Royal warrant to the Clerk of the Signet for a privy seal for 200,000l. to Sir George Wharton, Kt. and bart., Paymaster of the Ordnance, as imprest for the service of the Ordnance. 1676-7. [Sic erratum for 1677-8.] Feb. 1. Same to the Attorney or Solicitor General for a great seal for a farm of the Additional Excise in the form of an indenture between the King of the one part and George Dashwood, Thomas Rowny, William Roberts, Samuel Dashwood, Felix Calverd, John Freind, William Strong and Edward Buckley, of London, Esqrs., of the other part. By indenture of Feb. 26 last [1676-7], the King (in consideration of 250,000l. by them advanced at the times and in the proportions as mentioned in the said indenture of Feb. 26 last and in consideration further of the rents and covenants therein reserved and set out) did for 3 years from June 24 then next ensuing [i.e. 1677] and now last past grant the farm of the Excise as by the two Acts of 12 Car. II. : together with a covenant on the King's part that if the Additional Excise granted by the Act of 22 Car. II. should be continued by any fresh Act of Parliament during the term of this farm that then said Dashwood and partners herein should have a lease of said Additional Excise for the said term of 3 years. By the Act lately passed for the Additional Excise the said Additional Excise is continued for three years from 1677, June 24. Therefore the present indenture demises to said Dashwood and his partners herein the said rates of Additional Excise for 3 years from 1677, June 24, subject to the rents and covenants as in the said recited indenture of 1676-7, Feb. 26. And whereas in the said rated indenture the said Dashwood and partners did covenant not to sub-let or sub-farm the Excise within any county, city, borough or place without the consent of the Lord Treasurer, and that in case of such consent they would pay to the King all advance moneys coming to them from such sub-farms to be repaid with 6 per cent, interest in such manner as should be agreed upon between the King and them ; and whereas further they have sub-let the farm of the Excise of Wales at the rent of 13,600l. per an. and the like for Cumberland, Northumberland, Westmorland and Durham at 14,000l. per an. on which sub-farms several advance moneys amounting in all to 13,800l., have been paid to them, which they have lent and paid to the King as above, this indenture further witnesses that for securing said loan of 13,800l., with interest, the said sum shall be allowed and repaid to said Dashwood and partners by way of retainer, and that they may detain the same in their hands as follows out of the rents due from them, viz., 3,450l. out of their farm rent payable Lady day, 1679 ; 3,400l. out of same due 1679, June 24 ; 3,450l. out of same due Michaelmas, 1679, and 3,450l. out of same due Christmas, 1679 : and the King hereby covenants to pay 6 per cent, interest for said sum from July 16 last [1677], until repayment of same ; such interest to be by way of defalcation or detainer out of their farm rent quarterly, the first such defalcation to be made at Michaelmas now last past [1677] : with proviso that the said Dashwood and partners shall not be liable to account for the profits of the Excise of Wales or of said four Northern counties : and with proviso further that if the King reassume the Excise he will first repay to said Dashwood and partners he said 13,800l. with interest thereon in the same manner as the said 250,000l. with interest thereon is to be repaid in the like case as by the said recited indenture of 1676-7, Feb. 26. Feb. 2. Warrant from Treasurer Danby to the Customs Cashier to permit the landing, and to pass, Customs free, the goods of Sir William Temple one of the Ambassadors for the Treaty of Peace at Nimuegen and his retinue.
Appending : schedule of said goods (including Orange flower water ; East India cabinets ; trunks, etc., for my Lady, for Henry, for Miss, for Lady Gifford, for Charles, for Elizabeth, for Griffin ; cane chairs, Turkey work chairs, a squob of my Lady's ; a box of books for my son.

Warrant from Treasurer Danby to the Receipt to take in and vacate a tally dated 1675, April 1, for 4,198l. 11s. 2d. struck upon John Strode and others (then Farmers of the Four and a Half per cent. duty in Barbados) and payable to Richard, now Earl of Ranelagh, for money due to him in right of his wife, one of the daughters and coheirs of Francis, late Lord Willoughby of Parham for the moiety [propriety rights in] said duty [sic for Island] : and in lieu thereof to strike upon the same fund six new tallies each for 500l. and a seventh for 1,198l. 11s. 2d., the said Earl having prayed to have said original tally so split for his better convenience and accommodation. Letter of direction on 330l. in part of an order of Jan. 21 last for 1,456l. 1s. 4d. to John Lawrence for secret service as in part of 10,000l. to him by the privy seal of 1662, Sept. 29 : said 330l. to be hereby paid by levying a tally on Ellis Cooper, Esq., late Receiver of Hearthmoney in the North and East Ridings, co. Yorks, on his account for the year ended 1674, Lady day : "and let the residue thereof [of said 1,456l. 1s. 4d.] be paid by levying tallies upon John Adderly, late Receiver of the Eighteen Months' tax in co. Money warrant for 250l. to the heirs of William, late Earl of Kinnoul, for last Christmas quarter on his annuity of 1,000l. as by the letters patent of 1672, July 19. (For Bertie's letter hereon see infra under date 1678, July 6.) Ibid.
Warrant from Treasurer Danby to the Customs Commissioners to deliver to Mris. Montague, Customs free, a little packet of lace lately brought from France and belonging to her. Out Letters (Customs) IV. p. 8.
Feb. 3. Treasurer Danby to Sir Henry Thomson, Kt., George Manklin, William Richardson, Cressy Burnett, aldermen of the city of York, Philip Prince, Thomas Fairfax and Joseph Scott, Commissioners for the Royal Aid, Additional Aid, One Month's and Eleven Months' Assessment, viz., for co. Yorks and York city. From the report of the state of the accompt of Walter Strickland, Esq., deceased, late Receiver General for the above for York county and York city, it appears that there is due and in arrear from the city of York 517l. 7s. 1d. of the said aids and assessments as below. For recovery hereof process of Exchequer ought to issue out against you the Commissioners and against the inhabitants of said city for not levying and answering same in due time, the Acts for said grants having provided that the tax set upon any place shall not be lessened or abated by any negligence, wilfulness, mistake or other accident whatsoever. I desire you to take some speedy course for discharging the arrear by making reassessment or such others ways as you think meet, and according to the powers given to you by the Acts : and so prevent the inconvenience to yourself from Exchequer process.

Warrant from Treasurer Danby to the Customs Cashier to pay 50l. to Giles Dowle, gent., in part of 166l. 7s. 0d. which Treasurer Danby thinks fit to allow to said Dowle (over and above 13l. 13s. 0d. by same already received as fines imposed on offenders) ; the said Dowle having by the said Lord Treasurer's direction prosecuted several persons in co. Gloucester for planting tobacco contrary to the statutes whereby several considerable fines have been imposed on several of the said planters which are now in process for levying the same : Treasurer Danby intending that only said 50l. be at present paid to Dowle, and that the residue of said 166l. 7s. 0d. be paid as the said fines shall be brought into the Exchequer. Money warrant for 307l. 14s. 6d. to Sir Edward Wood for extraordinaries 1676, March 25, to 1677, March 25, as Envoy Extraordinary to the King of Sweden : as by a bill thereof as follows (the particular sum of 29l. for carriage of goods being disallowed).

Warrant from Treasurer Dan by to the Customs Cashier to pay to Giles Dunstar, one of the General Surveyors of the Customs, 93l. and 93l. 2s. 8d., the first for riding charges for his late western survey for 93 days to Oct. 23 last, and the second for his late charges in destroying tobacco. Ibid.
Charles Bertie to the Customs Cashier to bring in notwithstanding, etc. (and same to the Auditor of the receipt to issue) 25l. 1s. 10½d. each to Serjeant Ramsey and Serjeant Harsnet for a quarter on their fees and board wages. Out Letters (General) p. 217.

Treasurer Danby has appointed that the tallies on the Customs for 1,132l. 10s. 0d. for Sir William Swan and 546l. for Sir John Paul (ut supra, p. 756), shall be paid in course according to the dates of the tallies ; "and if you shall think fit to advance the money due on the said tallies or any part thereof, his Lordship is willing to allow you interest for the sums you shall so lend at the rate of 8 per cent, per an. until the tallies shall be payable in course and the money then repaid you." Feb. 6. Warrant from Treasurer Danby to Sir William Jones, Attorney General, to forbear proceedings, till further order, against William Dent, one of the securities of Robert Stockdale, late Collector of Dover port ; Dent having prayed for such stay pending the determination in the suit now between the King and Michael Arnold, another of the said securities, which is likely in a very short time to come to a decree in the Exchequer Chamber. Same from same to the Barons of the Exchequer and to the King's Remembrancer to swear in, and to take the securities of, Henry Ball, as one of the Collectors of Newcastle port, loco John Holman, surrendered : said securities being said Ball, Allan Wharton of St. Margaret's, Westminster, and Thomas Holford of New Windsor, Berks. Charles Bertie to the Receivers of Excise to pay 150l. to Lemuel Kingdon upon the score and for the account of Mr. Henry Killegrew, being the advance of half a year of his pension of 300l. per an : "for which I will give you a regular discharge." Out Letters (General) p. 216.
Same to the Customs Cashier to bring into the Exchequer, notwithstanding any restriction, 50l. for half a year of the pensions to Mris. Mary [Nevill] and Mris. Sophia Nevill ; and 60l. for three half years of Sir Thomas Hanmer's salary as one of the King's learned Counsel at Law. And to bring in "with what convenience you may" 541l. 19s. 4½d. for the Master of the Great Wardrobe for necessaries for his Majesty's chapel closet "which on the 18th of Dec. last I writ unto you to bring in with respect to the weekly payments." (Same dated Feb. 13 to the Auditor of the Receipt to issue to said Hanmer said 60l. which the Customs Cashier has lately brought in.) Ibid, pp. 217, 218.
Same to same. There is a tally struck on you for 5,941l. 1s. 8d. for the service of the Great Wardrobe. The money is very much wanted in that office. Treasurer Danby therefore desires you to advance said sum on the credit of said tallies, and he will allow you 8 per cent, interest until repayment thereof to you. Ibid, p. 216.
The like letter concerning the tally for 364l. "if you think fit to advance to Mr. Thomas Chudleigh (to whom the said tally belongs) the said sum." Ibid, p. 217.

Feb. 7. Reference from Treasurer Danby to the Customs Commissioners of the petition of Edward Agberowe, pricker of the Stilyard, who being (for want of business in his office) ordered to do the duty of a King's waiter, prays allowance of part of the fee of a King's waiter. Money warrant for 16,050l. to William Ashburnham, Cofferer of the Household, as imprest for the service of the Household and in part of the privy seal of the 6th inst. Feb. 8. Robert Brent (in the absence of Secretary Bertie) to the Customs Commissioners transmitting a paper [missing] about [sea] passes not as Treasurer Danby's warrant to be executed but as a paper upon which his Lordship desires your opinion as soon as you can, how far you conceive it fit for his Lordship to be concerned in giving any direction in it. Mr. Bernard desires that no grant may pass for any of the Searchers' places in London port till he be heard. Caveat Book, p. 32.
Feb. 9. Warrant from Treasurer Danby to the Attorney General to enter a noli prosequi to any information in the Exchequer against the ship Star, of Portsmouth, on the petition of Arthur Smith, master and part owner thereof ; it appearing that said ship loaded in Holland in Aug. last for Lisbon and Valencia, sailed Sept. 10 last, and sprang a leak on her voyage thither and was forced to put in at Ryde in the Isle of Wight, where she is seized by David Horton, Collector of Cowes port, and at the instigation of John Bailehach, deputy Customer there, under pretence that 200 deals laden on said ship and landed at Cowes were brought from Holland, whereas they were taken out of a vessel at sea and said 200 of them were entered by Arthur Smith, son of the petitioner, and duty paid, they being landed by consent and simply to buy provisions : as appears by the Customs Commissioners' report of the 26th ult. Money warrant for 200l. to John Ramsey without account for one year to Christmas last for his service in soliciting divers law suits on his Majesty's behalf. Letter of direction on 1,400l. in further part of the order of Nov. 9 last for 20,000l. to Charles Bertie for secret service : on which order the sums of 5,500l., 2,000l., 2,500l., 2,000l. and 3,125l. (or 15,125l. in all) have been already directed : the present 1,400l. to be hereby satisfied by tallies on Herbert Awbrey, Esq., late Receiver General of the Eighteen Months' Assessment for co. Warrant from Treasurer Danby to the Customs Commissioners to deliver, Customs free, to (William Dunbar altered to) John Downton, servant to Lady Temple, 19 trunks of clothing, etc., belonging to her and lately imported from Holland in the Katherine yacht. Warrant from Treasurer Danby to the Clerk of the Pipe to prepare an indenture to pass the Exchequer seal to give power and licence to Nathaniell Mathews of Petersham, Surrey, his heirs and assigns (he being owner of as much ground abutting upon his Majesty's great park at Richmond as contains 120 rods or thereabouts in length against the wall [thereof]) to make use of so much of the said wall as lies against the same for the planting of fruit trees for 99 years, he having proposed to oblige himself, his heirs, etc., to repair so much of the said wall at his own proper costs and charges from time to time as need shall require, viz., for 99 years from Christmas last : which proposal by the advice of the officers of the Works Treasurer Danby has thought it convenient to accept on the King's behalf. The tally for said 20,000l. is to be paid out of the Customs of East India commodities imported or to be imported by them from Nov. 1 last together with said interest from the time of the loan to the times of the respective repayments. Warrant from Treasurer Danby to the King's Remembrancer to deliver to Auditor Richard Aldworth (and same to said Aldworth to receive) the book of accompts of John Birch, Edward Wingate and Edmund Waring, late Commissioners for the several Wine Acts, they having about Hilary, 1671-2. made up an account of their receipts and disbursements to 1671-2, Feb. 3, which they exhibited into the Exchequer Court annexed to their answer to a bill brought against them in the said Court, which said account is remaining in the King's Remembrancer's office ; Treasurer Danby having appointed said Aldworth to audit and state same together with the remainder of the said Commissioners' accounts. When Aldworth shall have finished with said book it is to be returned into the King's Remembrancer's Office in the bag of particulars of the said account. Ibid.

Royal warrant to the Attorney or Solicitor General for a great seal for a grant to Sir Bernard Gascoigne of the duty of 5s. per ton on French ships, to hold for the term of nine years from Christmas last if the said duty shall so long continue payable, and from the determination of the said term to hold the same for a further term of seven years if same shall so long continue payable : all under the yearly rent of 1,200l., payable quarterly, of which rent 600l. per an. in the first place is to be paid to John, Lord Pawlett and Thomas Fowles or to be retained to the proper use of the said Sir Bernard Gascoigne for so long of the said terms as he shall live, as in discharge of the pension to him as below (in case the said duty shall amount to so much) ; and the residue thereof, after satisfying the said pension, to be paid into the Exchequer : nevertheless with this express agreement between the king and said Gascoigne that during the continuance of the war between France and Spain or in case that by reason of any other war or any plague, fire or other accident happening at any time during the said term the said duty of 5s. per ton shall not answer the said rent of 1,200l. per an. that then and immediately thenceforth said Gascoigne, his heirs, etc., shall only be chargeable as an accomptant to the King (as he now is by the privy seal as below) for so much as and no more than the said duty shall (over and above all necessary charges and deductions) amount to according as the same shall be certified out of the Register book of the Custom House under the hand of the Collector of the Navigation Act and of the Comptroller General of the Customs ; or otherwise (at the election of the said Gascoigne, his heirs, etc.) that they shall have such defalcations and deductions for the said accidents as the Lord Treasurer shall think fit ; and that in case he become such an accomptant the said 600l. per an. pension and all arrears thereon shall be in the first place paid or retained as above and only the residue after such payment and after such charges and deductions as above is to be paid into the Exchequer : the King having granted to said Gascoigne a pension of 600l. per an., which was afterwards settled to be paid out of said French duty ; which pension said Gascoigne has since assigned to John Lord Pawlet, of Hinton St. George, and Thomas Fowles, citizen and goldsmith of London, in trust for himself, said Gascoigne ; and the King having further by indenture of 1674, Nov. 26, granted said French duty to said Gascoigne at 1,200l. per an. rent and for 7 years 1 month and 20 days if the said duty and the duty of 50 sols per ton imposed by the French King on English shipping shall so long continue ; "and whereas of late since the war between France and Spain very few ships of the subjects of the French King have arrived in any of our ports of England or Ireland whereby the said duty of 5s. per ton is much increased [sic for decreased]" therefore by the privy seal of 1674, Oct. 30 (1675, Oct. 13, according to the Docquet Book see Cal. Tr. Books, Vol. IV. pp. 602, 809) said Gascoigne was made an accomptant as above during the continuance of the said war, and is now desirous to have a fresh lease upon surrender under the like understanding as above. Royal warrant to the Attorney or Solicitor General for a privy seal for a grant to Edward Hawley, Esq. (son to Francis, Lord Hawley), his executors, assigns, etc., of the sum of 219l. 10s. 7d., which appears by certificate from the Clerk of the Pipe to be the whole sum remaining due on the accompt of Sir Edmond Jennings, Kt., late sheriff of Yorks for the year ended 1676, Michaelmas ("and is for the revenue arising out of Recusants' estates charged within the said account") and of all other sums which shall appear to be due upon the said accompt : with power to said Hawley to sue for, compound or discharge said debt. Warrant from Treasurer Danby to the Customs Commissioners to permit the export, Customs free, of the remainder of the 40 tons of copper blanks for making farthings ; same being imported in 1675 by James Burkin, of London, merchant, pursuant to a contract made between the Comptroller of the Mint and Abraham Croonstrom, of Stockholm, merchant, of which 40 tons the said Comptroller took off about 20 tons, but refuses the rest, which remains on said Burkin's hands. Warrant from Treasurer Danby to the Customs Commissioners to employ Richard Johnson as a landwaiter, London port, upon the second vacancy, the first vacancy being to be for Thomas Salter : in both cases by particular direction from the King : meanwhile said Johnston is to be employed as a landwaiter extraordinary, without salary. Same from same to the Auditor of the Receipt to vacate an order for 250l. 14s. 1d. drawn Dec. 12 last, payable to Sir Thomas Player, Treasurer or Receiver of the money appointed for the rebuilding the Cathedral church of St. Paul's, London ; which order is drawn by virtue of the privy seal of 1676, June 14 (which privy seal appropriated the Greenwax money by moieties thenceforth to the rebuilding said church and the rebuilding Windsor Castle) and in place of said order to draw a new one for a moiety of that sum to be paid for the said purpose of rebuilding St. Paul's ; "and I shall hereafter give your direction for issuing the other moiety to the use of the said castle in such way as may be regular" : it appearing that said sum of 250l. 14s. 1d. was actually levied [as Greenwax money] and in the hands of Sir Thomas Fanshaw, his Majesty's late Attorney and Escheator in the Court of King's Bench, before the said 14 June, 1676, and should therefore by virtue of a preceding privy seal have been entirely paid to the rebuilding of Windsor Castle, but by the strict words of the privy seal a moiety thereof is, after it came into the Exchequer, made payable to the use of St. Paul's, "which was contrary to his Majesty's intention, and those which have appeared before me on behalf of said church are willing the same should be rectified." Feb. 20. Privy seal for a grant to John Foche, of London, gent. (at the nomination of Sir John Tippetts and Thomas Hayter) of the debt of 974l. 19s. 4d. owing to the King from Roger Mostyn, late Receiver of Hearthmoney for co. Montgomery : this grant to be for and towards satisfaction of the several sums owing by the King to said Tippetts and Hayter, viz., to said Tippetts upon two orders drawn in the Exchequer and assigned to him, one No. 986 for 250l. and interest in the name of Sir Dennis Gauden and registered on the Hearthmoney, the other for No. 103 for 300l. and interest drawn in the name of Sir Thomas Osborne and Sir Thomas Littleton, late Treasurers of the Navy, and registered on the Wine Act : and to said Hayter upon several orders Nos. 1, 4, 5 and 23 on the Customs drawn in the name of said late Treasurers of the Navy and assigned to him for 792l. in all : of all which said orders 500l. has been paid out of money paid in by Francis Crawley, late Receiver of Hearthmoney for Essex and Herts, thus leaving still due to said Tippetts and Hayter 1,000l. and upwards ; towards satisfaction whereof they have petitioned the King for a grant of the debt as herein. Feb. 21. Warrant from Treasurer Danby for Thomas Berringer, the last sheriff [for co. Bucks] to pay to Nathaniel Birch, keeper of the King's gaol in co. Bucks, 80l. for four years' rent for said gaol : the present warrant being in the form of a subscription by Treasurer Danby, underwritten on a petition from said Birch, which petition sets forth that there is no gaol for said county and that the king has always allowed to the sheriffs [thereof] on their accounts 20l. per an. for the rent of a gaol, but for the four years ended 1677, Michaelmas, same is unpaid, and said gaoler has paid same yearly out of his pocket : the Lord Chief Baron Montagu having reported the request to be reasonable. Same from same to same to permit Richard Boothe, merchant, to import from Holland to London 100 pottacoes of Spanish tobacco, he setting forth in his petition that there is now but a small quantity of said tobacco to be had in this nation, and that said commodity hath often been brought in privately in small parcels to the loss of the Customs : the said Commissioners having reported the 23rd inst. that the Customs on said parcel may amount to about 300l., and that petitioner is a considerable and fair trader. Warrant from Treasurer Danby to the Customs Commissioners to permit a lading of fish out of the ship Mathew, of Lynn Regis, to be landed without payment of the duties imposed by law on fish caught and imported in foreign ships : Treasurer Danby's warrant of the 3rd inst. having ordered the discharge of the seizure of said vessel, but there being a doubt whether such discharge implied the discharge also of said fish and its free import as above by reason that the said ship is English owned. Same from same to same to deliver to the proprietor 14 small gross of small Budgett locks (padlocks) imported from Rotterdam by John Towne, of London, merchant, in the ship George, Robert Niblett master, said Towne having paid Custom thereon Sept. 12 last, but the officer refuses to deliver same without order : all by reason it appears no fraud was intended, though the goods are by law prohibited. Reference to the Customs Commissioners of the petition of Charles Orchard. Customer of Barnstaple, Bideford and Ilfracombe who is required to collect the Customs of those ports for his patent salary though Collectors have [previously] been allowed 130l. per an. for the same, and he is further at great charge in making his returns of money [to London] and therefore prays that he may be excused the said collection or will undertake it at 50l. less than others have done ; and also prays that he may discount his salary out of his receipt. Privy seal to demise, release and discharge Sir Thomas Peyton, his heirs, etc., and their lands, goods, etc., from the debt of 553l. 6s. 2¾d. owing by him to the King on a bond dated about May, 1668, as security for Robert Gilbert, High Collector of the Royal and Additional Aids and the One Month's and Eleven Months' taxes within the lathe of St. Augustine's, co. Kent, on which Gilbert's accounts there is still due and in arrear the said sum of 553l. 6s. 2¾d. as appears by certificate from Auditor Richard Lightfoot : the said Peyton having petitioned the King, setting forth his great sufferings for his loyalty to the late and present King, whereby he incurred many great debts for discharge whereof he is committed to sell his estate and hath contracted to a purchaser for sale thereof but cannot make any good title to the same unless he be released from the abovesaid security, which the King is willing to grant in consideration of his loyalty and sufferings.
