1676-7. Jan. 10. Money warrant to the following officers of the Ordnance, viz., 36l. 10s. 0d. each to Sir Jonas Moore (Surveyor of the Ordnance) and Edward Sherburne (Clerk of the Ordnance), 54l. 15s. 0d. to Edward Conyers (keeper of Stores in the Office of Ordnance), 40l. to George Wharton (Treasurer and Paymaster of the Ordnance), 18l. 5s. 0d. to Samll. Fortrey (Clerk of deliveries of Stores in the Office of Ordnance), 15l. 4s. 10d. to Richd. Batchler, keeper of the King's hand guns, demihakes, curriers, harquebuts, daggs, etc., in the Tower and the Minorites : all for one year each on their respective fees. Feb. 22. Treasurer Danby's subscription of a docquet dated 1676-7, Feb., of a great seal for the farm of the Excise by way of indenture between the king of the one part and George Dashwood, Thomas Rowney, William Roberts, Samuel Dashwood, Felix Calverd, John Freind, William Strong and Edward Buckley of the other part, viz., of the Excise as granted by the 2 Acts of 12 Car. II. in consideration of 250,000l. to be by said Dashwood and partners advanced and to be advanced at the times agreed on, to hold same for three years from 1677, June 24 : the King hereby covenanting that if the Additional Excise [as granted by 22 Car. II.] be continued by fresh Act of Parliament, said Farmers shall have a lease thereof for the above period : the farm rent to be 560,000l. per an. if the said Additional Excise be continued and included as above, and 446,000l. if same be not so continued and included : the said sum to be payable as follows, 200,000l. per an. for the Excise of London, Westminster, Southwark, Middlesex and Surrey (except South Mimms) if the Additional Excise be continued or 146,000l. per an. if it be not ; to be payable by 12 equal monthly payments, the first payment to begin from June 24 next ([1677] : and similarly for the Excise of the counties, towns and places of England, Wales and Berwick, 360,000l. per an. if including the Additional Excise and 300,000l. if not ; to be payable quarterly, the first payment to begin at Michaelmas next [1677]. The King covenants to allow 6 per cent. interest for the advance money ; to be by detainer out of their rent, and the first such allowance to be made at Michaelmas next. In case the Additional Excise be continued then the advance is to be repaid by 27,500l. quarterly defalcations or detainers for the four quarters 1679, Lady day, Midsummer, Michaelmas and Christmas, 70,000l. out of the monthly and quarterly rents due between 1679, Christmas, and 1680, Lady day, and 70,000l. out of the like due between 1680, Lady day, and June 24 quarter. If the Additional Excise be not so retained then the repayment to be by 35,000l. out of the rents monthly and quarterly due at 1679, Lady day, 35,000l. out of same due at 1679, June 24, 44,000l. out of same due at 1679, Sept. 29, 44,000l. out of same due at 1679, Dec. 25, 46,000l. out of same due 1680, Lady day, and 46,000l. out of same due 1680, June 24 : with proviso, and the said Farmers hereby covenant, that if the quarterly rents be sufficient to satisfy the moneys to be [by them] retained then they are not to detain any part of the monthly payments ; but if said quarterly payments be not sufficient, then they are to detain so much of the monthly rents next preceding such quarterly rent as the Lord Treasurer shall appoint towards satisfaction thereof. If any of the monthly payments be unpaid 40 days after the due date the Farmers shall have no interest for 50,000l., part of their advance money, but shall lose the same for that month and for so long time more as the said monthly payment be unpaid : and if default be made in the payment of the quarterly rents so as one third part of such rent over and above what may be detained on the quarter day shall not be paid within 40 days next after any of the said quarter days, or the whole quarter's rent shall not be fully paid within 10 days before the next quarter day the Farmers shall lose the interest of another 87,500l., part of said advance money for that quarter and for so long [thereafter] as said rent shall be unpaid ; provided that if any of the monthly rents shall be unpaid for 54 days and the quarterly rents for 3 months and 8 days, the King may seize the farm. If the King so seize the farm then the 250,000l. advance money is to be accepted as part of the arrears of rent due and the residue, if any, is to be repaid to the Farmers with interest after the rate aforesaid. The Farmers covenant to resign at any time within a year and a half upon six months' notice, they being first satisfied their advance money : provided that if a surrender be required and shall not be made at or before the end of the six months, then upon signification of the King's pleasure under the privy seal the [present] grant to be void, the said advance being first satisfied. The King agrees that at the time of making such surrender or other determination of the term, the Farmers shall be empowered to levy arrears of Excise then due to them. The Farmers covenant not to sub lease or [sub] farm any of the Excise without the Lord Treasurer's consent ; and if such consent be given they are to pay to the King all such advance money as shall be raised thereby, to be repaid out of the rents with interest in such manner as shall be agreed upon. The Farmers covenant to pay (over and above the rents) 55,000l. per an. to the sub collectors and other inferior officers if a less sum will not serve with safety to his Majesty's service ; and if less will serve the overplus to be paid to the King. If the revenue arises one year with another (bad debts and arrears accounted) to more than the rents reserved and the said 55,000l., the King covenants to allow the Farmers 5,000l. per an. if the said overplus will amount to that sum or if short of that then so much thereof as said overplus shall amount to. This said allowance is in recompense of arrears, bad debts, losses and other incidents. The King covenants to allow to said Farmers for their hazard and reward for management 10,000l. per an. in case the overplus of the revenue (after payment of the rents, the 55,000l. per an., and the 5,000l. per an. aforesaid) will be sufficient to pay same ; if not sufficient then so much only as that overplus shall amount to. The Farmers covenant that if the revenue arises to more than the rents and the said 55,000l., 5,000l. and 10,000l. per an. they will pay to the king such overplus, deducting thereout only poundage at the rate of 3d. per in case the Additional Duty be continued, or 4d. per in case same be not continued. Together with other covenants and agreements touching the collecting and answering fines and penalties for non payment of Excise, touching payment of the daily [or current] cash [into the Exchequer], touching salaries to the Commissioners and other officers of the Excise [Office] and touching defalcations and allowances and other powers and authorities relating to the management of the Excise as are contained in the lease now in being. Aug. 3. Royal warrant for a privy seal to discharge Sir George Carteret of 700l., ut supra, pp. 709-10. [As the date of the privy seal must be subsequent to the date of this royal warrant it is evident that the date of the privy seal in King's Warrant Book, p. 422 is incorrect. July 31 may be a clerical error for Aug. 31. The docquet is dated Aug., 1677, though the date of Treasurer Danby's subscription of it is not given.] King's Warrant Book V. p. 402.
