Letter from Colonel Hart with Acts of St. Christophers.

His observations.

A letter from Colonel Hart, Governor of the Leewards Islands, dated the 10th July, 1724, transmitting three Acts of St. Christophers, with his observations on the same, was read.

Leeward Islands.

Letter from Colonel Hart.

Another letter from Colonel Hart, dated the 12th July, 1724, was read, and the papers, therein referred to, were laid before the Board, viz:—

Letter to Mr. Barker.

And their Lordships observing that Colonel Hart in the above answer to queries, mentions to have transmitted with them some samples of copper ore; ordered that a letter be writ to Mr. Barker, Colonel Hart's correspondent, to know whether he has received any such.

Letter to Duke of Newcastle, about the Danes keeping possession of one of the Virgin Islands.

A letter to the Duke of Newcastle, one of His Majesty's Principal Secretarys of State, inclosing extracts of Colonel Hart's abovementioned letter and papers, in relation to the Danes having seized and possessed themselves of St. Johns, one of the Virgin Islands, was agreed, transcribed and signed.

Montserrat.

Acts formerly destroyed to be sent to Colonel Hart.

Ordered that the Montserrat Acts, which were destroyed there, in 1712, and Colonel Hart desired in his letter, dated the 16th March, 1723–4, might be copied from the Records in this office, for the use of that Island, be sent him accordingly.

Antigua.

Letter from Sir Wm. Codrington about his return to the Island.

A letter from Sir Wm. Codrington, dated at Dodington the 2nd of September, 1724, signifying his intention to return to Antego, and desiring leave to stay one year longer in England, was read.

Acts considered.

Their Lordships then took into consideration two Acts passed at Antego in 1721–2, entituled, An Act for the preservation of the Body Ponds and making them Public Ponds; and an Act entituled, An Act for establishing a Court of King's Bench, Common Pleas and Errors, for the better regulating and settling due methods for the administration of Justice, and limiting a time for issuing execution out of the Court of Chancery in this Island, and agreed the same should lye by probationary.

Acts for Antigua and St. Christophers sent to Mr. West.

Ordered that an Act of Antego and the five following Acts of St. Christophers be sent to Mr. West, for his opinion thereupon in point of law.

An Act for cutting off the entail of certain lands, tenements and hereditaments in Antego, belonging to John Vernon, of the parish of St. James, Westminster, Esquire. Passed in 1724.

An Act entituled, An Act for the continuing and carrying on the works of the fortifications of Brimstone Hill and Charles Fort, and other the fortifications of this Island for one year longer, and also for continuing part of a certain Act for imploying negroes on the fortifications of this Island, and for rendering more effectual and explaining an Act for raising a tax by the Poll on all slaves in this Island, and also for raising five hundred pounds upon the inland trade of the same for the time in this present Act mentioned. Passed in 1723.

An Act to prevent the casting or unloading any ballast or rubbish in the havens, roads and creeks of this Island. Passed in 1723.

An Act to prevent the abuses committed in the importation of wheat flour and bottled liquors into the Island of St. Christophers. Passed in 1723–4.

St. Christophers.

Acts sent to Mr. West.

An Act for the establishing a Court of King's Bench and Common Pleas and for the better advancement of Justice in the Island of St. Christophers, and for settling certain fees and repealing a former Act of the said Island, intituled, An Act for establishing of Courts and settling due methods for the administration of justice. Passed in 1724, and

An Act for raising a tax on negroes and other slaves and on the inland trade of the said Island. Passed in 1724.

Letter from Mr. Scrape, of the Treasury.

Petition of Mr. Armstrong about complaints against him.

A letter from Mr. Scrope, secretary to the Lords of the Treasury, dated the 2nd inst., inclosing the petition of Mr. Armstrong, praying to be heard upon a complaint made against him to this Board, in his absence, was read; and their Lordships resolved to consider further thereof, when Mr. Armstrong should make application to them for this purpose.

Nova Scotia.

Memorial from Mr. Birkhead, etc.

Settlement of land.

A memorial from Mr. Birkhead and Mr. Sasoubre in relation to their proposal for settling some land between Nova Scotia and New England, was read.

Leeward Islands.

Mr. Smith against Act of St. Christophers.

His fees abridged by it.

To present his objections in writing.

Mr. Smith, secretary to the Leeward Islands, attending, acquainted their Lordships that by the Act, lately passed at St. Christophers, entituled, An Act for the establishing a court of King's Bench and Common Pleas and for the better advancement of Justice in the Island of St. Christophers, and for settling certain Fees, and repealing a former act of the said Island, entituled, An Act for establishing of Courts and settling due methods for the administration of Justice, he was abridged of a considerable part of the fees belonging to his office, and therefore desired their Lordships would please to give him an opportunity of presenting to the Board his objections to the said Act in writing, before they made any representation thereupon, which their Lordships promised to do accordingly.

Newfoundland.

Complaint of M. Chammorel about a-French fishing vessel driven from her station.

Commodore Cayley summoned.

Their Lordships taking again into consideration the letter from Mr. Delafaye, of the 25th November, 1723, referring to this Board, by order from the Lords Justices, the copy of a memorial from Monsr. Chammorel, the French secretary, complaining of a French vessel being driven by an English one from her fishing station on the bank of Newfoundland, mentioned in the Minutes of the 26th November, 1723; and the secretary acquainting their Lordships, that Captain Cayley, who was Commodore of the Newfoundland Convoy in the foresaid year, was in town; ordered that he be acquainted that the Board desire to speak with him on Wednesday morning next.

Plantations General.

Mr. Armstrong to attend upon his petition.

Ordered that Mr. Armstrong, late Collector of the Customs in New Hampshire, be acquainted that the Board have appointed next Thursday morning to consider his petition, referred to the Board by Mr. Scrope's letter of the 2nd, mentioned in the Minutes of the 3rd inst., and that he be desired to attend at the same time.

Massachusetts.

Acts to be sent to Mr. West.

Ordered that all the Acts, passed at New England since the King's accession, which have not been already considered by the Board, be sent to Mr. West, for his opinion thereupon in point of law.

Newfoundland.

Commodore Cayley about complaint from Monsr. Chammorel.

Commodore Cayley, attending, as he had been desired, their Lordships had some discourse with him in relation to the French vessels said to be drove from their fishing stations on the bank of Newfoundland by an English man of war, according to the papers annexed to Mr. Delafaye's two letters, mentioned in the Minutes of the 13th and 26th of November, 1723; and their Lordships asking him what he knew concerning this matter; to which he said, that when he arrived in Newfoundland in 1723, the Captain of His Majesty's ship the Solebay, who was then cruizing on the Banks, apprehending that, by the 13th Article of the Treaty of Utrecht, the French were prohibited fishing on the Bank to the southward of Cape Bonavista, had chased two French ships from thence, but that he had reason to believe the said ships did afterwards return to their stations, and had met with no further molestation.

Representation to be prepared.

Commodore Cayley being withdrawn, their Lordships gave some directions for preparing the draught of a representation upon this subject.

New York.

Act sent to Mr. West.

Ordered that an Act, passed at New York in 1723, entituled, An Act to enable Thomas Dungan and Walter Dungan, two surviving kinsmen of Thomas, late Earl of Limerick, to sell some part of their estate for payment of their debts, and discharging some incumbrances, wherewith the same is now charged, be sent to Mr. West, for his opinion thereupon in point of law.

Jamaica.

Draught of representation on Acts.

Their Lordships then took into consideration the draught of a representation ordered to be prepared, upon the several Acts passed at Jamaica, which have not yet been confirmed or disallowed by the Crown, and made a progress therein.

Further time to answer complaints.

Mr. Armstrong, late Collector of the Customs in New Hampshire, attending, as he had been desired, and desiring their Lordships would be pleased to allow him some further time to bring in his answer to the charge laid against him by Mr. Bolam, Mr. Huske and Mr. Sharpe, (mentioned in the Minutes of the 15th inst.), their Lordships were pleased to appoint Tuesday the 10th of November next.

Jamaica.

Draught of representation on Acts.

The Board took into consideration the draught of a representation upon the several Acts of Jamaica, (mentioned in yesterday's Minutes), which have not as yet been confirmed or repealed by the Crown, and made a progress therein.

Barbadoes.

Answer.

A letter from Mr. Worsley, Governor of Barbadoes, dated the 31st July last, was read, whereupon ordered that the secretary make an answer thereto.

Order repealing in Act.

A copy of an Order in Council, of 22nd August last, approving a representation of this Board, and a representation of a Committee of Council for repealing an Act, passed in Barbados the 31st December, 1723, entituled, An Act to raise a levy on the inhabitants of this Island and to establish a method to supply the want of cash for the payment of the public debts, was read.

South Carolina.

Order on hearing of complaints against General Nicholson.

Licence for coming to England.

Copy of an Order in Council of 22nd August, 1724, upon a representation of a Committee of Council, on a hearing of complaints against General Nicholson, approving the said representation, and ordering a license of leave for the said General's coming over to England, was read.
