Orders and instructions under the royal sign manual to be observed
by John Lluelin, Commissary General of the Provisions in Portugal,
in accordance with the 9th article of the Treaty with Portugal
according to which the said King is to provide by his own Officers
provisions for the English Troops to be sent thither and to deliver
same at the same rates and prices as to his own army. You are
forthwith to report to Portsmouth and embark for Portugal and on
arrival you are to apply yourself to the Officers and Commissaries
of the said King and settle and agree with them the manner and
method of your receiving from them the necessary provisions for our
Army and in particular the bread for the men and the barley and straw
for the horses, and [as to] your acquittances for same. (2) You are
to see that the deliveries are good and wholesome and the prices are
the same as to their own Forces. You are to give receipts for same and
to send advice of quantities and prices to Thomas Morrice, Deputy
Paymaster of the Forces in Portugal, to enable him to compare
the receipts brought to him by the King of Portugal's Officers.
(3) And whereas it is agreed by the said Treaty that 2000 horses
shall be got ready by the King of Portugal's Officers for the use of
the Confederate Forces going thither, two thirds whereof the Queen
is willing to take from them for English account, the said Lluelin is
to view and approve same and with the concurrence and good liking
of the General of the Forces they are to be delivered to the Colonels
&c. to be distributed to the Officers and soldiers. The said Lluelin
is to give receipts to the said King's Officers for the horses so delivered.
(4) On all necessary occasions Lluelin is to apply to the Commander-in-Chief
of our Forces in Portugal and particularly in reference to the
Hospitals and the care that is to be taken by the Portuguese of the
sick and maimed soldiers of the English Forces pursuant to the said
Treaty. "And upon any dispute, doubt or controversy between
you and the Officers of the said King of Portugal as well in relation
to the aforesaid Treaty and interpretation thereof as otherwise you
are to apply yourself unto our Chief Minister residing at the Court
of Portugal whose assistance you are to desire in the settling and
accommodating all such matters in dispute in such manner as shall
best conduce to our service and the good of the Troops in those parts."

Warrant by Treasurer Godolphin to John Parkhurst, Receiver of
the arrears of prizes taken during the late war with France, to
discharge John James David, Thomas Tomkins and John Lambert
merchants, of the sum of 133l. 18s. 4d. they having on the 8 April
1698 bought of the then Commissioners for Prizes a parcel of barilla
at 6s. 10d. per hundredweight amounting to 433l. 18s. 4d. lying at
Coruna in Spain on board a French prize called the Lady of
Annunciation taken by the Spanish Alliance pacquet boat, towards
which they sent 300l. to their correspondent at Coruna "and to
send the same [the barilla] to Thomas Legendre, merchant at Rouen
in France" : but on arrival of the goods they appeared to be but
one tenth barilla and all the rest potashes and at the sale the barilla
sold for 15 livres per hundred[weight] and the pot ashes for only 6
livres per hundredweight, the whole making only 245l. sterling as
was sworn before the Judges for Trade of the Court of Rouen 1699
May 11 by said Legendre.

Representation by same to the Queen concerning the captors'
shares of prizes in the hands of the Receiver General of Prizes.
For a good while past I have noticed with much uneasiness
the great sums so remaining in the Receiver's hands and have long
been using my best endeavours to prevent same by frequent writing
and speaking to the Commissioners of Prizes and the said Receiver
and the Navy Commissioners in the most pressing manner I could.
When I understood that the delay in the distribution was partly
occasioned by the non return of lists [of captors] to the Navy Office
I pressed the Lord Admiral's Council to order the due return of such
lists, but same have not hitherto been procured by reason that some
of the Officers who should sign them are still abroad on service.
Another impediment arising by doubts and queries raised by the
Prizes Commissioners I have referred to the Attorney General and
enclose his report [missing] thereon. In particular with regard to
the Vigo booty I have discoursed with the Navy Commissioners
and the Receiver of Prizes the proposal of the Prizes Commissioners
for paying out a part of the shares to the captors, leaving
the making up of the just proportions until the lists and accounts
are perfected and I thereupon directed such lists to be drawn by the
last musters before the action at Vigo. On the whole matter I
desire that the doubts in the former Declaration may be explained
[by an Explanatory Declaration] and that the above interim
distribution may be made : which will in some measure take off the
discouragement which the seamen have too long lain under for want

and profits of the Honor of Peveril in counties Notts and Derby
together with the title of High Steward of said Honor : in order to

and his heirs for ever under a fee farm of 14 marks per an. In the
last year of Hy. VIII Hugh Revell the right heir of said Eland
sold the bailiffship for 80l. to Henry Willoughby of Wollaton co.
Notts. since which time I presume it has continued in petitioner's
family. But whether the grant of Edw. I. authorised the naming
a steward to keep the Courts &c. should be referred to Queen's
Counsel. In 15 April 1664 Charles II granted the above profits
and perquisites to Charles, Earl of Norwich for 31 years and on
24 May 1673 granted same in reversion to Sir John Packington,
Reginald Graham and Geo. Legg (afterwards Lord Dartmouth) in
trust for Penelope, Katherine, Eliz. and Mary the 4 daughters of
Col. Washington deceased for 31 years. By indenture of 1699
May 15 (the said Mary being dead) Katherine and Penelope
released to Eliz, their sister, then wife of Stephen Gellot, who in
1690 assigned to Robert King in trust for James Selby, who in 2 Jan.
1698-9 assigned to Henry Jenkins, who in 15 May 1699 assigned to
James Winstanley, who, I presume, is a trustee for the present
petitioner. The High Stewardship had been previously granted
by James I to Sir George Goring, father of said Earl of Norwich.
The royalties formed part of the Queen Dowager's jointure but
the rent being not well paid she surrendered and had a reprisal.
In 1700 Dec. 28 Hen. Jenkins obtained a lease of the premises as
a concealment, on condition of asserting the Crown's title at his
own charge : which grant the petitioner has bought up. I value
a 31 years' lease at 500l. I take it that a grant to him and his heirs
[for ever] is restrained by Act of Parliament.
(b) Statement of opinion by Sir Simon Harcourt dated 1703
July 5. The Crown may grant to petitioner and his heirs notwithstanding
the Act of 1 Anne c. 7 save the mines of coal and iron
and the quarries of stone.

Towne, one of the brokers in the City of London, shewing that
he was employed by Mr. Edwards and Mr. John Gill to buy a
parcel of brandies that was seized by one Clarke, an officer of the
Customs, and by the said Edwards who is an officer of the Excise,
which amounted to 1725l. 5s. 5d. : but soon after found out that
Edwards and Gill had only made use of him to embarass the seizure
of the said Clarke, they having exhibited informations in the
Exchequer to try the priority of seizure : that petitioner acquainted
the Customs Commissioners therewith and the brandies were again
set up for sale and sold for 1551l. 5s. 8d. and the Attorney General
has exhibited an English bill against petitioner for the difference
