Dec. 5 Privy seal directed to the Lord Treasurer. By the failure of the present contractors and the refusal of Josiah Child and Tho. Papillon to deliver any more victuals on board our ships according to the terms of the contract for victualling the Navy it is necessary to make other provision for the supply of the ships. For that purpose we have called before us and the Admiralty Commissioners Sir Denys Gauden, Surveyor General of Marine Victuals, who, on behalf of himself, Sir Denny Ashburnham, Anthony Sturt, Abraham Jaggard, and Benjamin Gawden, has undertaken to furnish victuals for the Navy, during pleasure, at the rates mentioned in the contract of 1671, Nov. 4, and to submit to such amendments and regulations of said contract as may be thought expedient, from time to time, by the Admiralty Commissioners. Said undertaking is hereby approved, and you are to proceed upon it and to make such payments as may be necessary for that service. Warrant from Treasurer Latimer to the Customs Commissioners to have opened at Cleveland House some goods (a table, stands and a border for a looking glass) brought from Calais on the "Merlin" yacht for the Duchess of Cleveland. Warrants Not Relating to Money IV. p. 103.
Dec. 6 Treasurer Latimer to [the Receipt]. The several branches of expense are charged on the Hearthmoney in the manner following, viz. : 600l. per week in the first place for the Privy Purse towards the establishment of 38,000l. In the next place 250l. per week to the Paymaster of the Works on the ordinary of 8,000l. for the Works. Thirdly 5,000l. per an. to the Robes by 100l. per week. Fourthly 11,000l. per an. to the Duke of Buckingham for the Stables by 200l. a week. Fifthly 24,000l. to the Great Wardrobe by 400l. per week. The 30,000l. for a year's pay to the King's servants, payable by the Treasurer of the Chamber, is to be paid out of said revenue by directions to be given by the Lord Treasurer. As the said revenue comes into the Exchequer payments are to be made as above expressed, and if one week falls short it is to be made good out of the succeeding weeks. Dec. 8 Royal sign manual for 38l. 2s. 0d. to Oliver Pashler, vicar of Buckingham, as royal bounty, to enable him to pay an arrear of several years for the Tenths of his vicarage : in regard there has been no vicar legally invested therein for about 12 years last past until petitioner, about a year since, was presented on lapse. Chichley, Kt., Master General of the Ordnance, to authorise the Treasurer of the Ordnance to take up money on loan on the credit of orders and tallies remaining in his hands for the supply of the Ordnance for the year 1674 : His Majesty's urgent occasions requiring a speedy supply of considerable sums of money for carrying on the service of said Office, which for the present cannot be complied with by reason of the remoteness of the several assignments already made. Warrant from Treasurer Latimer to Sir John Otway, kt., Chancellor of the County Palatine of Durham, to have the stayes in the seigneury of Holdenshire, in the bishopric of Durham, repaired : using for the same the money in the hands of John Dunn, present Receiver of the King's revenue in the County Palatine of Durham. Same from same to the Surveyor General of Crown Lands for a particular and ratal of the agistment of the pasture of two parcels of ground called Withibrooke and Cookeham marsh, parcel of the manor of Cookham, Berks., as granted by King James to Sir Henry Vane the elder : same being moorish ground of about 180 acres, wherein the tenants of Cookham do claim common of pasture for their cattle sans number, whereby His Majesty's lessee is debarred from making any profit of his lease, but hopes by course of justice to exclude them from their pretended right in all or in a great part of the land, which will be a good service to the Crown : all with a view to a grant of a renewal of lease of the premises to William Taylear, of the Middle Temple. Sir William Turnor to attend with the exemplification of Bridges's patent on Tuesday morning next at the Treasury Chamber and in the meantime to wait upon the Attorney General or the Solicitor General with the order of Council concerning the said patent. The Attorney and Solicitor General are likewise desired to be there.
The Commissioners for the Eighteen Months' tax in co. Middlesex [who were] to attend on Thursday [are] put off till Monday afternoon next and [are] put off again till Tuesday morning, Dec. 16, and [are] again appointed [to attend] Thursday morning Dec. 18.

Dec. 10 Privy seal to discharge Lord Hawley of a fine of 550l., payable by Sarah, sister and executrix of Tho. Gowen, deceased, on her contract for purchase of a tenement or farm called Barton de Bradridge, in the manor of Boyton, co. Cornwall, said fine being hereby granted to him, it having been through mistake expressed in the lease to be paid to said Hawley, whereby he stands chargeable with it upon the Receiver General's account for the Duchy of Cornwall. Warrant from Treasurer Latimer to the Customs Commissioners to permit Peter Vandeput, merchant, to re-ship, Customs free, for Cadiz, two cases of Flanders lace : same being seized as prohibited goods, but being intended for Spain and being such lace as are usually carried to Spain and Portugal, and not proper for the market here : the Customs on said lace by the Book of Rates amounts to 240l. 18s. 5d., which is almost as much as it is worth. [?] Same from same to Sergeant Francis Stephens to arrest Randolph Allen and James Brooker : it appearing from the affidavit of Maurice Williams and Timothy Taylor (officers deputed by the Earl of Bath and Robert Spencer to execute the several offices of Aulnage and Collector of the duty of subsidy, aulnage and moiety of all forfeitures in London, &c.), that they seized at said Allen's house in the Minories some Kidderminster stuffs for not being sealed with the seal of the aulnage, but a rescue was thereof made : as likewise happened as to some cottons found concealed in the shop or warehouse of said Brooker, a factor in Little Moorfields. Warrant from Treasurer Latimer to Auditor Sir Edmond Sawyer to put out of charge and to enter of record as sold, certain fee farm rents and other dry rents in co. Bedford, of the yearly value of 106l., purchased by John Chace, Esq., but refused by said Sawyer to be put out of charge for technical reasons, detailed, viz., "the said rents being of two parts, first, of rents called pensions in the record, which you conceive were not vested in the Trustees by the Act of Parliament [for sale of fee farms], but the said Trustees find the word pensions in the first Act, and therefore have conceived them to be rents that pass by the second [Act] as effectually as any other rents therein mentioned : secondly, rents which in the record are written redditus sive firma, which you also conceive do not pass by the second Act in respect of the word firma. The salary of Mr. Diggs shall be revoked and that of Mr. Calvert, Surveyor of Maryland. You may dismiss Mr. Upton, Collector of Falmouth, and employ Isaac Alstell in his place. As to Mr. Godfrey's petition concerning tobacco, he is to pay the duty as for Virginia tobacco. An allowance will be made to Nicholas Denham, a Customs officer at Harwich, for seizing Annott in a collier's vessel. Dec. 13 Royal warrant for a privy seal to the Lord Treasurer. Before the failure of the late Victuallers of the Navy 22,604l. was imprested to the Navy Treasurer out of a feigned or fictitious loan made upon the credit of the present Eighteen Months' assessment by Edmd. Portman, an Agent for the said late Victuallers. The accompts of said Victuallers since their failure are not yet made up, but so much does not appear due to them as the said sum of 22,604l., "which although a regular issue be made of it at our Exchequer yet is not the same really received by them, the loan of the said Edmo. Portman being only feigned or fictitious and grounded upon a credit betwixt him and the Teller [of the Exchequer] as is usual in the like cases for the accommodation of our services." Care is hereby to be taken that no orders of repayment be given out to said Portman for said fictitious loan, it not yet appearing to be due to said Victuallers as aforesaid. If any such orders are drawn and signed they are to be vacated. Further to the end the Teller may not be charged with said loan nor the Treasurer of the Navy with the imprest of said money, the records and counter tallies of said loan and the records of the issues made thereof upon the orders to the Navy Treasurer and those orders themselves are to be also vacated. Further for carrying on the service of the Victualling you are to pay all sums necessary not exceeding 100,000l. to Sir Dennis Gauden et al.
