Report to the King from the Treasury Lords on the petition of Elizabeth Prideaux praying a grant of a fee farm rent of 83l. 14s. not named in the grant to the Trustees for sale of Fee Farms. The great sufferings and constant loyalty of petitioner's father, Sir Bevill Grenville, are known to your Majesty, as also the merits of her husband, Peter Prideaux, who upon all occasions has shown great marks of his loyalty and zeal. Same to the Attorney and Solicitor General and the rest of the King's Counsel. His Majesty has to-day been pressed by the present Farmers of the London Excise on the following covenant in their grant, viz., "and the said William Bucknall, Dannett Forth, &c., do covenant and grant to and with His Majesty . . . that if at any time during the said term of three years any the rates or duties of Excise hereby demised shall by authority of Parliament be raised, or if at any time hereafter any Act of Parliament shall be passed whereby the rates and duties of Excise shall or may be more generally imposed or extended to any other persons or made demandable . . . in more places or from more persons than by the present laws of Excise they are or ought to be, then and in such case they the said William Bucknall [and partners] shall thenceforth during the residue of the said term yield and pay such further increase of rent as shall be proportionable to the increase or extent of the said rates and duties of Excise and as by the Lord Treasurer or Commissioners of the Treasury and Chancellor of the Exchequer for the time being shall be thought reasonable, whereupon the said Farmers desiring to be heard by their Counsel as to the meaning and interpretation of the same the King directed them to be heard before the Lord Keeper accordingly. The Lord Keeper has appointed Saturday next for this. The Treasury Lords desire you to attend then, and having heard the matter to state your opinion in writing what you conceive to be the meaning of the said covenant and whether the word proportionable is relative to the present rent or to the true value of the farm. The Treasury Lords to the Customs Farmers in reply to theirs of March 21 last "wherein you inform us of the difficulty of returning of moneys from the outports hither and that you are necessitated to adventure a great deal of the moneys of the rent of your farm by sea and desiring our directions for the bringing up the moneys of the late Wine Act." You are to take the same course in order to the bringing up of the said moneys as for the moneys of your farm. My Lords have considered your letter of Nov. 3 last about the difference between the King and the East India Company concerning the freight of the "Leopard" and other His Majesty's ships sent formerly to the East Indies upon an agreement with the said Company. My Lords desire you will again meet Sir John Bankes or whom else the Governor of the East India Company shall appoint, and make a state of the whole matter of fact, "and then that you in person [on behalf of His Majesty and someone else] in behalf of the East India Company attend the Attorney General, who will hear the whole business and report his opinion thereupon to my Lords."
