the like Ordinance shall be granted for
Assessing of Monies in the Cities of Canterbury, Bristoll,
Exeter, and Plymouth, as passed London, mutatis mutandis: And that the Lords Concurrence be desired herein:
And that this Vote be sent up to the Lords, at the next
Message: And the like for Coventry and Warwickshire.
Malignants at Canterbury.
Ordered, That Sir Edward Master and Mr. Nutt do
present Names to be intrusted with the Power of
Disarming of Malignants in the City of Canterbury:
And that they do bring in an Order to authorize them
thereunto.
Merchant Adventurers.
The humble Petition of the Governors and Fellowship
of Merchant Adventurers, complaining of Interruption
in their Trade, by Intruders, and refractory Members
of their Fellowship, was this Day read; and likewise an
Ordinance, presented by them, for Continuance of their
Privileges, until the Leisure of the House will give them
Leave to resume the Consideration of the Bill; and all
laid aside.
Importing Bullion.
Ordered, That, on Tuesday next, the Business concerning the Importing of Bullion into the Kingdom ....
Instructions for Lancaster, &c.
The Instructions of the Deputy Lieutenants of the
County of Lancaster were this Day read; and, by Vote
upon the Question, assented unto; and ordered to be
sent up to the Lords for their Concurrence: And Mr.
Rigby is appointed to carry it to the Lords.
Ordered, That Cheshire may have the same Instructions, mutatis mutandis.
Members to be brought in custody.
Resolved, That Sir Guy Palmes and Mr. Noell, Members of this House, be forthwith summoned and brought
up in safe Custody, at their own Charges: And that the
Lords be moved to send for the Lord Campden.
