July 1 Royal warrant to the Attorney or Solicitor General to prepare a great seal, verbatim as detailed, for interest to the Goldsmiths to the amount of 140,000l. substantially ut supra. p. 540, under date June 8, save that the present warrant is more specific as to the stating of the accounts of such interest by Richard Aldworth and the making of certificates by the Auditor of the Receipt of the money due to said goldsmiths on any orders of loan. If the total of said interest due do not amount to 140,000l. the overplus is to be paid to said goldsmiths according to their proportions for interest which shall grow due to them above the said two years. July 10 Royal sign manual for 90l. 1s. 4d. to John Lloyd, late Clerk Comptroller of Tents, as royal bounty, being due for seven years to Sept. 29 last and 147 days since on his fee of 8d. a day : to which sum he has no claim or pretence by reason he surrendered said office before [any warrant for] payment thereof. July 11 Warrant from Treasurer Danby to the Receipt to pay 19l. to Grace Davis, executrix of John Davis, in full satisfaction of the assignment made to her of that amount by Thomas Bates in part of an order of 1671, June 29, for 2,000l. to the Earl of Sandwich as below under July 28, p. 560. July 13 Allowance by Treasurer Danby of the last Midsummer quarter's salary bill, detailed, of the Excise office, payable by the Farmers of the Excise of London, Middlesex and Surrey. (Total, 2,016l. 1s. 6d.) Money Book (Excise), pp. 64-5.

July 14 Warrant from Treasurer Danby to the Customs Commissioners to permit Christopher Lethulier, merchant, to export some knives and scissors on payment of Custom, they being brought in from St. Malo, in France, only for re-export to Spain, being sent by Lethulier's correspondent on the strength of the declaration [of 1672, May 10], and without the knowledge of said Lethulier : they being stayed at the Customs by reason the said declaration applied only to the Act of Navigation. Treasurer Danby's subscription of a docquet, dated 1674, May, of a grant to the Duke of Monmouth of the office of Master of the Horse : with the fee of 100 marks per an. and all other profits, fees and advantages thereof : upon a surrender thereof made to the King by George, Duke of Buckingham. Same of same, dated 1674, June, of a grant to Sir Fra. Winnington of the park and tolls of Bewdley and other lands, &c., of the manor of Bewdley, co. Worcester (formerly demised to Samuel Gardiner for 31 years, of which 29 are yet to run, and afterwards by the Queen and her Trustees leased to Sir Richard Poule for 40 years from 1702, Michaelmas) : to hold same for 99 years after the expiry of said two terms and without rent : and further of a grant to same of certain woods, underwoods and woodlands containing about 447 acres and other tenements, &c., of said manor of Bewdley (formerly demised to Sir Henry Herbert, Kt., for 31 years, whereof 21 years are yet to run, and afterwards by the Queen Mother leased to Sir Richard Powle for 40 years from 1695, Lady Day) : to be held similarly for 99 years from the terminations of said two terms and without rent : and also of a grant (from the death of the said Queen Consort) to said Winnington of the rents of 16l. 10s. 4d. per an. and 17l. per an. reserved upon the said intermediate leases of the abovesaid two sets of premises. Warrant from Treasurer Danby to the Navy Commissioners to make out a bill to the Treasurer of the Navy for payment [by him] of 2,346l. 19s. 3d. to Edward Backwell for interest of 18,700l. by Backwell advanced for the service of the Navy in 1671 : whereby said Treasurer may have due and full allowance of said sum upon his account (said 2,346l. 19s. 3d. being ordered to be paid by tallies on the Customs). Conventicle warrant (ut infra, p. 560, under date July 28 to Sir Francis Rolles, sheriff of Somerset for 1673, to forbear paying into the Exchequer and to pay back to the parties concerned 147l. 18s. 6d., being the King's part of fines levied that year on conventicles there. July 16 Warrant from Treasurer Danby to the Customs Commissioners and Cashier to pay Jo. Lawrence, the tally joiner, 2s. for joining tallies for every 1,000l. paid into the Exchequer on account of the Customs : being the fee as formerly received. Money Book (Customs), p. 168.
July 17 Warrant under the royal sign manual to the Attorney or Solicitor General to prepare a great seal for a grant to George, Viscount Grandison and Edward Villiers of the messuage or tenement lying near the King's garden in the parish of St. Margaret, Westminster, lately in the occupation of Dame Barbara Villiers, deceased, and now in the possession of Henry Brouncker, Esq., with all and singular buildings, structures, cellars, sollers, gardens, ways, waste ground. &c., as fully as granted to and enjoyed by Phillip, late Earl of Montgomery, Lady Elizabeth Stuart, and Margaret Stuart, her daughter : to be held for ever at the reserve rent of 10s. Warrant from Treasurer Danby to the Receipt to take back the bill from the officer of the Tally Court for the 970l. of the money of the Tenths of the diocese of York, &c., which was lately paid to the Teller or his deputy and a bill thrown down to the Tally Court for the same ; and to repay the said money to the Earl and Countess of Bristol, who shall deliver tallies of assignment for the Collector's discharge : the said Earl's and Countess's quarterly pensions being payable by tallies of assignment on said Tenths. Instructions from Treasurer Danby to the Customs Commissioners made on their representation of the 13th inst. As to corn imported at Lyme and Bristol I have referred the matter to the Attorney General. As to the naturalization of foreign built ships I am of opinion that all such ships so made free ought to be registered and certified by the officer for the Navigation Act as the law provides. But intending to move the King herein I direct that no foreign built ships be admitted to the benefit of freedom till the King's pleasure be known. As to the opinion of Sir William Jones. Solicitor General, in the case of meal and flour imported you are to proceed to the trial of the case thereupon. As to Abraham Niblet's petition concerning tea seized, being imported from Holland, you will receive my particular warrant therein. Warrants Not Relating to Money V. p. 19.
Warrant from Treasurer Danby to the Customs Commissioners to discharge the abovesaid seizure of a small pot of tea, of not above 13l. value, imported from Holland by Niblet thinking that the declaration of 1672, May 10, included Holland under the words Germany and the Netherlands. Warrant from same to the Customs Commissioners to permit Sir Denny Ashburnham, Sir Dennis Gawden and partners in the victualling of the Navy, to transport, Custom free, certain surplus victuals : they having in obedience to the King's command to provide victuals for 35,000 men for eight months for the present year, provided great quantities of beef and pork over and above what would serve 5,000 men for eight months, to which the aforesaid declaration of 35,000 men was by the King's order reduced : whereby they are forced to seek some markets abroad. Warrant from Treasurer Danby to the Customs Commissioners to permit Alvaro Dacosta, of London, merchant, to unlade the ship "St. Antony Abad," of Venice, Marco Bernardo master, laden at Gallipoli with oils and hemp before the publication of the peace with Holland and therefore "appearing worthy the favour of His Majesty's declaration of the 10 May [1672], and the said ship being arrived within the six months in the said declaration mentioned." Report from Treasurer Danby to the King on the petition of Frances, Duchess of Somerset (as by the order of reference of Aug. 12 last on said petition) for renewal of lease of the rectory of Austrey and mills of Fairsly in cos. Warwick and Stafford The Surveyor General of Crown Lands has received a certificate from four worthy gentlemen inhabiting near the premises certifying the old and increased rent to be 120l. per an. (105l. 11s. old rent and 14l. 9s. increased rent) and that (in spite of the fact that at the granting of the lease in March, 1661. that sum was considered to be but a moiety of the full improved value) the present value is 120l. per an. for the rectory and 6l. 13s. 4d. for the mills besides the land tax which is paid by said Duchess, "the value of lands and especially of tithes and mills being much fallen of late years." The Surveyor General therefore advised the new lease to her with an abatement of the increased rent and a compensation for her losses which are like to increase by the fall of things of this nature. The premises are in the Queen's jointure and cannot be granted by your Majesty (save in reversion of the Queen's interest) unless the Queen's Council be induced to surrender the premises for some equivalent. I approve the Surveyor General's report "and do humbly inform your Majesty that in some cases your Majesty hath been pleased to take lands out of the Queen's jointure recompensing Her Majesty by the addition of other lands in lieu thereof." Warrant from Treasurer Danby to the Auditor of Excise to make up two distinct accounts of the London Excise, one for the duty due by covenants on the old farm to June 24 last, the other for the New Duty due by agreement with the King at the rate of 54,000l. per an. to same date, taking care that upon the quarter's advance on the new duty you allow no interest if it appear that the Farmers have always had in their hands a greater sum than their advance. These accounts are to be ready for declaration by the first day of Michaelmas term, so that a due course may be taken for the recovery of sums appearing due thereupon. All by reason as follows, viz. : the state of the old and new duty of Excise as presented to me on the 17th inst. charged the late London [Excise] Farmers with 140,000l. per an. for the old duty and 54,000l. per an. for the new duty, and showed 30,000l. due from them on the new duty and a considerable sum on the old duty. "Whereupon the said Farmers being present did pray that they might not be charged after the rate of 54,000l. per an. for the new duty, they never having taken any lease thereof under the Great Seal but were willing to account for what they had received thereof, and pay so much as should be found unpaid upon such account. But it appearing to me upon the books now remaining in my office that there was a contract made for 54,000l. per an. for the said Additional duty and that one quarter's rent, after that rate, should be advanced ; and Sir Stephen Fox, then present, attesting that the sum of 13,500l. was accordingly advanced, and you having orders from the late Lord Treasurer [Clifford] to state their accounts after that rate, and they having quietly received the said Additional duty during the whole time of their farm and paid above 100,000l., part of the said rent, although they sued not out letters patent thereupon, and the said Farmers confessing that some of them did make such agreement and the other did not then oppose the same, but that it being only by parole and no letters patent sued out, they conceived they were not bound by the same but only by the clause in their letters patent relating to an increase of the duty by Act of Parliament ; and being attested by the Attorney General, who declared his opinion that they having received the duty during the whole term upon that contract ought to be bound thereby although no letters patent were sued out, I judged it unreasonable they should expect to become accomptants, having received the duty upon a certain contract, nevertheless if they would account as well for the old duty as the new during the said term I conceived it suitable to His Majesty's clemency that they should not be loosers upon the whole, and would represent such proposal to His Majesty. But they refusing the same I judged it reasonable and just that the account should be carried on in the same method it has been ever since their entry upon the said farm." Warrant from Treasurer Danby to Sir Christopher Wren and the officers of the Works to estimate for the repair of the buildings at the Mews [at Charing Cross] and the annual charge of preserving same in repair. Warrants Not Relating to Money V. p. 35.
Same from same to same. Very great damage and inconvenience may arise to the King by the increase of new buildings and by making considerable alterations in the several lodgings within his palaces and houses of access for the accommodation of several persons and their families, whereby said houses are weakened and the repairs become more chargeable, the freedom of air the less and the springs and conduit of water exhausted. You are hereby directed to take care that no new or additional building be for the future made or erected or any great or considerable alterations made within any of His Majesty's palaces or houses of access but such only as the King shall give particular order for under the Lord Treasurer's hand and such as are usually done by you for rendering the lodgings and offices more fit and useful. You are to forbid all workmen that shall be employed by any persons contrary to this order. Ibid.

Edward Villiers, Governor of Tynemouth Castle, of three roods of land adjoining the lighthouse and a house thereon by him erected and the soil and waste within the said castle, he having "begun to rebuild and at his own charge undertaken to finish an old ruinated church lately standing upon the waste ground within the said Castle." Instructions from Treasurer Danby to the Customs Commissioners. As to the several queries [from you] as to the importation of corn I herewith send you the opinion of Sir William Jones, Solicitor General, on the case, and you are hereby directed to give special directions to the collectors in all the ports of the kingdom to observe same. As to your first query whether the certificate of the clerk of the market or chief magistrate of the town shall be a rule to the Collector to receive the duty notwithstanding the general price was otherwise than [as] certified or whether proof of the general price ought not to be the rule within the intention of the Act of Tillage and what proof is necessary in the case ; to this Sir William Jones gives his opinion that the certificate is no rule but proof must be made by witnesses to a jury (if an action be brought) what was the general price.
To the second [query, viz. :] (that the words of the Act being general, viz. the price at the place of importation without mentioning the markets, whether the words should not include the quay or any other place of the city or town where corn is sold, and whether the greater part of the corn sold within that city or town shall not be intended [as] the price [of the place] within [the meaning of] the said Act of Parliament). Sir William Jones is of opinion that the general price of the place must be the guide and for as much as most corn is sold in the market the general market price is most likely to be the price of the place.
To the third query (if the merchant tender only the lesser duty upon corn according to the Act of Poundage whether the Collector may receive the same), Sir William Jones thinks the Collector may refuse it.
To the fourth query (if the merchant shall upon such tender without the Collector's acceptance proceed to the landing of his corn whether or no by the words of "custom and poundage" in the said Act of Tillage, by which the duty in question comes in lieu of that charged by the Act of Tunnage and Poundage, it is not liable to seizure) : this question Sir William Jones confesseth to be of some difficulty, because the Act of Tillage doth not say this new duty shall be paid under the penalty of the Act of Tunnage and Poundage : but yet he thinks, seeing that by the said Act of Tunnage and Poundage there was a duty payable upon corn imported, and this Act doth only increase that duty, and the duty here given doth involve and comprehend the duty given by that Act, that therefore there shall be like remedy for this as for that. And there are many cases in law where the addition to a thing given by a former Act shall be within the remedy of that former Act. The consequence will be if this additional duty, or rather change of the duty, be within the remedy of the former Act then may the officer seize if the whole duty be not paid. And seeing the matter is so probable he thinks fit a seizure should be made to bring the matter to a legal determination.
As to the fifth query (if the King's Collector shall accept of the tender of the lesser duty with a further demand of the greater, with a declaration that he doth not receive it in satisfaction of the Customs, whether the King has not a remedy for the recovery of the residue) Sir William Jones is of opinion such acceptance will not bar the King of his right. This answers your sixth query also.
To the seventh query (that if it should be advised that an information of seizure will lie for the greater duty due by the Act of Tillage and the seizer or informer should be nonsuited, whether such person shall be liable to damage for detainer of the corn) Sir William Jones thinks the seizer would be liable but the damage would be less when the matter is so doubtful.
To the eighth query (if the King shall bring his action of debt or information for the recovery of his duty, whether such action or information is local and to be tried in the proper county or may be tried in Middlesex, as [are] other informations for the King in Customs cases) Sir William Jones says if the action or information be brought for the King for the Customs it may be brought in what county the King pleases.

July 25 Warrant from Treasurer Danby to the King's Remembrancer to supersede process against the securities of Thomas Oliver, deceased, Receiver of Crown Revenues, and of the late Queen Mother's revenues in cos. Privy seal for 8,000l. per an. to Philip Packer for the ordinary of the Works, and 4,000l. per an. for extraordinaries thereof from April 1 last : the extraordinaries to be particularly appointed by the Lord Treasurer : the privy seals of 1668, Sept. 18, and 1670, Oct. 21, and 1671, June 27, to be hereby void, except as to all orders drawn thereon up to Lady Day last : so that the expenses of the Works may be ascertained and settled for the future, which of late have exceeded the allowance formerly established.
