The Treasury Lords to the Duke of Ormonde. The King has seen the draft you sent to the Earl of Sunderland of a [royal] letter to enable you to expend up to 1,000l. out of the revenue of Ireland in making an additional building at Chapel Izod. The King takes notice that the method used here in the case of new buildings or additions [to buildings] is to have a draft first made of the building with an estimate of the charge by the Surveyor of the Works. It is his Majesty's pleasure that the like draft and estimate be in this case made and submitted for approbation. Ibid, p. 423. Out Letters (Ireland) IV, p. 94.

Sept. 23. Henry Guy to Sir Richd. Haddock and partners, present Victuallers of the Navy, to pay the abovesaid 500l. to Richard Brett and partners, late Victuallers, in part of the money due to them for provisions and utensils ut supra. Disposition Book II, p. 413.
Treasury warrant to Nath. Driver and Edmd. Arundell, sheriffs of Bristol, to deliver on receipt of 80l. the goods and utensils of Erasmus Dole, which were seized on his conviction for Recusancy on the statute of 23 Eliz., the said goods including his tools etc. ut supra, p. 1191. the said sheriffs and Mr. Rumsey, town clerk of Bristol having reported that though said utensils be liable to the execution in the King's case, yet their detention may be mischievous and increase the poverty of the poor labourers who have a dependence upon working under him in his trade: and they therefore think that 80l. may be accepted for said goods and that the remainder of his fine of 220l. may still be continued in charge against him, as there is little hope of his conformity. The Treasury Lords to Sir William Stapleton. The King has referred to us your petition about the state of the two Foot Companies at St. Christophers and the arrears due to them and you. We are considering of the best means of satisfying same and meantime have directed half a year's pay to them and you which will be soon followed by a further supply when we receive a particular accompt of the name of every soldier in those Companies and of the time they have served and their arrears. Send this by the first conveyance and of your own knowledge without relying upon the information of other persons "being more willing as in other cases to depend upon the assurances you shall give us herein upon your honour." Sept. 24. Henry Guy to the Customs Commissioners. Send the Treasury Lords with all speed a list of all the officers for the collection of the Four and a Half per cent. duty in the Leeward Islands. Out Letters (General) VII, p. 423.
Same to Sir Tho. Player. In reply to yours of the 8th inst. the Treasury Lords desire you to put the business in some course of certain despatch with the auditors by the first day of next term for there cannot be any further delay in it. Mr. Woodward gives me to infer that you will be able to do this. Ibid.

Appending: said query. A. B. of the town of C. in Ireland, has at divers times forged, counterfeited and applied the seals of office of and the handwriting of the Customs officers of the port of White-haven in Cumberland to several certificates or papers, falsely attesting that the ships and persons named therein had given security to bring to England, Wales or Berwick any goods laden in any of the King's Plantations in America. Hereby the King has been defrauded of a certain duty laid upon Plantation goods by the Act of 25 Car. II., for that the said ships did go to some of the said Plantations and did there load goods and did not return to England, Wales or Berwick. Query how the said A. B., now living in Ireland, shall be prosecuted at law for the said offence.

Sept. 26. Royal sign manual for 204l. 7s. 7d. to John Hebdon, late Envoy to Russia: to be issued without account, being intended to be on his allowance of 50s. a day and as in full thereof for the whole time he was so employed (viz. from 1676, Sept. 16, to 1678, July 15, being 667 days) after deduction of the following sums, viz. 753l. 2s. 5d. remaining in his hands as collector of Customs, Colchester (which it is intended he shall be regularly discharged of) and 600l. which he is acknowledged to have received on account of his said journey to Russia and 110l. which he has received of Henry Guy. Sept. 27. Same to Mr. Ryves. The last declared account of the Wine Licences Commissioners was for the year 1675. For want of vouchers for some of the allowances claimed by you Auditor Aldworth cannot finish your account for the [succeeding] year 1676, whereby all the succeeding accounts are stopped, to the King's great prejudice. You are forthwith to send to said Aldworth what warrants you have to make good your said demands. Ibid.

Treasury warrant to the Clerk of the Pipe for a lease under the Exchequer seal to Mary Hellowes, relict of William Hellowes, deceased, of the tenement called the sign of King Henry in New Windsor, the pasture of one acre and meadow of two acres lying adjacent in the Shutts, three closes of pasture near Lingham's Lodge and two acres of land lying in the Worth and 1½ of land lying ibid. formerly in the tenure of Christopher Bushe and now or late in that of John Lodge and late in that of Richard Temple and now in that of Francis Temple; and 2¼ acres lying in Pittsfield in New Windsor, bounded by a field of Brocas farm north and by Porthouse Lane and Puppetts Close east, the said 2¼ acres being reputed part of the premises which are all part of the lands of Richard, Ward, found by inquisition and now annexed to the Honor of Windsor and were demised to William Hellowes 1680, May 11. The present lease is to be for 14½ years in reversion from 1701, Lady day, at the old rent of 4l. 5s. 4d. and fine of 20l. and with a special covenant that in case it be thought fit to make use of any part of the premises for making or enlarging the new walk or avenue between Windsor Castle and Windsor Great Park, same may be re-assumed by the Crown on reasonable compensation. Same to the Customs Commissioners to take off three surcharges for oatmeal imported at Poulton port Mar. 3 and 16 last, the collector of said port, Augustine Heirdson, having (as appears by the certificate of Joseph Dawson, late examiner of the outport books) charged to his account of the Customs only 12d. per 20s. value of said oatmeal whereas oatmeal ought to pay as oats; and at those dates oats were under the price of 16s. the quarter at Poulton, wherefore the said examiner surcharged the said collector with the high duty of 5s. 4d. the quarter, which amounted to 36l. 11s. 2d. more than said collector had put to his account, whereupon the collector petitioned alleging in his defence that it has been understood that oatmeal imported, not being entered in the Book of Rates, ought to pay Custom ad valorem, which led petitioner and other collectors in the neighbouring ports into that mistake and that no alterations were made on petitioner's former accounts when the price of oats exceeded 16s. the quarter and when the custom was similarly charged ad valorem, such charge being then "more than the Custom of oats upon the Book of Rates." Similarly the surcharge of 43l. 7s. 10d. set in like manner on Sir Christopher Musgrave, collector of Carlisle port, for oatmeal imported there 1683, July, Aug. and Sept., and the surcharge of 55l. 0s. 6½d. set in like manner upon John Foster, collector of Lancaster port, for oatmeal imported there in 1683, Midsummer quarter, are both hereby to be taken off.
Sept. 27. Treasury reference to the Customs Commissioners of the petition of John Evance, one of the sub-searchers, London port, who is sick and is recommended to try the country air and prays that Thomas Bats may be admitted as his deputy. Reference Book II, p. 81.

Treasury warrant to the Customs Commissioners. In your memorial of Aug. 5 last you inform us you have written to Mr. Skelton, Envoy at Hamburg, to propose to the Master of the ship Black Greyhound of Kinsale that if he would pay the full Custom of the tobacco which he imported on the said ship at [to] Hamburg contrary to law [reckoning said Customs] as if the tobacco had been imported into England and not shipped out again you would not prosecute said ship or goods. Thereupon Mr. Skelton informs you that he has received 150l. for said Custom "and that he expects some benefits thereout, having waived the forfeiture and informed you that the President of Altona in the King of Denmark's dominions where the seizure was first made deserves a gratuity of 5l. for his assistance." Thereupon you propose to allow Mr. Skelton 50l. as a reward for his pains. You are hereby authorised to do this: and the Auditor is to allow said payment in the accounts of the Receiver General of Customs. Out Letters (Customs) IX, pp. 51–2.

Treasury reference to Richard Graham and Philip Burton of the petition of Sir John Mathews, kt., to the King, shewing that Gregory Stapleton of Carleton, co. Yorks, by his will published 1671, April 6, bequeathed to Thomas Gascoigne of Barmbrough, John Middleton of Stockeld and Philip Constable, son of Sir Marmaduke Constable of Everingham, bart., and to the heir of the survivor of them for ever the lordship or manor of Askham Brian alias Brian Askam in York city; that the said lordship is granted in trust for superstitious uses and is therefore forfeit to the King: therefore petitioner prays a grant thereof on his prosecuting the King's title at his own cost.
